Justice ANTONY DOMINIC\n\n Dated :17\/06\/2009\n\n O R D E R\n                        ANTONY DOMINIC, J.\n                      ================\n                  W.P.(C) NO. 16750 OF 2009 (K)\n                  =====================\n\n              Dated this the 17th day of June, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      It is stated that pursuant to Ext.P1, an enquiry under Section<\/p>\n<p>65 was conducted into the affairs of the society, of which the<\/p>\n<p>petitioner is the President and a report was submitted. Acting<\/p>\n<p>upon the report so received, the 1st respondent has now issued<\/p>\n<p>Ext.P2 show cause notice to the petitioner calling upon the<\/p>\n<p>petitioner to furnish their explanations in the matter.<\/p>\n<p id=\"p_1\">      2.     Petitioner has two grievances. One is that copy of the<\/p>\n<p>report submitted, based on which Ext.P2 has been issued, has not<\/p>\n<p>been furnished. Secondly, they should also get an opportunity to<\/p>\n<p>make their representations in the matter before final orders are<\/p>\n<p>passed in pursuance to Ext.P2.\n<\/p>\n<p id=\"p_2\">      3.     Having heard the counsel for the petitioner and the<\/p>\n<p>learned Government Pleader, I think the petitioner is justified in<\/p>\n<p>the submissions made.\n<\/p>\n<p id=\"p_3\">      4.     Therefore, the writ petition is disposed of with the<\/p>\n<p>following directions.\n<\/p>\n<p id=\"p_4\">      (1)    That on production of a copy of this judgment, the 1st<\/p>\n<p>WPC 16750\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :2 :<\/span><\/p>\n<p>respondent shall furnish a copy of the report on the basis of which<\/p>\n<p>Ext.P2 notice has been issued to the petitioner.<\/p>\n<p id=\"p_5\">      (2)  It is directed that in order to enable the petitioner to<\/p>\n<p>file an effective reply to Ext.P2, the time for filing the reply will<\/p>\n<p>also stand enlarged by 2 weeks from the date of service of the<\/p>\n<p>copy of the report.
