Lohan, Advocate\n            for the appellant.\n                  -----\n\nORDER:\n<\/pre>\n<p id=\"p_1\">1.          The appellant is aggrieved by rejection of his claim for<\/p>\n<p>promotion by the learned Single Judge.\n<\/p>\n<p id=\"p_1\">2.          The petitioner was employed as Patwari in the<\/p>\n<p>revenue department in the State of Haryana. For promotion to<\/p>\n<p>the post of Kanungo under the Haryana Kanungo Service (Group<\/p>\n<p>C) Rules, 1981, there is requirement of passing of qualifying<\/p>\n<p>examination.   The relevant part of the said Rule laying down<\/p>\n<p>requirement of passing departmental examination is quoted<\/p>\n<p>below:-\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\"> L.P.A. No.541 of 2009                                               2<\/span><\/p>\n<p id=\"p_2\">\n<blockquote id=\"blockquote_1\"><p>             &#8220;Field      (i) Graduate of (i)        Matriculation       or<br \/>\n             Kanungo     a      recognised equivalent examination<br \/>\n                         University       or of               recognized<br \/>\n                         Board              University or Board.\n<\/p><\/blockquote>\n<pre id=\"pre_1\">                         (ii)        Passed (ii)   Passed        the\n                         Kanungo               Kanungo examination\n                         examination           held by the Director.\"\n                         held     by     the\n                         Director.\n\n\n<\/pre>\n<blockquote id=\"blockquote_1\"><p>3.         The petitioner qualified the Kanungo examination held<\/p>\n<p>by the Director in the year 1993 while the contesting private<\/p>\n<p>respondent No.4 passed the said examination in the year 1996.\n<\/p><\/blockquote>\n<p id=\"p_3\">As per departmental instructions dated 12.4.2001, the petitioner<\/p>\n<p>was given promotion in the year 2001 when the post fell vacant,<\/p>\n<p>rejecting the claim of the contesting respondent on the ground<\/p>\n<p>that he passed the examination later, even though he was senior<\/p>\n<p>to the petitioner. The instructions were later on revised purporting<\/p>\n<p>to be in pursuance of judgment of this Court in <a href=\"\/doc\/1745045\/\" id=\"a_1\">Arjan Dev v.<\/p>\n<p>The State of Punjab and others<\/a> 1997(4) RSJ 463.                 A show<\/p>\n<p>cause notice to revert the petitioner with a view to give promotion<\/p>\n<p>to the contesting respondent was issued.               The petitioner<\/p>\n<p>challenged the show cause notice.\n<\/p>\n<p id=\"p_4\">4.         The learned Single Judge, inter-alia, relying on<\/p>\n<p>judgment of this Court in Ram Kumar Sharma               v.    State of<\/p>\n<p>Haryana 1996(6) SLR 450 which in turn refers to judgment of the<\/p>\n<p>Hon&#8217;ble Supreme Court in SLP (C) No.7294 of 1993 Haryana<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> L.P.A. No.541 of 2009                                          3<\/span><\/p>\n<p>State Agricultural Marketing Board v. Surinder Mohan<\/p>\n<p>Sharma and others decided on 14.9.1994, reported in 1999 SCC<\/p>\n<p>(L&amp;S) 731, dismissed the writ petition. Observations in the order<\/p>\n<p>of Hon&#8217;ble the Supreme Court are:-\n<\/p>\n<blockquote id=\"blockquote_2\"><p>              &#8220;It is obvious from Rule 12 of the rules, quoted<br \/>\n        above that the inter se seniority between Surinder<br \/>\n        Mohan Sharma and Dinesh Kumar could only be fixed<br \/>\n        on the basis of continuous length of service in the cadre<br \/>\n        of Sub-Divisional Officers subject to the applicability of<br \/>\n        any of the clauses under proviso to the said rule. The<br \/>\n        rule nowhere provides that the seniority is to be fixed on<br \/>\n        the basis of the date of acquiring the eligibility<br \/>\n        qualifications. The rule which was before the Full Bench<br \/>\n        in Ashok Kumar Sehgal&#8217;s case was entirely different<br \/>\n        than the rule in this case. The High Court became totally<br \/>\n        oblivious to Rule 12 of the Rules and fell into patent error<br \/>\n        in allowing the writ petition following the judgment in<br \/>\n        Ashok Kumar Sehgal&#8217;s case which has no relevance<br \/>\n        whatsoever to the present case. We, therefore, allow<br \/>\n        the appeal with costs and set aside the order of the High<br \/>\n        Court dated February 1, 1993 and dismiss the writ<br \/>\n        petition filed by Surinder Mohan Sharma before the High<br \/>\n        Court. We quantify the cost as Rs.11,000\/- to be paid by<br \/>\n        respondent No.1 Surinder Mohan Sharma to respondent<br \/>\n        No.3 Dinesh Kumar.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_5\">The Hon&#8217;ble Supreme Court, thus, observed that continuous<\/p>\n<p>length of service was the basis for inter se seniority and not<\/p>\n<p>passing of the qualifying examination and promotion had to be<\/p>\n<p>given on that basis.    There is no contrary rule, in the present<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> L.P.A. No.541 of 2009                                            4<\/span><\/p>\n<p>case, about seniority being linked to passing of examination. This<\/p>\n<p>being the position, the contesting respondent continued to remain<\/p>\n<p>senior to the appellant irrespective of the date on which the<\/p>\n<p>qualifying examination was passed. On the date on which the<\/p>\n<p>post was to be filled up, the contesting respondent was senior to<\/p>\n<p>the appellant and had already passed the examination.             His<\/p>\n<p>eligibility and seniority could not be ignored, unless the rule<\/p>\n<p>specifically provided the passing of eligibility qualification earlier<\/p>\n<p>to be the basis for giving preference in promotion. No doubt there<\/p>\n<p>will be hardship to the appellant who is said to have worked for<\/p>\n<p>eight years, the fact remains that there is only one post and the<\/p>\n<p>contesting respondent is senior to the appellant and was eligible<\/p>\n<p>on the relevant date.\n<\/p>\n<p id=\"p_6\">5.          In view of above, we do not find any ground to<\/p>\n<p>interfere with the view taken by the learned Single Judge.<\/p>\n<p id=\"p_7\">6.
