Rajendra Babu &amp; Ruma Pal\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">RAJENDRA BABU, J. :\n<\/p>\n<p id=\"p_1\">\tThe brief facts giving rise to this appeal are as follows :\n<\/p>\n<p id=\"p_2\">Rosa Fonseca had married Antonio D&#8217;Costa on 15.4.1889 and a<br \/>\nmale child Jose Philipe was born to them.  The said Antonio D&#8217;Costa died<br \/>\nin 1892, and almost seven years after his death, his wife Rosa Fonseca<br \/>\ngave birth to a daughter in 1899.  On 21.2.1903, the baby girl was<br \/>\nbaptised and named Maria Da Graca Albertina Luiza Fonseca and the<br \/>\ndate and time of her birth were recorded in the Parochial Book of Records<br \/>\nof Baptism of the Taleigao Church.  The names of the maternal<br \/>\ngrandparents were mentioned and the godfather and godmother also<br \/>\nsigned the register respectively.  In 1933, the daughter Maria Fonseca<br \/>\nmarried Camilo Viegas and in 1935 the appellant was born out of this<br \/>\nwedlock.  Their marriage certificate dated 4.5.1933, stated that Maria<br \/>\nFonseca was an illegitimate child and only mentioned the name of the<br \/>\nmother.\t In 1952, Rosa Fonseca, the grandmother and in 1967 Maria<br \/>\nFonseca, the mother died.\n<\/p>\n<p id=\"p_3\">In 1985, the appellant filed inventory proceedings for partition of<br \/>\ninheritance of Rosa Fonseca and Antonio D&#8217;Costa in the Court of Civil<br \/>\nJudge [Senior Division].  The locus standi of the appellant was<br \/>\nchallenged by the Cabeca-de-Casal [Head of family] on the ground that<br \/>\nthe appellant is not an heir of the deceased person Rosa Fonseca.  The<br \/>\ninventory proceedings were restricted to the estate of Rosa Fonseca only<br \/>\nmaking her the sole inventariado in the matter.\n<\/p>\n<p id=\"p_4\">The Trial Court decided that the said proceedings were not<br \/>\nmaintainable and an appeal against the order of the Trial Court was<br \/>\npreferred in the High Court of Bombay at Panaji.  The High Court set<br \/>\naside the order of the Trial Court and remanded the matter for dealing<br \/>\nwith it afresh.\t On remand, the Trial Court passed an order observing<br \/>\nthat Maria Fonseca had not been legitimised as per law and she had no<br \/>\nright to the estate of Rosa Fonseca.  The same issue came up in appeal<br \/>\nbefore the High Court in appeal No.34\/1996 wherein the High Court<br \/>\nonce again remanded the matter to the Trial Court, directing that the<br \/>\narguments of the appellant must be taken into account for deciding the<br \/>\ncase.  After remand, on the second occasion, the Trial Court by an order<br \/>\ndated 4.9.1999 rejected the challenge to locus standi of the appellant<br \/>\nand observed that the appellant was entitled to participate in the<br \/>\ninheritance proceedings to the estate of Rosa Fonseca.\tChallenging this<br \/>\norder, the respondents filed an appeal, before the Additional District<br \/>\nJudge, North Goa, who held by an order made on 20.7.2000 that there<br \/>\nwas no proper legitimation of Maria Fonseca and hence, the appellant is<br \/>\nnot an heir.\n<\/p>\n<p id=\"p_5\">On 30.8.2000, the appellant filed a writ petition in the High Court<br \/>\nchallenging the order of the Additional District Judge dated 20.7.2000.<br \/>\nThe High Court by an order made on 9.11.2000 dismissed the writ<br \/>\npetition and upheld the order of the Additional District Judge. Hence this<br \/>\nappeal by special leave has been preferred against the order of the High<br \/>\nCourt dated 9.11.2000 dismissing the writ petition.\n<\/p>\n<p id=\"p_6\">The question that needs to be decided is whether Maria Fonseca<br \/>\nwas legitimized by her mother, Rosa Fonseca.  For this purpose, the<br \/>\nappellant produced the birth certificate of his mother Maria Fonseca<br \/>\nissued by the Directorate of Archives, Panaji, which was based on the<br \/>\nbaptism certificate issued by the local church. The Trial Court held that<br \/>\nMaria Fonseca was baptized on 21.2.1903 at home as she was ill and her<br \/>\nlife was at peril; that she was born on 15.4.1899 at 3.00 a.m. of an<br \/>\nunknown father and the mother is Rosa Fonseca; that this was enough<br \/>\nto hold that she was legally recognised; that the baptism certificate<br \/>\nrecorded the names of the mother, grandparents and godparents; but it<br \/>\nwas questioned on the ground that it did not contain mother&#8217;s signature<br \/>\nthrowing doubt as to whether she had consented to the ceremony of<br \/>\nlegitimizing her daughter; that the respondents also failed to bring any<br \/>\nevidence to counter the natural presumption of the presence of the<br \/>\nmother Rosa Fonseca at the time of baptism.  