GOVERNMENT PLEADER for\nRespondent(s) : 1, \nNone for Respondent(s) : 2 -\n3. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.<br \/>\nHeard Mr. Jasani, learned advocate for the petitioner.\n<\/p>\n<p id=\"p_1\">2.<br \/>\nPresent petition is preferred seeking below mentioned relief\/s:-\n<\/p>\n<p id=\"p_2\">&#8220;6(A)<br \/>\nYOUR LORDSHIPS may be pleased to issue an appropriate writ, order or<br \/>\ndirection, by quashing and setting aside the impugned order dated<br \/>\n29.12.2005 passed by the respondent District Education Officer<br \/>\nraising the recovery of amount Rs.3,50,150\/- being violative of<br \/>\nArticles 14 and 16 of the Constitution of India and against the<br \/>\nprinciples of natural justice.\n<\/p>\n<p id=\"p_3\">(B)<br \/>\nYOUR LORDSHIPS may be pleased to issue an appropriate writ, order or<br \/>\ndirection, directing the respondent District Education Officer to<br \/>\nrepay the amount of Rs.1,58,520\/- which was recovered unauthorizedly<br \/>\nwith interest to the petitioner school forthwith.\n<\/p>\n<p id=\"p_4\">(C)&#8230;&#8230;..\n<\/p>\n<p id=\"p_5\">(D)&#8230;&#8230;..&#8221;\n<\/p>\n<p id=\"p_6\">3.<br \/>\nAs can be seen from the relief prayed for by the petitioner, the<br \/>\npetitioner has preferred present petition against order dated<br \/>\n29.12.2005. Differently put, the petition is preferred almost after<br \/>\nmore than 5 years against the order which was passed way back in<br \/>\nDecember 2005.\n<\/p>\n<p id=\"p_7\">4.<br \/>\nIn view of the said delay in challenging the order, the Court is not<br \/>\ninclined to interfere with the said order at this stage.\n<\/p>\n<p id=\"p_8\">5.<br \/>\nIt is, however required to be noted and clarified that the petitioner<br \/>\nhas preferred petition and challenged the order on ground of<br \/>\nviolation of principles of natural justice. It prima facie appears<br \/>\nthat the decision to recover specified amount was taken and order was<br \/>\npassed without any Notice or hearing. However, since the facts which<br \/>\nmay come out from the record of the respondent is not available on<br \/>\nthe record of present petition, therefore any view<br \/>\n     with regard to the alleged violation of principle of natural<br \/>\njustice cannot be formed, at this stage.\n<\/p>\n<p id=\"p_9\">6.<br \/>\nMr. Jasani, learned advocate for the petitioner has relied upon the<br \/>\ncommon order dated 31.3.2006 passed in SCA No.5771 of 2006 and allied<br \/>\nmatters.\n<\/p>\n<p id=\"p_10\">7.<br \/>\nThe said order would not help the petitioner at this stage for the<br \/>\nsimple reason that in the said case the petitioner had approached the<br \/>\nCourt immediately when the cause of action arose i.e. in 2006.<br \/>\nSimilar is the case in respect of order dated 30.11.2009 passed in<br \/>\nSCA No.11345 of 2009. In the said case the petitioner had approached<br \/>\nthe Court, in 2009, against the order dated 30.5.2009 and the order<br \/>\nin the petition came to be passed on 30.11.2009.\n<\/p>\n<p id=\"p_11\">8.<br \/>\nWhereas in present case the petitioner has preferred petition after<br \/>\nmore than five years.\n<\/p>\n<p id=\"p_12\">9.<br \/>\nFor the said reason the Court is not inclined to entertain the<br \/>\npetition and also not inclined to enter into the merits of the<br \/>\ngrievance made by the petitioner.\n<\/p>\n<p id=\"p_13\">10.<br \/>\nMr. Jasani, learned advocate for the petitioner has submitted that<br \/>\nthe petitioner has already approached the High Power Committee,<br \/>\nhowever the said committee has not taken any decision as regards the<br \/>\nrepresentation and grievance made by the petitioner.\n<\/p>\n<p id=\"p_14\">11.<br \/>\nIt is not clear as to whether the said Committee     is authorized &#8211;<br \/>\ncompetent to entertain any application or representation against the<br \/>\ncompetent authority&#8217;s order regarding recovery or not. However, since<br \/>\nthe petitioner has already approached the said High Power Committee,<br \/>\nlearned advocate for the petitioner has submitted that appropriate<br \/>\ndirection to the Committee to pass order with regard to the<br \/>\npetitioner&#8217;s application \/ representation may be passed.\n<\/p>\n<p id=\"p_15\">12.<br \/>\nHaving regard to the said submission it                appears that<br \/>\nthe petition may be disposed of with the observation the observation<br \/>\nthat the application \/ representation made by the petitioner against<br \/>\nthe communication dated 29.12.2005, which might be pending before the<br \/>\nHigh Power Committee, may be decided as early as possible and<br \/>\npreferably within 8 weeks from today. The decision on such<br \/>\nrepresentation will not be a cause to challenge the same i.e.<br \/>\ndecision on the representation.\n<\/p>\n<p id=\"p_16\">13.<br \/>\nWith the aforesaid observation the petition stands disposed of.\n<\/p>\n<p id=\"p_17\">14.<br \/>\nIt is reiterated and clarified that in view of the delay and laches<br \/>\nthe petition has not been entertained.
