Lahoti, CJI<\/p>\n<p>Leave granted in SLP (C) No. 3106\/2004.\n<\/p>\n<p>In all these appeals, it is not necessary to notice the facts<br \/>\nof individual cases.  It would suffice to state that in all these<br \/>\ncases, the plaintiff, a woman, had undergone a sterilization<br \/>\noperation performed by a surgeon in the employment of the<br \/>\nState of Haryana.  Subsequent to the performance of the<br \/>\nsurgery, the woman became pregnant and delivered a child.<br \/>\nSuit was filed against the doctor who had performed the surgery,<br \/>\nclaiming compensation based on the cause of action of<br \/>\n&#8216;unwanted pregnancy&#8217; and &#8216;unwanted child&#8217;, attributable to the<br \/>\nfailure of the surgery. State of Haryana was impleaded, claiming<br \/>\ndecree against it on the principle of vicarious liability. The suits<br \/>\nhave been decreed and such decrees have been put in issue by<br \/>\nfiling these appeals by special leave.\n<\/p>\n<p>A 3-Judge Bench of this Court has held in <a href=\"\/doc\/1599759\/\">State of Punjab<br \/>\nv. Shiv Ram &amp; Ors. (C.A.<\/a> 5128 of 2002 decided on August 25,<br \/>\n2005) that child birth in spite of a sterilization operation can<br \/>\noccur due to negligence of the doctor in performance of the<br \/>\noperation, or due to certain natural causes such as spontaneous<br \/>\nrecanalisation.  The doctor can be held liable only in cases where<br \/>\nthe failure of the operation is attributable to his negligence and<br \/>\nnot otherwise.  Several textbooks on medical negligence have<br \/>\nrecognized the percentage of failure of the sterilization operation<br \/>\ndue to natural causes to be varying between 0.3% to 7%<br \/>\ndepending on the techniques or method chosen for performing<br \/>\nthe surgery out of the several prevalent and acceptable ones in<br \/>\nmedical science.  The fallopian tubes which are cut and sealed<br \/>\nmay reunite and the woman may conceive though the surgery<br \/>\nwas performed by a proficient doctor successfully by adopting a<br \/>\ntechnique recognized by medical science.  Thus, the pregnancy<br \/>\ncan be for reasons  de hors any negligence of the surgeon.  In<br \/>\nthe absence of proof of negligence, the surgeon cannot be held<br \/>\nliable to pay compensation.  Then the question of the State<br \/>\nbeing held vicariously liable also would not arise.  The decrees<br \/>\ncannot, therefore, be upheld.\n<\/p>\n<p>However, the learned counsel for the appellant-State<br \/>\nstated at the very outset that the plaintiffs in all these cases are<br \/>\npoor persons and the State was not interested in depriving the<br \/>\ndecree-holders of the payment made in satisfaction of the<br \/>\ndecrees but the State was certainly interested in having the<br \/>\nquestion of law settled.  The stand taken by the appellant-State<br \/>\nhas been that in spite of the decrees under appeal having been<br \/>\nset aside, any payment already made thereunder would be<br \/>\ntreated by the State as ex gratia payment.\n<\/p>\n<p>In view of the law laid down in <a href=\"\/doc\/1599759\/\">State of Punjab  v. Shiv<br \/>\nRam &amp; Ors.,<\/a>(supra) all these appeals are allowed. The<br \/>\njudgments and decrees under appeals are set aside. All the suits<br \/>\nfiled by the plaintiffs-respondents are dismissed. There will be no<br \/>\norder as to costs throughout.
