SHAH\n\t\t\n\t\n\n \n\nDate\n: 27\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr.Yogen Pandya, learned advocate waives service of notice of Rule on<br \/>\nbehalf of the respondent.\n<\/p>\n<p>2.\t\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent petition is taken up for final hearing today.\n<\/p>\n<p>3.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioner &#8211; Sarpanch of Khadadhar Gram<br \/>\nPanchayat, has prayed for an appropriate writ, order and\/or<br \/>\ndirection, quashing and setting aside the impugned judgement and<br \/>\naward dated 29\/01\/2010 passed by Labour Court, Amreli in Reference<br \/>\nCase No.66 of 2004, by which, Labour Court, Amreli has allowed the<br \/>\nsaid Reference by directing the petitioner to reinstate the<br \/>\nrespondent on his original post with full backwages for the<br \/>\nintervening period.\n<\/p>\n<p>4.\t\tAt<br \/>\nthe outset, it is required to be noted that this Court has issued<br \/>\nNotice only for the purpose of considering the backwages.\n<\/p>\n<p>5.\t\tMr.Yogen<br \/>\nPandya, learned advocate appearing on behalf of the respondent, under<br \/>\nthe instruction received from the respondent, has left it to the<br \/>\nCourt with respect to amount of backwages is concerned. He has<br \/>\nfurther submitted that though respondent-workman has been reinstated<br \/>\nin the month of January,2010 till date, he has not been paid any<br \/>\namount of wages except Rs.1200\/- each for the month of March,2010 and<br \/>\nApril,2010. He has further submitted that at least the respondent is<br \/>\nentitled to get the minimum wages from the date of reinstatement till<br \/>\ndate. So far as backwages which may be awarded by this Court is<br \/>\nconcerned, as Recovery Application is pending, the same shall be<br \/>\ndecided by the concerned Labour Court.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard Ms.Patel, learned advocate appearing on behalf of the<br \/>\npetitioner and Mr.Yogen Pandya, learned advocate appearing on behalf<br \/>\nof the respondent and considering the facts and circumstances of the<br \/>\ncase and impugned judgement and award passed by the Labour Court and<br \/>\nconsidering the financial position of the Panchayat, it appears to<br \/>\nthe Court that if the respondent is awarded 25% backwages from the<br \/>\ndate of termination till reinstatement, it will meet the ends of<br \/>\njustice.\n<\/p>\n<p>7.\t\tLearned<br \/>\nadvocates appearing on behalf of the respective parties do not invite<br \/>\nany further reasoned order while awarding  25% backwages and<br \/>\nmodifying the impugned judgement and award passed by the Labour Court<br \/>\nto the aforesaid extent.\n<\/p>\n<p>8.\t\tIn<br \/>\nview of the above broad consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties, the petition succeeds<br \/>\nin part. The impugned judgement and award dated 29\/01\/2010 passed by<br \/>\nLabour Court, Amreli in Reference Case No.66 of 2004 is hereby<br \/>\nmodified to the extent of awarding backwages and instead of full<br \/>\nbackwages, the petitioner is directed to pay 25% of the backwages to<br \/>\nthe respondent for the intervening period i.e. from the date of<br \/>\ntermination till date of reinstatement. As the respondent is already<br \/>\nreinstated in service in the month of January,2010, the petitioner is<br \/>\nbound to pay minimum wages to the respondent on the post in question<br \/>\nand the petitioner is directed to pay the same from the date of<br \/>\nreinstatement  till date  within  a  period  of \u00a0six weeks from<br \/>\ntoday without fail. So far as 25% backwages as per modified judgement<br \/>\nand award passed by the Labour Court is concerned, it is reported<br \/>\nthat recovery application is already pending with the Labour Court<br \/>\nand, therefore, amount of backwages due and payable to the respondent<br \/>\nshall be decided by the concerned Labour Court in accordance with law<br \/>\nand on merits.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of. Rule is made absolute to<br \/>\nthe aforesaid extent.
