\tThese
\ntwo appeals arise out of the judgment and order rendered by Sessions
\nCourt, Patan, in Sessions Case No.47 of 2003, convicting
\nappellant-Mukeshbhai Khemabhai Nai-original accused No.1 for the
\noffences punishable under Section 302<\/a>, 120(B)<\/a>, 452<\/a>, 506(2)<\/a> of IPC and
\nSection 135 of the Bombay Police Act, and original accused
\nNo.2-Babubhai Lallubhai Patel-, appellant in Criminal Appeal No.898
\nof 2006, for offence punishable under Section 302<\/a> read with Section
\n34<\/a> and Section 120(B)<\/a> of IPC. Original accused No.1-Mukeshbhai
\nKhemabhai Nai has preferred Criminal Appeal No.1023 of 2005, whereas
\naccused No.2- Babubai Lallubhai Patel has preferred Criminal Appeal
\nNo.898 of 2006. For the sake of convenience, they are referred to as
\naccused Nos.1 and 2, respectively in this judgment.\n<\/p>\n
2.\tAccused
\nNo.1 was punished as under:-\n<\/p>\n
(1)\tFor
\noffence punishable under Section 302<\/a> of IPC, life imprisonment and
\nfine of Rs.5,000\/-, in default, SI for 6 months;\n<\/p>\n
(2)\tFor
\noffence punishable under Section 120(B)<\/a> of IPC, no separate sentence
\nwas passed;\n<\/p>\n
(3)\tFor
\noffence punishable under Section 452<\/a> of IPC, RI for 2 years and fine
\nof Rs.1,000\/-, in default, SI for 2 months;\n<\/p>\n
(4)\tFor
\noffence punishable under Section 506(2)<\/a> of IPC, RI for 2 years and
\nfine of Rs.500\/-, in default, SI for 1 month;\n<\/p>\n
(5)\tFor
\noffence punishable under Section 135 of Bombay Police Act, RI for one
\nmonth and fine of Rs.200\/-, in default, SI for 1 month;\n<\/p>\n
\tAll
\nsentences were ordered to run concurrently.\n<\/p>\n
2.1\tAccused
\nNo.2 was punished as under:-\n<\/p>\n
(1)\tFor
\noffence punishable under Section 302<\/a> read with Section 34<\/a> of IPC,
\nlife imprisonment and fine of Rs.5000\/-, in default, SI for 6 months;\n<\/p>\n
(2)\tFor
\noffence punishable under Section 120(B)<\/a> of IPC, no separate sentence
\nwas awarded;\n<\/p>\n
(3)<\/span><\/p>\n
For offence punishable under Sections 452<\/a> read with Section 34<\/a> and
\nSection 506<\/a> (2) read with Section 34<\/a> of IPC, the accused was
\nacquitted.\n<\/p>\n
3.\tThe
\nfacts of the case, in brief, are that accused No.1 allegedly
\ncommitted murder of Minaben Patel on 20.3.2003 around 7-30 AM at
\nBalarwada in Patan by inflicting knife blows on vital part of her
\nbody. The case of the prosecution further is that for committing
\nmurder, A-1 had committed trespass, and intimidated the first
\ninformant and witnesses. It is also the case of the prosecution that
\nthis act was committed by A-1 at the behest  of and in conspiracy
\nwith A-2.\n<\/p>\n
4.\tAs
\nper the prosecution case, after committing the murder, when A-1 was
\ntrying to escape from the place of incident, he was apprehended by
\nKeyurbhai Ambalal Jani, who, in turn, lodged the FIR. When A-1 was
\napprehended, he was found to be in possession of blood-stained knife
\nand his clothes were also blood-stained. On the basis of the FIR,
\noffence was registered and investigated. The police filed
\ncharge-sheet against both the accused for offence punishable under
\nSections  302<\/a> read with Section 34<\/a>, Section 452<\/a> read with Section 34<\/a>,
\nSection 506(2)<\/a> read with Section 34<\/a>, Section 120(B)<\/a> read with Section
\n34<\/a> of IPC and Section 135 of the Bombay Police Act. Investigation was
\nmade and, ultimately, chargesheet was filed in the Court of Chief
\nJudicial Magistrate, Patan, who, in turn, committed the case to the
\nCourt of Sessions and Sessions Case No.47 of 2003 came to be
\nregistered.\n<\/p>\n
4.1\tCharge
\nwas framed against the accused persons at Exh.9. The accused persons
\npleaded not guilty to the charge and came to be tried.\n<\/p>\n
5.\tThe
\ntrial Court, after considering the evidence led by the prosecution,
\ncame to the conclusion that the prosecution was successful in
\nestablishing the charges levelled against the accused persons and
\nconvicted them of the offences, as stated in earlier part of this
\njudgment and passed the sentence. Hence, these appeals.\n<\/p>\n
6.\tLearned
\nadvocate Mr Pratik Barot appears for A-1 Mukeshbhai Khemabhai Nai –
\nappellant in Criminal Appeal No.1023 of 2005, and learned advocate Mr
\nAnil S Dave is represented by Mr Vicky Mehta for original accused
\nNo.1- appellant in Criminal Appeal No.898 of 2006. The State is
\nrepresented by learned APP Mr Pandya.\n<\/p>\n
7.\tLearned
\nadvocate Mr Barot submitted that there is no direct evidence of any
\neye-witness, who  could claim to have seen the actual occurrence. He
\nsubmitted that there is no evidence of any conspiracy either. He
\nsubmitted that A-1 is not connected with the deceased in any manner
\nand had no motive for committing the offence. All these factors have
\nbeen overlooked by the trial Court. The appeal, therefore, may be
\nallowed.\n<\/p>\n
8.\tLearned
\nadvocate Mr Vicky Mehta submitted that the charge against accused
\nNo.2 is that of having conspired and having deployed A-1 to commit
\nmurder of deceased Minaben Patel. In absence of any such evidence, he
\ncould not have been convicted by the trial Court. He submitted that
\nthe appeal may be allowed.\n<\/p>\n
9.\tOn
\nthe other hand, learned APP Mr Pandya submitted that so far as A-1 is
\nconcerned, he was found to be leaving the premises from which the
\ndeceased was found in a dead condition. The deceased had sustained
\nnumber of knife injuries, which, ultimately, resulted into her death.
