cultivating  mother and the mother<\/p>\n
_.._of the accused as’-alvso mother of complainant are sisters<\/p>\n
   situate in Inchagera viiiage. She used<\/p>\n
to  visit her brother. It is alleged that<\/p>\n
during sugjhirizirsits in the past, the accused raised the<\/p>\n

Ramdbai after having tea in ihe house <\/p>\n

to {he bus stop in the viliage. wh;i_ch._is Jtiie\u00bb \\’}’i’ii,.r;;_1g,e’e-. <\/p>\n
gate and was waiting for t1″e1hs13’ri..7._it3he”Was in”<\/p>\n
company of Ahnaraya KLEfI1b’e1\\F._ At .__th;aVtV a
\ntempo passed to which _She  s’ig_\u00a7nai.”‘As she was<\/p>\n
trying to board the vehig%1c;’e-.{h;3 accjucsed came from<\/p>\n
Harijanwada    pushed her to the.\n<\/p>\n
groundy” h’1″‘i1e1f(:aft,ei:’ “he”.s’tari,ed'”assaulting her with the
\nspear. Anh_araye1’\u00abifnrhzidiaieiy rushed to save her. but<\/p>\n
he made ari4″‘att’e’n)V1:;\u00a3 i)’I1Vi’1:if1}. Annaraya tried to escape,<\/p>\n
V.”but”vU:1\u20ac3,.\u00e91C(?’~!iS\u20acd c’)Ve’r”p()wered him and assaulted him<\/p>\n
 Qjanxbiyel (spear). Pw.7 Shivagorid who<\/p>\n
runs’ a hvoiceiijhearby saw the incident, and rushed to the<\/p>\n
‘A “~.__v’sp0t td  Ramabai and then saw Anharaya also being<\/p>\n
A   Aiohg with him the complainant and Pw.9~<\/p>\n
 .. Shivasharahappa, Pw.i 1~Sha1’anayya joined in rescuing<\/p>\n
Vthe victim. but by that time. the accused had<\/p>\n
7. He would further contend that if the rnanner of
\nassault disclosed by the witnesses are applied t.o t_he<\/p>\n
medical evidence, the injuries as noticed by the do”(:–t.or<\/p>\n
would not have been caused on the victims as a..l.l.e”geds-<\/p>\n
the witnesses. This in short is only e1ss_er’t.ive.f;:-oint*f<\/p>\n
canvassed by the appellant.\n<\/p>\n
8. Per contra learned Additional State  Public
\nProsecutor has sL1pport.\u00abed  t.h,e  impugned judgment.
\nHowever. we have_ 1’t3~E1I_)j)T?E3tlS.\u20acd-,l,l’1L”  on record.<\/p>\n
9. We. h\u00abave- Vrigoticlevd_”*~ftf(3–;11 the evidence of Pw.7,<\/p>\n
Shivagond titett t1.\u20ac.’~ is’=_arT”independent witness who had<\/p>\n
‘”‘undv%.sp1i1’ted’iy rui’1i”1’ihg a hotel. T he incident has<\/p>\n
  front. of the hotel at the bus stop. He<\/p>\n
has-..reache_d’..-the spot as he had been noticing arrival of<\/p>\n
“”–._V’RAama.bs.i” in the cornpariy of Anharaya as also the<\/p>\n
” _ teem}:-iainant.. He has noticed her not only arriving at<\/p>\n
 do  Spot, but mitempting to board the vehicle. He was<\/p>\n
crossexamiraed on that aspect… The second part of his<\/p>\n
evidence relates to overt. acts of the accused. The<\/p>\n

by these witnesses also shows that Annaraya suffered in<\/p>\n

  alreaciy present at the bus stop when<\/p>\n

went for rescue of Ramabai. but accused after<\/p>\n
assaulting her ran towards Armaraya to assauit. him<\/p>\n

 it ,_srtieles are supported from the evidence of Pw.8 who<\/p>\n
has also states that on 4.7.2000. the accused guided to<\/p>\n
a hut on the land and after visit,.i1’1g the  he took<\/p>\n
