      Petitioner is a Scientist in the first respondent-organisation. He<\/p>\n
was awarded the prestigious ‘Ramanujam Fellowship’ by the Indian<\/p>\n
Institute of Science, Bangalore. He applied for leave for taking up the<\/p>\n
said assignment. Leave was not granted. It is under the above<\/p>\n
circumstances, the petitioner has filed this Writ Petition seeking the<\/p>\n
following reliefs:\n<\/p>\n
      “i)   issue a writ in the nature of certiorari or any other<\/p>\n
             appropriate writ, direction or order calloing for<\/p>\n
             othe records leading to the decision contained in<\/p>\n
             the letter No.1736\/C2\/08\/KSCSTE dated 18.8.2008<\/p>\n
             of the 3rd respondent referred to as No.4 in Ext.P2<\/p>\n
             and Ext.P2 and quash the same;<\/p><\/blockquote>\n
\n\n      ii)     issue a writ in the nature of mandamus or any\n\n             other   appropriate      writ,    direction     or order\n\n             commanding the         Respondents 3 and 4 to\n\n<\/pre>\n
             reconsider the request of the petitioner for leave<\/p>\n
             as early as possible, within a time frame to be<\/p>\n
             fixed by this Hon’ble Court; and<\/p>\n<\/blockquote>\n
      iii)  issue such other appropriate direction or order as<\/p>\n
             the case may be.”\n<\/p><\/blockquote>\n

      2. On 3.10.2008 this Court passed the following interim order:<\/p>\n<\/blockquote>\n
                    “Admit. Advocate Sri.E.K.Madhavan takes notice<\/p>\n
             for respondents 1 and 2.       Advocate Sri.P.A.Ahamed<\/p>\n
             takes notice for respondents 3 and 4. Heard the learned<\/p>\n
             counsel appearing for the petitioner and the learned<\/p>\n
             counsel appearing for the respondents. There will be an<\/p>\n
             interim order directing the respondents to grant the<\/p>\n
             petitioner study leave for a period of one year from the<\/p>\n
             date of sanction as to enable him to do research work in<\/p>\n
             the Indian Institute of Science, Bangalore pursuant to<\/p>\n
             the award of Ramanujam Fellowship instituted by the<\/p>\n
             Government of India.    This shall be done within two<\/p>\n
             weeks from today.”\n<\/p><\/blockquote>\n
Again this Court passed an interim order on 25.6.2009, which reads<\/p>\n
as follows:\n<\/p><\/blockquote>\n
                   “Heard learned counsel appearing on both sides.<\/p>\n
            Though the 3rd respondent vehemently opposes the<\/p>\n
            grant of the relief prayed for in this application, on going<\/p>\n
            through Ext.P12 and the stipulations in the rules referred<\/p>\n
            to therein, I am prima facie satisfied that the<\/p>\n
            respondents are bound to conduct an assessment of the<\/p>\n
            petitioner for assessment promotion for the period 2003-<\/p>\n
            2008.     There will accordingly be, an interim order<\/p>\n
            directing the respondents to assess the petitioner if he<\/p>\n
            presents himself at this own expense tomorrow before<\/p>\n
            the Assessment Committee constituted by the first<\/p>\n
            respondent. It is clarified that even if the petitioner is<\/p>\n
            found eligible for promotion after assessment by the<\/p>\n
            committee, orders giving promotion to him need not be<\/p>\n

            issued until further orders. The respondents shall after<\/p>\n
            the assessment is conducted file an affidavit in this<\/p>\n
            Court as regards the decision taken by the Assessment<\/p>\n
            Committee.”\n<\/p><\/blockquote>\n
Still further another interim order was passed by this Court on<\/p>\n
25.8.2009, which reads as follows:\n<\/p><\/blockquote>\n
                    “Heard the learned counsel appearing on both<\/p>\n
            sides.  While admitting this case on 03.10.2008, this<\/p>\n
            Court had passed an interim order directing the<\/p>\n
            respondents to grant the petitioner study leave for a<\/p>\n
            period of one year from the date of sanction in order to<\/p>\n
            enable him to do research work in the Indian Institute of<\/p>\n
            Science,   Bangalore,    pursuant  to   the   award    of<\/p>\n
            Ramanujam Fellowhsip instituted by the Government of<\/p>\n
            India.  As directed by this Court, the petitioner was<\/p>\n
            granted leave without allowances for a period of one<\/p>\n
            year. The said period of leave expires on 01.09.2009. A<\/p>\n
            prestigious   fellowship  has  been    awarded    to  the<\/p>\n
            petitioner, which the respondents should be proud to<\/p>\n
            proclaim from the roof top.        However, the third<\/p>\n
            respondent is determined to ensure that the petitioner is<\/p>\n
            not in a position to take up the research work.      The<\/p>\n
            stand adopted by the third respondent would, in my<\/p>\n
            opinion, defeat the very purpose for which the Council<\/p>\n
            was created.     I am therefore satisfied that the leave<\/p>\n
            sanctioned to the petitioner requires to be extended by<\/p>\n
            a further period of one year.\n<\/p><\/blockquote>\n
                   I accordingly direct the competent authority<\/p>\n
            among the respondents to sanction to the petitioner<\/p>\n
            leave without allowances for a further period of one year<\/p>\n

            from 01.09.2009. Necessary orders in that regard shall<\/p>\n
            be issued expeditiously and in any event before<\/p>\n
            01.09.2009.”\n<\/p><\/blockquote>\n
I passed an order dated 16.9.2010 as follows:<\/p>\n<\/blockquote>\n
                    “The learned counsel for the 2nd respondent<\/p>\n
             produces before me the result of the Assessment held<\/p>\n
             on 26th June 2009 for Assessment promotion of the<\/p>\n
             petitioner, as directed in I.A. No.7302\/2009 by order<\/p>\n
             dated 25.06.2009, which reads as follows:<\/p>\n<\/blockquote>\n
                           “In   compliance     with    the
\n                     decision of the Hon’ble High Court in
\n                     I.A. No.7302 of 2009 in W.P.(C)
\n                     No.26253 of 2008, Dr. C.P.Rajendran,
\n                     Scientist-E 2 was assessed by the
\n                     Assessment        Committee         on
\n                     26.06.2009.    The Committee found
\n                     him suitable for promotion to the next
\n                     higher grade of Scientist-F with effect
\n                     from 01.11.2003.”\n<\/p><\/blockquote>\n
            This is recorded.”<\/p><\/blockquote>\n
\n<\/blockquote>\n
      3. Today an order dated 28.1.2011 has been produced before<\/p>\n
me by the counsel for the 1st respondent whereby the petitioner was<\/p>\n
granted further leave without allowance for one more year with<\/p>\n
effect from 1.9.2010. Learned counsel for the petitioner submits that<\/p>\n
if the leave as granted as per interim orders of this Court and by<\/p>\n
order dated 28.1.2011 is confirmed, the petitioner would be<\/p>\n
satisfied.<\/p><\/blockquote>\n
\n
      Accordingly, the Writ Petition is closed with a direction to the<\/p>\n
respondents to regularise all the leave granted to the petitioner up<\/p>\n
   WP(C).26253\/08               5<\/span><\/p>\n
to 31.8.2011 pursuant to the interim orders of this Court and order<\/p>\n
dated 28.1.2011. The petitioner’s assessment promotion shall also<\/p>\n
be regularised in accordance with the assessment held on<\/p>\n
26.6.2009, which has been recorded by order dated 16.9.2010.<\/p>\n
