Nagar West) detailed for cleanliness.\n<\/p>\n<p id=\"p_3\">   b) Name and place where these had been posted including details of sanity inspector\/ASI.\n<\/p>\n<p id=\"p_4\">   c) Number of Buggis with name of their owner, rickshaws, trucks with its registration number and<br \/>\n      driver&#8217;s name.\n<\/p>\n<p id=\"p_5\">   d) Number of employees deputed for the house of area councilor.\n<\/p>\n<p id=\"p_6\">   e) Copy of attendance register mentioning attendance of all the employees (In regard to whom<br \/>\n      information had been sought) and whether there were any irregularity.\n<\/p>\n<p id=\"p_7\">Reply of the PIO:\n<\/p>\n<p id=\"p_8\">Not replied.\n<\/p>\n<p id=\"p_9\">Ground of First Appeal:\n<\/p>\n<p id=\"p_10\">Non-receipt of information from the PIO within the stipulated time.\n<\/p>\n<p id=\"p_11\">First Appellate Authority ordered:\n<\/p>\n<p id=\"p_12\">The FAA in its order stated that Mr. Shehander Singh, SS had informed that the reply has been<br \/>\nprepared and forwarded to the PIO on 06\/10\/2009. The FAA further directed the AC\/PIO to supply the<br \/>\ninformation to the Appellant within three days from issue of the order.\n<\/p>\n<p id=\"p_13\">Ground of the Second Appeal:\n<\/p>\n<p id=\"p_14\">Non compliance of the order of the FAA by the PIO.\n<\/p>\n<p id=\"p_15\"> Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_16\">The following were present:\n<\/p>\n<p id=\"p_17\">Appellant : Mr. Hitender Kumar;\n<\/p>\n<p id=\"p_18\">Respondent : Mr Gajendra Singh, CSI on behalf of Mr. Ravideep Singh Chahar PIO &amp; AC;\n<\/p>\n<p id=\"p_19\">              Mr. Raman Kumar, RTI Clerk;\n<\/p>\n<p id=\"p_20\">       The PIO claims that he sent the information to the Appellant on 20\/10\/2009. The Appellant<br \/>\nclaims that he has not received this. The Appellant was given the information infront of the<br \/>\nCommission and he shows that this information is also incomplete in the following respect:<br \/>\n1-     Query-2:      Information about the number of people in the various beats has not been<br \/>\n       provided along with the list.\n<\/p>\n<p id=\"p_21\">2-     Query-3:      The complete information will be provided to the Appellant.<br \/>\n3-     Query-5:      The complete information giving photocopies of the attendance register will be<br \/>\n       provided.\n<\/p>\n<p id=\"p_22\">The RTI application was filed on 17\/08\/2009. According to the appellant he is receiving the<br \/>\ninformation only before the Commission. The PIO claims that the information was sent on 20\/10\/2009.<br \/>\nIt is significant that before the First Appellate Authority it was claimed by Mr. Sahender Singh, SS that<br \/>\nthe information had been prepared and forwarded to the PIO on 06\/10\/2009. Mr. Raman Kumar states<br \/>\nthat the information had been sent on 20\/10\/2009 to the Appellant by speed post. The PIO Mr.<br \/>\nRavideep Singh Chahar will get the speed post receipt by which it is claimed to have sent the<br \/>\ninformation on 20\/10\/2009.\n<\/p>\n<p id=\"p_23\">Decision:\n<\/p>\n<p id=\"p_24\">The Appeal is allowed.\n<\/p>\n<p id=\"p_25\">      The PIO is directed to provide the information as directed above to the Appellant before 05<br \/>\nMarch 2010.\n<\/p>\n<p id=\"p_26\">The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p id=\"p_27\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. He has further refused to obey the orders of his superior officer, which<br \/>\nraises a reasonable doubt that the denial of information may also be malafide. The First Appellate<br \/>\nAuthority has clearly ordered the information to be given. It appears that the PIO&#8217;s actions attract the<br \/>\npenal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause notice is being issued to him, and he is directed give<br \/>\nhis reasons to the Commission to show cause why penalty should not be levied on him.\n<\/p>\n<p id=\"p_28\">Mr. Ravideep Singh Chahar will present himself before the Commission at the above address on 19<br \/>\nMarch 2010 at 3.00pm alongwith his written submissions showing cause why penalty should not be<br \/>\nimposed on him as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1). He will also submit proof of having given the<br \/>\ninformation to the appellant.
