Justice R.BASANT\n\n Dated :23\/03\/2007\n\n O R D E R\n                                  R.BASANT, J\n\n                        ------------------------------------\n\n                          Crl.M.C.No.874 of 2007\n\n                        -------------------------------------\n\n                  Dated this the 23rd day of March, 2007\n\n\n                                      ORDER\n<\/pre>\n<p>      The petitioner has been found guilty, convicted and sentenced in<\/p>\n<p>a prosecution under Section 138 of the N.I Act.  This Court in revision<\/p>\n<p>had modified the sentence.   The petitioner now faces the sentence of<\/p>\n<p>imprisonment till rising of court.  There is a further direction &#8220;to pay&#8221;<\/p>\n<p>an amount of Rs.90,000\/- by way of compensation to the complainant.<\/p>\n<p>The default sentence is also prescribed.   There is a further direction<\/p>\n<p>that   the   petitioner   shall   surrender   before   the   learned   Magistrate<\/p>\n<p>positively within two months from 20.12.2006 and shall &#8220;deposit&#8221; the<\/p>\n<p>entire   amount   of   compensation   before   court   positively   on   that   date.<\/p>\n<p>Default sentence is also prescribed.   For the sake of clarity, I extract<\/p>\n<p>the relevant operative portion in para.3 of the order passed in revision<\/p>\n<p>below:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;3.   In   the   result,   I   confirm   the   conviction   of   the<\/p>\n<p>      petitioner   for   offence   under   Section   138   of   N.I   Act   but<\/p>\n<p>      modify   and   reduce   the   sentence   of   imprisonment   to<\/p>\n<p>      imprisonment for one day till rising of court and direct the<\/p>\n<p>      petitioner  to   pay   an   amount   of   Rs.90,000\/-   by   way   of<\/p>\n<p>      compensation   to   the   2nd  respondent\/complainant   under<\/p>\n<p>      Section   357(3)   Cr.P.C   and   in   default   to   undergo   simple<\/p>\n<p>      imprisonment   for   three   months.     The   petitioner   shall<\/p>\n<p>      surrender   before   the   Judicial   First   Class   Magistrate,<\/p>\n<p>      Malappuram   positively   within   two   months   from   today   to<\/p>\n<p>      serve the sentence and shall  at the same time deposit the<\/p>\n<p>      entire amount of compensation before the court positively<\/p>\n<p>      on   that   day.     In   case   of   failure   to   make   deposit   of<\/p>\n<p>      compensation   on   that   day,   the   learned   Magistrate   shall<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.874 of 2007                      2<\/span><\/p>\n<p>       enforce   the   sentence   in   default   of   payment   of<\/p>\n<p>       compensation forthwith.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              This Criminal revision is disposed of as above.&#8221;<\/p><\/blockquote>\n<p>       2.     The   petitioner\/accused   and   the   respondent\/complainant<\/p>\n<p>have now come before this Court with this petition under Section 482<\/p>\n<p>Cr.P.C.     Both   of   them   submit   that   the   amount   of   compensation   has<\/p>\n<p>already   been   paid   and   received   by   the   complainant.     The   petitioner<\/p>\n<p>had   not   appeared   before   the   learned   Magistrate   within   a   period   of<\/p>\n<p>two months as directed.  The petitioner is willing to appear before the<\/p>\n<p>learned   Magistrate   to   suffer   the   substantive   sentence   of<\/p>\n<p>imprisonment, but he apprehends that in view of the later statement<\/p>\n<p>that the amount must be &#8220;deposited&#8221; positively within two months, the<\/p>\n<p>default  sentence   may   be   enforced   notwithstanding   the  admitted  fact<\/p>\n<p>that the payment has been made to the complainant.<\/p>\n<p>       3.     I   do   note   that   there   is   some   confusion.     In   the   earlier<\/p>\n<p>portion of para.3 extracted above, the direction is to pay the amount<\/p>\n<p>and   later   it   has   been   directed   that   it   shall   be   deposited.     The<\/p>\n<p>petitioner contends that it has been paid thinking that that would be<\/p>\n<p>sufficient compliance.\n<\/p>\n<\/p>\n<p>       4.     I   am   satisfied,   in   these   circumstances,   that   it   can   be<\/p>\n<p>clarified   that   if   the   learned   Magistrate   is   satisfied   that     payment   of<\/p>\n<p>Rs.90,000\/-   has   been   effected   by   the   petitioner\/accused   to   the<\/p>\n<p>respondent\/complainant, the default sentence should not be enforced.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.874 of 2007                     3<\/span><\/p>\n<p>Insistence need not be made on literal compliance of the direction to<\/p>\n<p>deposit the amount in para.3 of the  order in revision extracted above.<\/p>\n<p>         5.    This   Crl.M.C   is,   in   these   circumstances,   allowed   in   part.<\/p>\n<p>The   above   clarification   is   made.     The   petitioner   along   with   the<\/p>\n<p>complainant   can   now   appear   before   the   learned   Magistrate<\/p>\n<p>immediately and the petitioner can suffer the substantive sentence of<\/p>\n<p>imprisonment.\n<\/p>\n<\/p>\n<p>         6.
