JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. Ashindra Gautam, for the petitioner.\n<\/p>\n<p id=\"p_1\">Mr. Amit Punia, Public Prosecutor.\n<\/p>\n<p id=\"p_2\">\t\tThis order governs the disposal of  bail application filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of Cr.P.C. by Mr. Ashindra Gautam Advocate on behalf of the applicant Balram Meena pertaining to F.I.R. No. 316\/2009 of Police Station Kotwali, Sawai Madhopur, District Sawai Madhopur in the offences under <a href=\"\/doc\/1101188\/\" id=\"a_1\">Sections 379<\/a> of IPC.\n<\/p>\n<p id=\"p_3\">2.\t\tHeard the learned counsel for the petitioner as also the learned Public Prosecutor appearing for the State and perused the relevant material available on record.\n<\/p>\n<p id=\"p_4\">3.\t\tLearned counsel for the petitioner has contended that he has been falsely implicated and is in no way connected with the commission of the offences of the instant case. The petitioner has been custody for quite a long time and the case is pending investigation, hence, he may be granted indulgence of bail.\n<\/p>\n<p id=\"p_5\">4.\t\tLearned Public Prosecutor has opposed the bail application primarily on the ground that seven other criminal cases of alike nature are pending against him and he is a habitual offender, as such, bail petition may be dismissed.\n<\/p>\n<p id=\"p_6\">5.\t\tHaving considered the submissions made at the bar and scanned the relevant material on record, it is noticed that seven other criminal cases of alike nature are pending against him.
