Application No.821 of 2007 &amp;\n                  R. S. A. No.1091 of 2007\n          ------------------------------------------------\n           Dated this the 15th day of July, 2008\n\n                         JUDGMENT\n<\/pre>\n<p id=\"p_1\">    This   is      an       application               seeking  for<\/p>\n<p>condonation of delay of 79 days in filing the<\/p>\n<p>appeal.  The       judgment             under           appeal  was<\/p>\n<p>delivered  on      31\/07\/06.              Copy        thereof  was<\/p>\n<p>applied for on 01\/08\/06. Stamp papers called<\/p>\n<p>for on 19\/02\/07 were produced on 20\/02\/07 and<\/p>\n<p>judgment was taken delivery of on 08\/03\/07<\/p>\n<p>though date fixed to appear to receive copy<\/p>\n<p>was on 07\/03\/07. However, appeal is filed only<\/p>\n<p>on 24\/08\/07 after more than five and a half<\/p>\n<p>months.  The    appeal          is      one        filed    by the<\/p>\n<p>defendants   against           the        concurrent         decree<\/p>\n<p>passed by the courts below in favour of the<\/p>\n<p>plaintiffs.\n<\/p>\n<p id=\"p_1\">    2. In the affidavit filed by the first<\/p>\n<p>appellant in support of the application for<\/p>\n<p>condonation of delay he has stated that the<\/p>\n<p>appeal ought to have been presented on or<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">R. S. A. No.1091 of 2007        -2-<\/span><\/p>\n<p>       before 05\/06\/07, but the appeal could not be<\/p>\n<p>       filed in time as he could not contact his<\/p>\n<p>       counsel as he was suffering from acute fever<\/p>\n<p>       from 26\/05\/07 to 10\/06\/07 and he was advised<\/p>\n<p>       to take rest for three weeks due to heavy body<\/p>\n<p>       pain and he could contact the counsel only on<\/p>\n<p>       01\/08\/07         and the counsel  required   some<\/p>\n<p>       documents for preparation of appeal and the<\/p>\n<p>       same was collected and handed over to him only<\/p>\n<p>       on 12\/08\/07 and thereafter only the appeal was<\/p>\n<p>       prepared and filed on 24\/08\/07 and thus there<\/p>\n<p>       is delay of 79 days in filing the R.S.A and<\/p>\n<p>       the delay is neither deliberate nor wilful and<\/p>\n<p>       has therefore, to be condoned.\n<\/p>\n<p id=\"p_2\">               3. Even assuming and taking the aforesaid<\/p>\n<p>       grounds as true the averments made by the<\/p>\n<p>       first appellant in the affidavit that he was<\/p>\n<p>       suffering from fever from 26\/05\/07 to 10\/06\/07<\/p>\n<p>       only and advice to take rest was also only for<\/p>\n<p>       three weeks, but he contacted his lawyer only<\/p>\n<p>       as      late     as  on 01\/08\/07.  There  is   no<\/p>\n<p>       explanation for this much delay. As regards<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">R. S. A. No.1091 of 2007          -3-<\/span><\/p>\n<p>       the further averment that the counsel required<\/p>\n<p>       some document for preparation of the appeal,<\/p>\n<p>       also there is no explanation as to what were<\/p>\n<p>       the documents which were not supplied to the<\/p>\n<p>       lawyer to enable him to file appeal. In the<\/p>\n<p>       circumstances, I am not prepared to accept the<\/p>\n<p>       reasons assigned for condonation of delay as<\/p>\n<p>       just and sufficient cause. I am not of the<\/p>\n<p>       view that the rights which have accrued to the<\/p>\n<p>       successful party can be disturbed on such bald<\/p>\n<p>       averments         made  by  the aggrieved  party,<\/p>\n<p>       condoning the delay taking a lenient view in<\/p>\n<p>       that matter as there should be a finality to<\/p>\n<p>       the judgment. Hence, for reason of absence of<\/p>\n<p>       any just and sufficient cause to condone the<\/p>\n<p>       delay of as much as 79 days in filing the<\/p>\n<p>       appeal,          I dismiss the C.M.
