Nigam Ltd., Jodhpur &amp; Ors.\n                            v.\n                        Bhim Singh\n\n\n        Date of Order        ::         1st November, 2010\n\n\n              HON'BLE MR.JUSTICE GOVIND MATHUR\n\n\nMr. Nitin Trivedi, for the appellants.\n                         ....\n\n\n\n             This second appeal is barred b y limitation\n\nfrom    61   days.   An   application    is   preferred   seeking\n\ncondonation of delay aforesaid. The reasons given in\n\nthe    application   for   condonation of      delay   are   quite\n\nvague and unconvincing, however, ignoring the same, I\n\nhave examined merits of the appeal.\n\n\n\n             Briefly stated, facts of the case are that\n\nthe plaintiff respondent preferred a suit for recovery\n\nof compensation as a consequent to loss caused to him\n\ndue to death of a buffalo on receiving electricity\n\ncurrent from a pole with transformer installed by the\n\ndefendant appellant Jodhpur Vidyut Vitran Nigam Ltd.\n\nAs per the plaintiff he purchased the buffalo from\n\nKrishna Kumar son of Kishanlal @ Rs.35,000\/- and that\n\ndied on 15.7.2006 on getting current from the pole\n\ninstalled by the defendant Jodhpur Vidyut Vitran Nigam\n\nLtd. The plaintiff claimed a sum of Rs.40,000\/- as\n\ncompensation.\n                                            2\n\n\n\n              Learned         trial    court           after     examining     the\n\nevidence available on record gave a definite finding\n\nof    fact    that       on    15.7.2006          the         buffalo     received\n\nelectricity current from the electricity pole due to\n\nnegligence         and    carelessness            on     the     part     of   the\n\nCorporation. The trial court not only relied upon the\n\nplaintiff's witness but also the statements of defence\n\nwitnesses DW-2           Pawan    Kumar and            DW-3     Dharamveer who\n\nstated that the information with regard to incident\n\npertaining to death of buffalo because of electricity\n\ncurrent      was    received      by       them       through     a     telephonic\n\nmessage. The trial court also considered the defence\n\nof the defendant that one Hushiyar Singh Punia was\n\ninvolved in theft of electricity and the buffalo died\n\nbecause of illegal wiring made by aforesaid Hushiyar\n\nSingh. While examining the defence aforesaid learned\n\ntrial court held that the Corporation is responsible\n\nfor    electricity             supply           and      to      maintain      the\n\ntransformers, pole, electricity line etc., including\n\nkeeping      regular      vigil       on       theft    of     electricity.     On\n\nbasis of the evidence available on record the trial\n\ncourt awarded a compensation in a tune of Rs.35,000\/-\n\nto the plaintiff with interest @ 6% per annum. Learned\n\nfirst appellate court affirmed the finding given by\n\nthe trial court and dismissed the appeal.\n\n\n\n              Before this Court while pressing this second\n\nappeal, the contention of counsel for the appellants\n                                           3\n\nis that the finding given is not supported by any\n\nevidence and also that the court should have examined\n\nproductivity       of    the    buffalo             while        determining          the\n\ncompensation.\n\n\n\n              I   do    not    find      any        merit       in    the    argument\n\nadvanced.      Adequate       evidence             is    available         on     record\n\nthat the buffalo was purchased by the plaintiff at the\n\ncost    of    Rs.35,000\/-.          True it             is,    whatever evidence\n\navailable is oral but merely on that count it cannot\n\nbe said that same is not reliable. It is a matter of\n\ncommon       knowledge       that    in       rural           areas    purchase        of\n\ncattles is normally not made by executing instruments,\n\nbut by deed of payment without making any record under\n\nany instrument. In the instant matter the independent\n\npersons have stated that the buffalo was purchased by\n\nthe     plaintiff       by     making          payment           in    a     tune     of\n\nRs.35,000\/- and there is no reason to disbelieve them.\n\n\n\n              So far as the issue relating to productivity\n\nof     the    buffalo    is     concerned,                that       too    has      been\n\nconsidered by the trial court. The trial court relied\n\nupon the statement of plaintiff and other independent\n\npersons regarding discharge of about 18 liters milk by\n\nthe    buffalo    everyday.          The      discharge          is    not      at    all\n\nexaggerated.       Be    that       as        it    may,        the    courts        have\n\nawarded      compensation       only          against          the    cost      of   the\n\nproperty.\n                               4\n\n          The    concurrent   findings   of   facts   in   the\n\nterms above given by the courts below do not suffer\n\nfrom any error that may warrant disturbance in this\n\nsecond appeal.\n\n\n\n          The appeal does not involve any substantial\n\nquestion of law.
