BASANT, J.\n\n          ````````````````````````````````````````````````````\n                  B.A. No. 1251 OF 2008 F\n          ````````````````````````````````````````````````````\n         Dated this the 29th day of February, 2008\n\n                            O R D E R\n<\/pre>\n<p id=\"p_1\">           Application for anticipatory bail. Petitioners are the<\/p>\n<p>husband of the de facto complainant and his relatives. The<\/p>\n<p>marriage took place on 12.9.03. The spouses are blessed<\/p>\n<p>with one child. There is some strain in the matrimony. The<\/p>\n<p>crime has been registered alleging offences punishable, inter<\/p>\n<p>alia, under <a href=\"\/doc\/538436\/\" id=\"a_1\">section 498A<\/a> IPC. It is registered on the basis of a<\/p>\n<p>private complaint filed before the Magistrate and referred to<\/p>\n<p>the police by the learned Magistrate under <a href=\"\/doc\/99487\/\" id=\"a_1\">section 156(3)<\/a><\/p>\n<p>Cr.P.C.     Investigation is in progress. The petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<p id=\"p_1\">      2.   The learned counsel for the petitioners prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer<\/p>\n<p>and I am satisfied, in the facts and circumstances of this case,<\/p>\n<p>that the petitioners can be granted anticipatory bail. In the<\/p>\n<p>BA.1251\/08<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               : 2 :<\/span><\/p>\n<p>absence of the opposition by the learned Public Prosecutor, I<\/p>\n<p>am not adverting to the facts in any greater detail in this order.<\/p>\n<p id=\"p_2\">      3.   In the result, this petition is allowed.    Following<\/p>\n<p>directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section 438<\/a> Cr.P.C in favour of<\/p>\n<p>the petitioners.\n<\/p>\n<p id=\"p_3\">      i)   Petitioners shall surrender before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 7.3.2008. They<\/p>\n<p>shall be released on regular bail on condition that they<\/p>\n<p>execute bonds for Rs.25,000\/-(Rupees twenty five thousand<\/p>\n<p>only) each with two solvent sureties each for the like sum to<\/p>\n<p>the satisfaction of the learned Magistrate.<\/p>\n<p id=\"p_4\">      ii)  The petitioners shall make themselves available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 10.3.08 and 11.3.08 and thereafter on all<\/p>\n<p>Mondays and Fridays between 10 a.m and 12 noon for a<\/p>\n<p>period of two months. Subsequently, the petitioners shall so<\/p>\n<p>appear as and when directed by the investigating officer in<\/p>\n<p>writing to do so.\n<\/p>\n<p id=\"p_5\">BA.1251\/08<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                : 3 :<\/span><\/p>\n<p id=\"p_6\">      (iii) If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above<\/p>\n<p>shall thereafter stand revoked and the police shall be at liberty<\/p>\n<p>to arrest the petitioners and deal with them in accordance with<\/p>\n<p>law, as if these directions were not issued at all.<\/p>\n<p id=\"p_7\">      (iv) If they were arrested prior to 7.3.08, they shall be<\/p>\n<p>released from custody on their executing bonds for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) each without<\/p>\n<p>any sureties, undertaking to appear before the learned<\/p>\n<p>Magistrate on 7.3.08.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">                                           (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Santhoshkumar R. vs The State Of Kerala on 29 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 1251 of 2008() 1.