\nIt was also submitted that A-1 was having a knife in his hand, which
\nwas blood-stained. That blood group was of the deceased. It was
\nfurther submitted that A-1 was apprehended on the spot with
\nblood-stained knife and blood-stained clothes. He had no reason to be
\nthere and, as such, the case against him is proved beyond reasonable
\ndoubt, as has been held by the trial Court.\n<\/p>\n
9.1\tSo
\nfar as A-2 is concerned, he is the person interested in ensuring
\ndemise of deceased Minaben. He had suspected fidelity of Minaben and,
\ntherefore, engaged A-1 do to away with Minaben. Otherwise, A-1 had no
\ninterest in causing death of Minaben. The trial Court has, therefore,
\ncorrectly interpreted the evidence and recorded conviction. The
\nappeals may, therefore, be dismissed.\n<\/p>\n
10.\tHaving
\nregard to the rival submissions, we have examined the record and
\nproceedings.\n<\/p>\n
11.\tA
\nperusal  at the evidence would indicate that Keyur Ambalal Jani, the
\nfirst informant, Exh.29, Anishkumar Satyendrabhai, Exh.33 and
\nRamjibhai Govindbhai Exh.40 would go to show that Keyur Ambalal Jani,
\nwhile passing by the house of the deceased, noticed A-1 coming out of
\nthe house, trying to flee. He noticed that A-1 had a knife in his
\nhands, which was bleeding. The blood-group on that knife is reported
\nto be ‘O’ +ve, which is the blood-group of the deceased. He
\napprehended A-1 and then reported the entire incident to the Police.
\nA-1 had no other reason to go to the place where the incident
\noccurred and the deceased resided. Soon after he was apprehended,
\nwhen the place of incident was visited upon by witnesses, the
\ndeceased was found to be lying dead in the room. The only legitimate
\ninference that can be drawn is that A-1 had caused death of the
\ndeceased, which is the only hypothesis possible which would lead to
\nthe guilt of A-1 of the said offence. Added to the fact is that his
\nclothes were stained with blood of ‘O’ +ve group, which was of the
\ndeceased. A-1 had no injury on his person. The injuries found on the
\nperson of A-1 were in the nature of abrasions only.\n<\/p>\n
12.\tThe
\ntrial Court was, therefore, justified in coming to the conclusion
\nthat it was A-1 who was responsible for death of Minaben Patel.\n<\/p>\n
13.\tSo
\nfar as A-2 – Babubhai Lallubhai Patel is concerned, he was
\napprehended subsequently on the basis of interrogation of A-1. There
\nis no material to show that there was a nexus between both the
\nappellants. It is, therefore, difficult to infer that A-1 contacted
\nwith A-2 to cause death of victim Minaben Patel. He, therefore, could
\nnot have been convicted by the trial Court for the offence of murder
\nof Minaben with the help of Section 120(B)<\/a> of IPC or with the help of
\nSection 34<\/a> of IPC. In our opinion, therefore, the trial Court erred
\nin convicting A-2. Therefore, Criminal Appeal No.898 of 2006
\npreferred by original accused No.2 deserves to be allowed and the
\nsame is allowed.\n<\/p>\n
14.\tSo
\nfar as Criminal Appeal No.1023 of 2005 preferred by Mukeshbhai
\nKhemabhai Nai is concerned, we do not find any merits in the appeal.
\nHis conviction recorded by the trial Court is hereby confirmed.\n<\/p>\n
15.\tIn
\nthe result, Criminal Appeal No.1023 of 2005 is dismissed.\n<\/p>\n
16.\tSo
\nfar as Criminal Appeal No.898 of 2006 is concerned, the same is
\nallowed.  The conviction of accused No.2-  Babubhai Lallubhai Patel,
\nas recorded by Additional Sessions Judge, Fast-track Court, Patan, by
\njudgment dated 15.3.2005 in Sessions Case No.47 of 2003  for offence
\npunishable under Section 302<\/a> read with Section 34<\/a> of IPC and Section
\n120-B<\/a> of IPC is hereby set aside. He is acquitted of charges levelled
\nagainst him. His Bail bond shall stand cancelled. Fine paid, if any,
\nbe refunded to him.\n<\/p>\n
