On the basis of registration of this case, the<br \/>\ndetaining authority held that the present detenue was carrying on<br \/>\nactivities of selling foreign made liquor which is harmful to the<br \/>\nhealth of the public. It is held by the detaining authority that as<br \/>\nthe detenue is indulged in illegal activities, it is required to<br \/>\nrestrain him from carrying out further illegal activities, i.e.<br \/>\nselling of liquor. The detaining authority has placed reliance on the<br \/>\nabove registered offences and statements of unnamed witnesses.  In<br \/>\nthe opinion of this Court, the activities of the detenue can, by no<br \/>\nstretch of imagination, be said to be disturbing the \u00fdSpublic<br \/>\norder.\u00fd\u00fd It is seen from the grounds that a general statement that<br \/>\nhas been made by the detaining authority that consuming liquor is<br \/>\ninjurious to health.  In fact, a perusal of the order passed by the<br \/>\ndetaining authority shows that the grounds which  are mentioned in<br \/>\nthe order are in reference to the situation of \u00fdSlaw and order\u00fd\u00fd<br \/>\nand not \u00fdSpublic order\u00fd\u00fd.  Therefore, on this ground, the<br \/>\nsubjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p id=\"p_4\">4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of <a href=\"\/doc\/687998\/\" id=\"a_2\">Ashokbhai Jivraj @ Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_3\">Ram<br \/>\nManohar Lohia v. State of Bihar<\/a> (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n\u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p id=\"p_5\">5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the \u00fdSpublic  order\u00fd\u00fd<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to \u00fdSpublic order\u00fd\u00fd. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p id=\"p_6\">6.\tI<br \/>\nam fortified by in my view by the decision taken by this Court in the<br \/>\ncase of <a href=\"\/doc\/662396\/\" id=\"a_4\">Sandip Omprakash Gupta v. State of Gujarat<\/a> (2004)(1) GLR\n<\/p>\n<p id=\"p_7\">865) that solitary incident of  violation of prohibition law,<br \/>\nnormally would not be a problem to the maintenance of public order<br \/>\nand for such solitary offence, no person can be detained under the<br \/>\nAct.\n<\/p>\n<p id=\"p_8\">7.\tIn<br \/>\nthe result, this Special Civil<br \/>\nApplication is allowed. The impugned order of detention passed by the<br \/>\ndetaining authority is hereby quashed and set aside. The detenue is<br \/>\nordered to be set at liberty forthwith, if not required in any other<br \/>\ncase. Rule is made absolute accordingly.
