(J)\n\nCITATION:\n 1996 AIR  333\t\t  1996 SCC  (1) 554\n JT 1995 (7)   151\t  1995 SCALE  (5)422\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p id=\"p_1\">     This appeal  by special  leave arises from the order of<br \/>\nthe Single  Judge dated\t December 17, 1990 of the High Court<br \/>\nof Allahabad  made in  Civil Misc.  W.P. No.706\t of 199. The<br \/>\nundisputed facts  are that the appellant and Mrs. Geeta, the<br \/>\nrespondent, are\t legally married  couple. Their marriage was<br \/>\nsolemnized on  November 22,  1981. The\trespondent laid\t the<br \/>\nproceedings under  <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section  125<\/a>\t of  the  Code\tof  Criminal<br \/>\nProcedure, 1973\t [for short,`the Code&#8217;] on July 14, 1987 for<br \/>\nmaintenance on the ground that the appellant is impotent and<br \/>\nhe  neglected\ther  and   that,  therefore,   she   claimed<br \/>\nmaintenance for\t separate residence  from the appellant. The<br \/>\nlearned magistrate  awarded a  sum  of\tRs.500\/-  per  month<br \/>\nw.e.f. the  date of  filing of the petition. On revision the<br \/>\nSessions Judge\tconfirmed the same. The High Court dismissed<br \/>\nthe writ  filed under  <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a>  of the  Constitution  of<br \/>\nIndia by  the impugned\torder. Thus,  this appeal by special<br \/>\nleave.\n<\/p>\n<p id=\"p_2\">     The only  question\t raised\t by  Shri  S.C.\t Birla,\t the<br \/>\nlearned counsel for the appellant, is that the appellant had<br \/>\nnot neglected  to maintain  Mrs. Geeta.\t The very foundation<br \/>\nfor claiming maintenance under s.125<a href=\"\/doc\/445276\/\" id=\"a_2\"> of the Code<\/a> is that the<br \/>\nappellant had  neglected to maintain the respondent and that<br \/>\nthe respondent\twas not having sufficient means for her self<br \/>\nmaintenance. We\t are unable  to agree  with  the  appellant.<br \/>\n<a href=\"\/doc\/1695755\/\" id=\"a_3\">Section 125(1)<\/a> of the Code envisages that:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;(1) If  any  person  having  sufficient<br \/>\n     means neglects or refuses to maintain-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     (a)  his\twife,  unable\tto   maintain<br \/>\n     herself, or\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     (b) xxxxxxxxxxxxxxxx\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     (c) xxxxxxxxxxxxxxxx\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     (d) xxxxxxxxxxxxxxxx<br \/>\n     a Magistrate  of the  first  class\t may,<br \/>\n     upon proof\t of such  neglect or refusal,<br \/>\n     order such\t person\t to  make  a  monthly<br \/>\n     allowance for  the\t maintenance  of  his<br \/>\n     wife or such child, father or mother, at<br \/>\n     such monthly  rate\t not  exceeding\t five<br \/>\n     hundred rupees  in the  whole,  as\t such<br \/>\n     Magistrate thinks\tfit, and  to pay  the<br \/>\n     same to  such person  as the  Magistrate<br \/>\n     may from time to time direct.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">     The courts below found as a fact that the appellant was<br \/>\nimpotent  and\the  was\t  not  capable\t of  giving   sexual<br \/>\nsatisfaction to\t the respondent,  in consequence, it amounts<br \/>\nto cruelty  and that,  therefore, the respondent is entitled<br \/>\nto live\t separately from the appellant. Since she was unable<br \/>\nto maintain  herself, she  is entitled\tto seek\t maintenance<br \/>\nfrom the  appellant. We find that the view taken by the High<br \/>\nCourt is  well justified.  The controversy  is no longer res<br \/>\nintegra.\n<\/p>\n<p id=\"p_4\">     <a href=\"\/doc\/1317023\/\" id=\"a_4\">In\t Sirajmohmedkhan   Janmohanadkhan  vs.\t Hafizunnisa<br \/>\nYasinkhan and  Anr<\/a>. [(1982 1 SCR 695], this Court considered<br \/>\nthe questing  arising in the proceedings under s.125 itself.<br \/>\nThis court held that:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>     &#8220;If this  is so,  can it  be said by any<br \/>\n     stretch of imagination that where a wife<br \/>\n     refuses to\t live with her husband, if he<br \/>\n     is impotent  and unable to discharge his<br \/>\n     marital obligation,  this would not be a<br \/>\n     just ground  for refusing\tto live\t with<br \/>\n     her husband when it seems to us that the<br \/>\n     ground of\timpotence which had been held<br \/>\n     by a  number of  authorities  under  the<br \/>\n     civil law\tto be  a good ground not only<br \/>\n     for restitution  of conjugal  rights but<br \/>\n     also for  divorce. Indeed, if this could<br \/>\n     be a ground for divorce or for an action<br \/>\n     for  restitution\tof  conjugal  rights,<br \/>\n     could it  be said with any show of force<br \/>\n     that it  would not\t be a just ground for<br \/>\n     the wife  to refuse  to  live  with  her<br \/>\n     husband.  