    Plaintiff  in  O.S.608\/2001  on  the   file  of<\/p>\n
Addl.Munsiff  Court,  Kannur   is  the   appellant.<\/p>\n
Defendant is the respondent.  Appellant instituted<\/p>\n
the  suit  seeking   a  decree   for  damages   for<\/p>\n
defamation contending that appellant sent a reply<\/p>\n
to the lawyer notice issued at the instance of the<\/p>\n
appellant  with  copy  to    District   Court,  Bar<\/p>\n
Association and Officer in charge of the Police<\/p>\n
Station,  Kannur  raising  defamatory   allegations<\/p>\n
against the petitioner and it has affected his<\/p>\n
reputation among his friends, relatives and public<\/p>\n
and therefore he is entitled to a damages for<\/p>\n
Rs.10,000\/-.     Respondent  resisted   the   claim<\/p>\n
justifying the allegations on the ground that they<\/p>\n
are true.\n<\/p>\n
    2. Learned Munsiff on the evidence of appellant<\/p>\n
as PW1, respondent as DW1 and witness as DW2 and<\/p>\n
R.S.A.623\/07                 2<\/span><\/p>\n
Exts.A1 to A7 dismissed the suit holding that<\/p>\n
though it was unwarranted on the part of the<\/p>\n
appellant to state in the reply the allegations<\/p>\n
raised, the gist of the substance is correct and in<\/p>\n
such circumstance, it is justifiable by truth and<\/p>\n
therefore appellant is not entitled to the damages<\/p>\n
sought for.       Appellant challenged the decree and<\/p>\n
judgment       before   Sub   Court,   Tellicherry  in<\/p>\n
A.S.217\/2003.      Learned Sub Judge on reappreciation<\/p>\n
of    evidence    confirmed  the  findings  of  learned<\/p>\n
Munsiff and dismissed the suit.       It is challenged<\/p>\n
in the second appeal.\n<\/p>\n
      3. Learned counsel appearing for appellant was<\/p>\n
heard.\n<\/p>\n
      4.    The argument of learned counsel    is that<\/p>\n
courts      below  having  found  that  allegations  in<\/p>\n
Ext.A2      are  defamatory,     in   the  absence  of<\/p>\n
sufficient evidence to prove that allegations are<\/p>\n

true, were not justified in dismissing the suit and<\/p>\n
therefore the decree and judgment are to be set<\/p>\n
aside.\n<\/p>\n
      5.    Learned counsel argued that    allegations<\/p>\n
raised in Ext.A2 reply are per se defamatory and<\/p>\n
every man has a reputation and        evidence of PW1<\/p>\n
establish that his      reputation has been adversely<\/p>\n
affected by the defamatory statements in Ext.A1 and<\/p>\n
therefor     courts  below  should  have  granted  the<\/p>\n
decree.\n<\/p>\n
      6.    On hearing learned counsel, I do not find<\/p>\n
any substantial question of law involved in the<\/p>\n
case.      The question whether  allegations in Ext.A1<\/p>\n
are defamatory and whether they are justifiable by<\/p>\n
truth      or  not  depend  on  appreciaiton  of   the<\/p>\n
allegations in Ext.A2 and the evidence.          Trial<\/p>\n
court on appreciating the evidence found it against<\/p>\n
the      appellant.    The   first   appellate   court<\/p>\n

reappreciated     the  evidence   and  confirmed  the<\/p>\n
findings of the learned Munsiff.       I do not find<\/p>\n
that     appreciation of evidence perverse warranting<\/p>\n
reappreciation    of  evidence  in  exercise  of   the<\/p>\n
powers of this court under seciton 100 of Code of<\/p>\n
Civil Procedure.\n<\/p>\n
      Appeal is dismissed in limine.\n<\/p>\n
