Srinivasa Murthy\n\nPublic Authority: Vijaya Bank\n                  Mr. Hariprakash Shetty, GM &amp; PIO\n                  Mr. T. Valliappan, Executive Director &amp; Appellate Authority\n\nFACTS<\/pre>\n<p id=\"p_1\">:\n<\/p>\n<p id=\"p_1\">       While working as branch manager, a charge sheet was issued to the<br \/>\nappellant pursuant to which an enquiry was conducted. On receipt of the enquiry<br \/>\nreport, the CVC opinion was obtained and major penalty of dismissal was imposed<br \/>\non the appellant. The said dismissal order of the disciplinary authority was<br \/>\nconfirmed by appellate authority. The writ petition filed by the appellant before the<br \/>\nHigh Court was dismissed and presently the second appeal of the appellant is<br \/>\npending before the Division Bench. By an application dated 12.2.2007, the<br \/>\nappellant sought for copies of the first and second stage advice of the CVC and<br \/>\nalso the recommendation of the disciplinary authority to CVC regarding the<br \/>\nproposed penalty on receipt of the enquiry report. By a communication dated<br \/>\n30.10.2007, the CPIO declined to furnish the information on the ground of the<br \/>\nmatter being sub judice and applying the provisions of <a href=\"\/doc\/1525538\/\" id=\"a_1\">Section 8(1)(h)<\/a> of the Act.<br \/>\nOn appeal, the AA upheld the decision of the CPIO. Hence the present appeal in<br \/>\nwhich the appellant has submitted that at no point of time either before the<br \/>\nimposition of penalty or thereafter, the advice of CVC was given to the appellant in<br \/>\nspite of repeated requests. He has further contended that since the enquiry has been<br \/>\ncompleted, the question of applying the provisions of <a href=\"\/doc\/1525538\/\" id=\"a_2\">Section 8(1)(h)<\/a> of the Act<br \/>\ndoes not arise. Since he is seeking documents relating to his own case, the same<br \/>\ncannot be denied. He has also referred to certain decisions of the Supreme Court<br \/>\nwherein the court has held that punishment cannot be imposed without disclosing<br \/>\nall materials including the CVC advice. Accordingly, he has sought for a direction<br \/>\nto the CPIO to furnish the information. In the comments, it is stated that since the<br \/>\nappeal of the appellant is pending before the Division Bench of the High Court,<br \/>\ndisclosure of the information sought for by the appellant may adversely affect the<br \/>\ninterests of the bank. In the rejoinder, the appellant has submitted that even as per<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                             1<\/span><br \/>\n the CVC guidelines, copies of its advice should be given to the concerned<br \/>\nemployee and as such the same cannot be denied.\n<\/p>\n<p id=\"p_2\">DECISION:\n<\/p>\n<p id=\"p_3\">      Normally, a matter being sub judice cannot be brought under <a href=\"\/doc\/1525538\/\" id=\"a_3\">Section 8(1)(h)<\/a><br \/>\nof the Act, However, this Commission has been taking a view that if the<br \/>\ninformation sought is directly connected with a matter in a Court and if the public<br \/>\nauthority contends that the disclosure would affect the public authority<br \/>\nprejudicially in the judicial proceeding, then the information seeker should<br \/>\napproach the Court for a direction to the public authority to disclose the<br \/>\ndocuments. In the present case, the public authority has taken a stand in the<br \/>\ncomments that disclosure might adversely affect its interests in the appeal pending<br \/>\nbefore the Division Bench of the High Court. Therefore, I uphold the decisions of<br \/>\nthe CPIO and the AA. The appellant has relied on certain decisions of the Supreme<br \/>\nCourt in this regard. They all relate to the proceedings during the disciplinary<br \/>\nproceedings and not in connection with the <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>.