The  matter  deserves  serious<br \/>\n     attention from  the point of view of the<br \/>\n     wife. Here\t is a  wife who\t is forced or<br \/>\n     compelled to  live a  life\t of  celibacy<br \/>\n     while staying  with her  husband who  is<br \/>\n     unable to\thave sexual relationship with<br \/>\n     her. Such a life is one of the perpetual<br \/>\n     torture, which  is not  only mentally or<br \/>\n     psychologically injurious\tbut even from<br \/>\n     the   medical    point   of   view,   is<br \/>\n     detrimental to  the health of the woman.<br \/>\n     Surely, the  concept of  mental  cruelty<br \/>\n     cannot be\tdifferent in a civil case and<br \/>\n     in a  criminal case  when the attributes<br \/>\n     of such a cruelty are the same.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     xxxx    xxxx   xxx<br \/>\n\t  We hold  that where it is proved to<br \/>\n     the satisfaction  of the  court  that  a<br \/>\n     husband is\t impotent and  is  unable  to<br \/>\n     discharge his  marital obligations, this<br \/>\n     would amount  to both  legal and  mental<br \/>\n     cruelty which  would  undoubtedly\tbe  a<br \/>\n     just  ground   as\tcontemplated  by  the<br \/>\n     aforesaid proviso for the wife&#8217;s refusal<br \/>\n     to live  with her\thusband and  the wife<br \/>\n     would be  entitled to  maintenance\t from<br \/>\n     her husband according to his means.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">     Accordingly,  it  was  held  that\tthe  wife  would  be<br \/>\nentitled to  maintenance under\ts.125 (1)<a href=\"\/doc\/445276\/\" id=\"a_5\">  of the  Code<\/a>. The<br \/>\nwoman would  go to  the marital\t home of her husband, with a<br \/>\nfond hope  and expectation  that she  would have  not only a<br \/>\nhappy but  also peaceful  conjugal society with her husband.<br \/>\nWhen she  found that her husband is unable to perform sexual<br \/>\nobligation, which  is one of the important factors to cement<br \/>\nbondage of  affection and  cordial relationship\t in  marital<br \/>\nhome, it  would be  perpetual agony for the wife to continue<br \/>\nto live\t in peace  in the conjugal home. Cruelty is a ground<br \/>\nfor divorce  or judical separation in civil law. Under these<br \/>\ncircumstances,\tshe   would  be\t  well\tjustified   to\tlive<br \/>\nseparately with\t the husband  and  at  the  same  time\tkeep<br \/>\nmaintaining married status.\n<\/p>\n<p id=\"p_6\">     It is  seen that  in the  letter addressed\t on June 27,<br \/>\n1985 by\t the appellant\thimself to his father-in-law, he had<br \/>\nstated that  &#8220;the root\tcause of  their\t problem&#8221;  with\t the<br \/>\nrespondent &#8220;is\tfailure of sexual life&#8221;. He admitted therein<br \/>\nthat  his   father-in-law  advised   him  to   read  certain<br \/>\nliterature thereon.  In his  cross-examination\the  admitted<br \/>\nthat his  wife had  advised him\t medical treatment. It would<br \/>\nmean that  apart from  other problems that had come in their<br \/>\nway, the  main problem\tis the failure on his part of sexual<br \/>\nlife.  It   would  be  seen  that  the\trespondent  had\t not<br \/>\nimmediately rushed  to severe her marital relations with the<br \/>\nappellant. She\thad sufficiently waited for long time to see<br \/>\nwhether there would be any improvement in the potency of the<br \/>\nappellant.  Having   found  no\t hope,\tshe  chose  to\tlive<br \/>\nseparately from the appellant. Therefore, it could safely be<br \/>\nconcluded that\tthe respondent\thaving tried  all  means  to<br \/>\nsustain the  marital relations\tbut having found that it was<br \/>\nimpossible for the appellant to gain potency, she had chosen<br \/>\nto live\t apart from  the  appellant.  Therefore,  there\t was<br \/>\nsufficient ground for the wife to live separately.\n<\/p>\n<p id=\"p_7\">     It\t is  next  contended  for  the\tappellant  that\t the<br \/>\nrespondent had\tsufficient means  and she  can live  herself<br \/>\ncomfortably  and   is  thus   not  entitled   to  claim\t any<br \/>\nmaintenance from  the appellant.  We find  no force  in\t the<br \/>\ncontention. It is seen that the appellant is an Army officer<br \/>\nand is\thaving sufficient  means to  maintain his  wife. The<br \/>\namount of  Rs.500\/- per\t month being  the  maximum  provided<br \/>\nunder<a href=\"\/doc\/445276\/\" id=\"a_6\"> the  Code<\/a>, the  learned Magistrate  is well justified,<br \/>\nunder the  circumstances, to  award this  meagre sum  to the<br \/>\nrespondent towards her maintenance.\n<\/p>\n<p id=\"p_8\">     The appeal is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Major Ashok Kumar Singh vs Vith Addl.
