      The petitioner is the respondent in an application for<\/p>\n
divorce before the Family Court.               Divorce is sought on the<\/p>\n
ground of cruelty and desertion. Pending the said proceedings,<\/p>\n
the respondent herein that is the husband\/petitioner before the<\/p>\n
Family Court came to this court for a direction for expeditious<\/p>\n
disposal of the case. During the pendency of that application,<\/p>\n
there was an attempt made by the Bench to induce the parties to<\/p>\n
come to a settlement. That attempt did not succeed. The writ<\/p>\n
petition was allowed by judgment dated 30\/10\/2008 (Ext.P3) with<\/p>\n
a direction to the Family Court to dispose of the matter as<\/p>\n
expeditiously as possible at any rate within a period of four<\/p>\n
months from the date of receipt of a copy of the judgment.<\/p>\n
     2.   We are informed that though the trial is in progress,<\/p>\n
the matter has not been disposed of so far. The petitioner has<\/p>\n
now come to this court with a grievance that the court below is<\/p>\n
about to receive Ext.P6 document in evidence by examining the<\/p>\n
doctor who issued the same.\n<\/p>\n

      3.    The learned counsel contends that such evidence has to<\/p>\n
be eschewed and excluded. What are the reasons? The learned<\/p>\n
counsel contends first of all that this court had not referred the<\/p>\n
parties to any psychiatrist; but had referred the parties only to a<\/p>\n
psychologist. The person who issued Ext.P6 is a psychiatrist and<\/p>\n
therefore that evidence should not be accepted, it is contended. It<\/p>\n
is further contended that the opinion given in Ext.P6 is not<\/p>\n
acceptable. Sufficient detailed study and examination have not<\/p>\n
been carried out before issuing Ext.P6. The learned counsel has a<\/p>\n
further contention that the doctor who issued Ext.P6 is interested<\/p>\n
and biased.      Members of the family of the respondent are<\/p>\n
physicians. The author of Ext.P6 is a colleague of theirs. They<\/p>\n
belong to the same church also. For all these reasons, the contents<\/p>\n
of Ext.P6 cannot be accepted, contends the learned counsel.<\/p>\n
      4.    For all these various reasons, the petitioner prays that<\/p>\n
the court below may be directed not to receive Ext.P6 in evidence<\/p>\n
and examine the author thereof as a witness.          Invoking the<\/p>\n
extraordinary constitutional jurisdiction and Article 227<\/a> of the<\/p>\n
Constitution of India, such examination may be prevented. This in<\/p>\n
short is the plea.\n<\/p>\n
      5.    We are afraid, the request cannot be accepted. We find<\/p>\n
no reason to assume that the court below shall not consider the<\/p>\n

admissibility and acceptability of Ext.P6 and the oral evidence if<\/p>\n
any tendered by the author of Ext.P6. Nothing has been shown to<\/p>\n
us to persuade this court to accept that Ext.P6 is inadmissible in<\/p>\n
evidence. Be that as it may, we are satisfied that no detailed<\/p>\n
consideration of even that question is necessary in this<\/p>\n
proceedings. The petitioner must raise all his objections before the<\/p>\n
court below and the court below must consider all such objections<\/p>\n
raised about admissibility and acceptability of Ext.P6 and the oral<\/p>\n
evidence to be tendered by the author of Ext.P6.<\/p>\n
      6.    There is a time bound direction for disposal. We are not<\/p>\n
satisfied, in the circumstances of the case, that notwithstanding<\/p>\n
this direction, this writ petition can or ought to be entertained at<\/p>\n
this stage. The petitioner must certainly co-operate with the court<\/p>\n
below to implement the directions of this court for expeditious<\/p>\n
disposal.\n<\/p>\n
      7.    With the above observations, this writ petition is<\/p>\n
dismissed.\n<\/p>\n
      8.    Hand over copy of this order to the learned counsel for<\/p>\n
the petitioner.\n<\/p>\n
