      This is an application for anticipatory bail under Section 438<\/a> of<\/p>\n
the Code of Criminal Procedure. The petitioner is the first accused<\/p>\n
in Crime No.368 of 2009 of Karunagappally Police Station.<\/p>\n
      2. The offences alleged against the petitioner and others are<\/p>\n
under Sections 143<\/a>, 147<\/a>, 148<\/a>, 323<\/a>, 324<\/a>, 308<\/a>, 427<\/a> and 447<\/a> read with<\/p>\n
Section 149<\/a> of the Indian Penal Code.\n<\/p>\n
\n
      3. The petitioner moved B.A.No.2376 of 2009 for anticipatory<\/p>\n
bail, which was disposed of by the order dated 11.6.2009. The order<\/p>\n
reads as follows:\n<\/p>\n
\n
             “The first accused in Crime No.368 of 2009 of<\/p>\n
      Karunagappally Police Station has filed this application<\/p>\n
      for anticipatory bail.       The learned counsel for the<\/p>\n
      petitioner submitted that the investigation is going on<\/p>\n
      and that there is every likelihood of Section 308<\/a> of IPC<\/p>\n
      being deleted from the offence alleged. It is submitted<\/p>\n
      that this Bail Application may be closed with liberty to<\/p>\n
      move a fresh Bail Application as and when it becomes<\/p>\n
      necessary.\n<\/p><\/blockquote>\n

              The prayer is reasonable. The Bail Application is<\/p>\n
       closed with liberty to move a fresh Bail Application, if it<\/p>\n
       becomes necessary.”\n<\/p>\n
\n
       4. It is alleged that Section 308<\/a> was not subsequently deleted.<\/p>\n
Apprehending arrest, accused Nos.10 and 11 filed B.A.No.2471 of<\/p>\n
2009 for anticipatory bail. That Bail Application was allowed as per<\/p>\n
the order dated 15.6.2009.\n<\/p>\n
\n
       5.   The prosecution case is that on 18.4.2009, when a<\/p>\n
religious discourse at the office of ISM (Ithihadul Sublanil<\/p>\n
Mujahiddin) was going on, the accused persons who belonged to<\/p>\n
Sunni Group pelted stones on the gathering and thus committed the<\/p>\n
offence.\n<\/p>\n
\n
       6. I have perused the case diary. The wound certificate would<\/p>\n
disclose only minor injuries.\n<\/p>\n
\n
       7. Taking into account the facts and circumstances of the<\/p>\n
case,    the nature of the offence, the injury sustained and other<\/p>\n
circumstances, I am of the view that anticipatory bail can be granted<\/p>\n

                                         :: 3 ::\n<\/p>\n
to the petitioner. There will be a direction that in the event of the<\/p>\n
arrest of the petitioner, the officer in charge of the police station shall<\/p>\n
release him on bail for a period of one month on his executing bond<\/p>\n
for Rs.25,000\/- with two solvent sureties for the like amount to the<\/p>\n
satisfaction of the officer concerned, subject to the following<\/p>\n
conditions:\n<\/p>\n
\n
      a)     The petitioner shall report before the investigating
\n             officer between 9 A.M.         and 11 A.M. on all Mondays,
\n             till the final report is filed or until further orders;<\/p>\n<\/blockquote>\n
      b)     The petitioner shall appear before the investigating
\n             officer for interrogation as and when required;<\/p>\n<\/blockquote>\n
      c)     The petitioner shall not try to influence the prosecution
\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n
      d)     The petitioner shall not commit any offence or indulge in
\n             any prejudicial activity while on bail;<\/p>\n<\/blockquote>\n
      e)     On the expiry of the period mentioned above or even
\n             before that period, the petitioner shall surrender before
\n             the Magistrate concerned and seek regular bail;<\/p>\n<\/blockquote>\n
      f)     In case of breach of any of the conditions mentioned
\n             above, the bail shall be liable to be cancelled.<\/p>\n
      The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n
