SHEEMA ALI KHAN)<\/p>\n<p>3   21-09-2011                Heard Counsel for the petitioner and the State.<\/p>\n<p id=\"p_1\">                              The petitioner is aggrieved by the order dated<\/p>\n<p>                  20.12.2007 passed by the Sub Divisional Officer, Araria by<\/p>\n<p>                  which the license of the petitioner has been cancelled.<\/p>\n<p id=\"p_2\">                              Learned Counsel for the petitioner submits that the<\/p>\n<p>                  license has been cancelled on two grounds; firstly, it is said that<\/p>\n<p>                  the petitioner&#8217;s name was not cleared by the District Selection<\/p>\n<p>                  Committee and secondly, for the reason that the petitioner has<\/p>\n<p>                  not followed the provisions of the Control Order, 2001, which<\/p>\n<p>                  was come into effect in the year 2007.\n<\/p>\n<p id=\"p_3\">                              Against the order aforesaid, the petitioner has filed an<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> 2   Patna High Court CWJC No.12491 of 2008 (3) dt.21-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                         2\/3<\/span><\/p>\n<p>              appeal before the District Magistrate, Araria, numbered as 174<\/p>\n<p>              of 2007-08. The submission of the petitioner is that there was no<\/p>\n<p>              District Selection Committee at the time when the petitioner was<\/p>\n<p>              granted the license. The District Selection Committee came into<\/p>\n<p>              existence only after 2007, and as such, this cannot be a ground<\/p>\n<p>              for cancelling the license. Secondly, it is submitted that the<\/p>\n<p>              petitioner has followed the provisions of the Control Order,<\/p>\n<p>              2001 and thus, the order of cancellation is bad on this ground as<\/p>\n<p>              well, as no specific allegations are made out against the<\/p>\n<p>              petitioner.\n<\/p>\n<p id=\"p_4\">                            The District Magistrate, Araria by order dated<\/p>\n<p>              12.02.2008 remanded the matter to the Sub Divisional Officer,<\/p>\n<p>              Araria to reconsider the matter afresh.
