HEMA, J.\n\n                ---------------------------------------------------\n                        B.A. No. 2981 of 2010\n                ---------------------------------------------------\n                 Dated this 27th day of May, 2010.\n\n\n                                    ORDER\n<\/pre>\n<p id=\"p_1\">      Petition for bail.\n<\/p>\n<p id=\"p_1\">      2. The alleged offence is under <a href=\"\/doc\/895566\/\" id=\"a_1\">Section 4<\/a> of the Explosive<\/p>\n<p>Substances Act. According to prosecution, on 24.11.1981 at about<\/p>\n<p>10 a.m. some country bombs and chopper were seized from the de<\/p>\n<p>facto complainant&#8217;s shop.          On enquiry, it was revealed         those<\/p>\n<p>articles were kept there by first and second accused. Petitioner is<\/p>\n<p>the 2nd accused. Hence, a crime was registered against petitioner<\/p>\n<p>and another.\n<\/p>\n<p id=\"p_2\">      3. The trial could not be proceeded with, because petitioner<\/p>\n<p>was absent. Petitioner was granted bail in this case, but later he<\/p>\n<p>absconded.      Hence, non-bailable warrant was issued against<\/p>\n<p>etitioner and he was arrested on 9.5.2010. He is in custody since<\/p>\n<p>then.\n<\/p>\n<p id=\"p_3\">      4. Learned counsel for petitioner submitted that petitioner<\/p>\n<p>was granted bail but he was forced to go abroad in connection<\/p>\n<p>with his job. He came back long back and is permanently residing<\/p>\n<p>within the limits of police station but petitioner was not arrested<\/p>\n<p>by police and hence he thought that proceedings were over. He<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">]B.A.No.2981\/10]                     2<\/span><\/p>\n<p>may be granted bail, it is submitted.\n<\/p>\n<p id=\"p_4\">      5. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the submissions made by petitioner&#8217;s counsel that<\/p>\n<p>petitioner was     available   in the address    is not correct.    On<\/p>\n<p>instruction, it was found that petitioner was not residing within the<\/p>\n<p>limits of the police station within which crime is registered or in the<\/p>\n<p>address shown by him.        He was residing within the limits of<\/p>\n<p>Kallambalam Police Station and petitioner could not be arrested<\/p>\n<p>since he was absconding.\n<\/p>\n<p id=\"p_5\">      5. On hearing both sides, I find that petitioner&#8217;s counsel was<\/p>\n<p>not even able to state the stage of the trial before trial court. The<\/p>\n<p>case was transferred to long pending case as L.P.No.11\/99. The<\/p>\n<p>proceedings are at a stand still since petitioner&#8217;s presence could<\/p>\n<p>not be procured. The order by which warrant is issued to petitioner<\/p>\n<p>has become final. The said order is not so far challenged. There is<\/p>\n<p>nothing to show that the order issuing warrant is illegal.    In such<\/p>\n<p>circumstances, I am not inclined to interfere with the discretion<\/p>\n<p>exercised by the trial court as per a lawful order. I am satisfied<\/p>\n<p>that petitioner may not be available for trial, if bail is granted at<\/p>\n<p>this stage.\n<\/p>\n<p id=\"p_6\">      Hence, petition is dismissed.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                 K.
