Heard Mr. Ambika Bhagat learned counsel for the<\/p>\n<p>                   petitioner and learned counsel for the State.\n<\/p>\n<p id=\"p_1\">                               The petitioner apprehends his arrest in connection with a<\/p>\n<p>                   case registered for the offence punishable under <a href=\"\/doc\/1436241\/\" id=\"a_1\">sections 420<\/a>, <a href=\"\/doc\/940928\/\" id=\"a_1\">407<\/a>,<\/p>\n<p>                   <a href=\"\/doc\/556166\/\" id=\"a_2\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_3\">471<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_4\">120B<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_2\">                               The prosecution case in brief, according to the<\/p>\n<p>                   informant, who is B.D. O, Barhat, is that certain irregularities were<\/p>\n<p>                   done by the Mukhiya and the Panchyat Sachiv, a co-accused, in<\/p>\n<p>                   appointment of the teachers. They did not abide by order of the<\/p>\n<p>                   appellate authority. Even after the order of the appellate authority,<\/p>\n<p>                   they did not prepare a fresh merit list and in place of fresh<\/p>\n<p>                   appointment, the appointment made earlier was confirmed.<\/p>\n<p id=\"p_3\">                               It is submitted on behalf of the petitioner that there was<\/p>\n<p>                   no irregularity in appointment of the teachers. As per the direction<\/p>\n<p>                   of the appellate authority, recounselling was done and the<\/p>\n<p>                   complainant Ranjit Kumar and others had not submitted their<\/p>\n<p>                   relevant documents at the time of recounselling and thus they could<\/p>\n<p>                   not be appointed. It is also submitted that even if the allegation made<\/p>\n<p>                   in the first information report is to be believed, the offence as<\/p>\n<p>                   alleged would not be attracted. The petitioner is a lady and is an Ex-<\/p>\n<p>                   Mukhiya. She is not likely to abscond or tamper with the evidence.<\/p>\n<p id=\"p_4\">                               Be that as it may, considering the facts and<\/p>\n<p>                   circumstances of the case and specifically taking into account the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>        fact that the petitioner is a lady, let the petitioner named above in<\/p>\n<p>        the event of arrest or surrender before the court below within a<\/p>\n<p>        period of four weeks from the date of receipt\/communication of the<\/p>\n<p>        order be released on bail on furnishing bail bonds of Rs.5,000\/- (five<\/p>\n<p>        thousand) with two sureties of the like amount each to the<\/p>\n<p>        satisfaction of learned C.J.M, Jamui in connection with Barhat P.S.<\/p>\n<p>        Case No.27 of 2011 subject to the conditions as laid down under<\/p>\n<p>        <a href=\"\/doc\/1692057\/\" id=\"a_5\">section 438(2)<\/a> of the Code of Criminal Procedure.<\/p>\n<pre id=\"pre_1\">Md.S.
