\ngranted why’ \u00abthe :A’ssVt.._\u00bbi’Cjoiniimissioner on 12.01.95 vide<\/p>\n
orders as atiA~nniexu’i*es”vBto B5. The second petitioner was<\/p>\n
 a.lsov-iperrpstted by th’e”‘said authority, to purchase the lands<\/p>\n
 egerrieeior’rije_,power conferred under S.79A and 795 of<\/p>\n
rrre,r;amararesri2Lane Reforms Act, 1961 (for short ‘the<\/p>\n
Act’). Th_e”;petitioners ciaim that, they being agricuiturists,<\/p>\n
  “possessing agricuiturai lands in the State, did not suffer<\/p>\n
  any disabiiity, under the provisions of the said Act, in<\/p>\n
running the resorts, the Governmental Authorities, granted<\/p>\n
ciearance for estabiishing of jungle resorts by <\/p>\n
Colarado Resorts (I) Pvt. Ltd. The petitioners:,,”i:EaVir:n’<\/p>\n

the Asst. Co’ir1;niss,i’onevr and after finding that, the lands<\/p>\n

‘resorts,1″-the\u00e9”conversion sought was granted. The<\/p>\n
peti’t,i_oners,we.re called upon to remit the conversion fine,<\/p>\n

\nifhe_Vfo_,rd’e’r~s.  Karnataka SC \/ ST<\/p>\n
.’:of\u00a2.:’_Tran.svfVe’r of Certain Lands) Act,
\nA 1978,’ it”was_fai.s’oV.,.observed that, the Authority
\n‘s_hiou|d” tai~:’e\u00bb’fu;rther action in the matters, in<\/p>\n
 _ accordanceywith law.\n<\/p>\n

passed by the first respondent. They have traversed in<\/p>\n
detail, the averments made in the writ petition. <\/p>\n
sought for upholding of the aforesaid order  ”<\/p>\n
first respondent and the dismissal o.f’th\u00bbe.wri–t petition  <\/p>\n

\n The lands have been purchased from persons
\nT who were not entitled to sell the same,<\/p>\n

declaring the sale transactions to be null and void,<\/p>\n
resuming the alienated land and restoring. the prope.rty to<\/p>\n
the grantee\/s. Since the petitioners herein 2<\/p>\n
that, only one item of land bearing Survey! <\/p>\n
measuring 2 acres was the s’u’bVje’ct,_ <\/p>\n
proceedings under the PTCL Act, in:”resp_ect ofV_–whi,ch,’cla’se”~<\/p>\n
No.43\/97-98 was registe’r”e.d~, by dwssisizant V<\/p>\n
Commissioner and an orcler dated ‘V0f3,Vi0._.199t\u00a7Vwa’sV passed,
\nwhereby it was declared,”the’uisaie_.:_t’ra.nsaction involved
\ntherein to be n..u\u00abi’i:,.:a’nd voidzganid ultimately came
\nup to this  which petition was
\ndismissed .ror,’lnm:\u00a7rose\u00a70t.ioinr on 12.06.2008 and since<\/p>\n
the petitionersVvhiay\u00e9’iV.not:””t,al<en any steps for recalling of<\/p>\n
 the ,o.i:d'er.and havevvalso stated that, they are not intending<\/p>\n
 tovpursu\u00e9,thematter any further and that, they have no<\/p>\n
iobjVectio'nfl_o.r resumption of the land involved in the said<\/p>\n

0  vi.ol'ation of provisions of Karnataka Act 2 of 1979 is illegal<\/p>\n