Hence the Trial Court<br \/>\nallowed the claim of the appellant.\n<\/p>\n<p id=\"p_7\">In appeal the learned District Judge held that in order to solemnize<br \/>\nbaptism, the names of God parents should be entered in the record and<br \/>\nthe presence of either of the God parents is absolutely necessary and<br \/>\nshould be signed by the Parochial Authority; that, the baptism certificate<br \/>\nrelied upon by the appellant does not indicate that both or either of the<br \/>\nGod parents were present in proof of which their signatures were taken;<br \/>\nthat, baptism certificate could not be relied upon; that, the birth<br \/>\ncertificate proceeds on the basis of baptism certificate, which is not valid;<br \/>\nthat, thus there is no legal recognition of legitimacy by any proper deed.<br \/>\nOn this basis, he allowed the appeal.\n<\/p>\n<p id=\"p_8\">In the writ petition, the High Court without assigning any separate<br \/>\nreasoning held that the District Judge took into consideration the entire<br \/>\nmaterial on record and on proper application of law rejected the case of<br \/>\nthe appellant and dismissed the writ petition.\n<\/p>\n<p id=\"p_9\">What we have to see in this matter is whether the test indicated by<br \/>\nthe learned District Judge has been complied with by the parties<br \/>\nconcerned. A true translation of the birth certificate is made available<br \/>\nand reads as follows:\n<\/p>\n<p id=\"p_10\">&#8220;In Margin: No.78 Maria Graca Albertina daughter of Roza Maria<br \/>\nAnna Fonseca, from Gally.\n<\/p>\n<p id=\"p_11\">In the Text: On the twenty-first day of the month of February in<br \/>\nthe year one thousand nine hundred and three in this Parish<br \/>\nChurch of Taleigao, Taluka islands of Goa (Tiswadi), of the<br \/>\nArchdiocese of Goa, with my permission, Fr.Floriano Jose<br \/>\nJoaquim Joao Fernandes, resident of this locality, put the holy oils<br \/>\non a person of female sex as she had been duly baptised in home<br \/>\nbecause she was in peril of her life by Francisco Xavier Raymando<br \/>\nFernandes, former Curate of this Parish, with the name Maria<br \/>\nGraca Albertina Luisa who was born in the ward Gally of this<br \/>\nParish at three hours of the morning of the fifteenth day of April in<br \/>\nthe last year (sic) one thousand eight hundred ninety-nine free<br \/>\nlegitimate daughter, second in the order of children and the only<br \/>\none with this name, I mean daughter of unknown father and of<br \/>\nRoza Maria Anna Fonseca, native of Parra and resident of<br \/>\nTaleigao, widow, landed proprietor whose income does not amount<br \/>\nto three hundred &#8220;reis&#8221; per day,  paternal (sic) grand-daughter of<br \/>\nPaulo Antonio de Fonseca and of Maria Angelica Fernandes, both<br \/>\nnatives of Parra.  Her godfather was Antonio Augusto Milares da<br \/>\nPiedade Lobo, bachelor, Land Surveyor, resident of Santo Estevao<br \/>\nand godmother Monica Maria Eulalia Francisco Gomes,<br \/>\nunmarried, native of Ucassaim represented in this act by Maria<br \/>\nFrancisca Gonsalves, unmarried, from Taleigao, all of whom I<br \/>\nacknowledge them as proper persons.  And to be known I made<br \/>\nthis record in duplicate which, after it was read and checked<br \/>\nbefore the godparents, I sign it along with them. Date as<br \/>\nmentioned above, Correction follows sd\/- Ant.Augt. Milagres da<br \/>\nP.Lobo. Sd\/- Maria Francisca Xavier Gonsalves. The parson sd\/-<br \/>\nFr. Jose Lourenco de Silva.&#8221;\n<\/p>\n<p id=\"p_12\">\tThe underlined portion stated above clearly indicates that the<br \/>\nbaptismal record was read and checked before the godparents, and the<br \/>\nsame has been signed by the Parson along with them. The learned<br \/>\nDistrict Judge felt that the certificate of registration of birth merely<br \/>\nproceeds on the basis of the baptism certificate.  If the birth certificate is<br \/>\na true reflection of the baptism record and it contains the fact that it was<br \/>\nread and checked before the godparents, the same need not be discarded<br \/>\nand it must be held that the same had been made in the presence of both<br \/>\ngod parents.  In that view of the matter, the Trial Court was justified in<br \/>\nthe conclusion it reached and not the learned District Judge who<br \/>\nproceeded on misreading of the record. Hence the High Court ought to<br \/>\nhave reversed the finding recorded by the learned District Judge who<br \/>\nignored this crucial aspect in the course of his order.\n<\/p>\n<p id=\"p_13\">In the result, we set aside the order made by the High Court and<br \/>\nthe order of the learned District Judge while restoring the order made by<br \/>\nthe Trial Court.
