Justice ANTONY DOMINIC\n\n Dated :20\/02\/2008\n\n O R D E R\n                              ANTONY DOMINIC, J.\n\n\n\n                ------------------------------------\n\n\n\n                             W.P.(C) 6001  of  2008\n\n\n\n               -------------------------------------\n\n\n\n                           Dated: February 20, 2008\n\n\n\n                                    JUDGMENT\n<\/pre>\n<p id=\"p_1\">       The   challenge   is   against  Ext.P15,   an   order   passed   by   the   2nd<\/p>\n<p>respondent, cancelling the patta granted to the petitioner under the<\/p>\n<p>Cardamom Rules of 1935 and ordering resumption of the land.   In<\/p>\n<p>terms of Rule 38 of the Cardamom Rules itself, an appellate remedy<\/p>\n<p>is provided to the Land Revenue Commissioner.  Since the statutory<\/p>\n<p>remedy of appeal is available as above. I do not think it proper for<\/p>\n<p>this court to examine the merits of the contentions at least at this<\/p>\n<p>stage.\n<\/p>\n<p id=\"p_1\">       2.     Therefore   I   dispose   of   this   writ   petition   directing     the<\/p>\n<p>petitioner   to   pursue   the   statutory   remedy   of   appeal   to   the   Land<\/p>\n<p>Revenue Commissioner.   It is directed that if the petitioner files an<\/p>\n<p>appeal within three weeks from today, the same will be entertained<\/p>\n<p>and   the   appeal   will   be   considered     on   merits   with   notice   to   the<\/p>\n<p>WP(C) 6001\/08<\/p>\n<p>                                  Page numbers<\/p>\n<p>petitioner and within six weeks orders will be passed by the   Land<\/p>\n<p>Revenue   Commissioner.
