At the time of his  promotion  to\t the\nJunior Management Grade Scale-1, he gave an undertaking\t for\nposting\t anywhere in India, and was consequently  posted  as\nBranch Officer in the State of Bihar. Thereafter, he filed a\nwrit  petition\tin the High Court claiming his\ttransfer  to\nChandigarh Zone on the ground of his wife being employed  at\nChandigarh.  The writ petition was allowed. The\t Bank  filed\nappeal by special leave to this Court.\n    It was contended on behalf of the respondent that para 4\n(vi) of Memorandum dated 3.4.1986 of the Government of India\ncontained guidelines for posting of husband and wife at\t one\nstation\t which\twere meant to be followed also\tby  all\t the\nPublic Sector Undertakings, and, according to the provisions\nof the Banking Compa-\n493\nnies (Acquisition and <a href=\"\/doc\/1232997\/\" id=\"a_1\">Transfer of Undertakings) Act<\/a> 1970 and\nthe Bank of India (Officers') Service Regulations, 1979 made\nthereunder, the bank was bound to follow the guidelines\t and\ndirections issued by the Central Government.\nAllowing the appeal of the Bank, this Court,\n    HELD:   1.\tAlthough  the  guidelines  require  the\t two\nspouses to be posted at one place as far as practicable\t the\ndesirability  of such a course being obvious-yet  that\tdoes\nnot enable any spouse to claim such a posting as of right if\nthe  departmental authorities do not consider  it  feasible;\nnor does it mean that their place of posting should invaria-\nbly be one of their choice even though their preference\t may\nbe  taken into account while making the decision in  accord-\nance with the administrative needs. The only thing  required\nis  that  the departmental authorities should  consider\t the\nfeasibility of a suitable posting along with the  exigencies\nof administration and enable the two spouses to live togeth-\ner at one station if it is possible without any detriment to\nthe  administrative needs and the claim of other  employees.\n[pp 495 E; 496 BC]\n    2.\tAfter accepting a promotion or any appointment in an\nAll  india  Service, subordinating the need  of\t the  couple\nliving\ttogether  at one station, they cannot  as  of  right\nclaim to be relieved of the ordinary incidents of the  serv-\nice  and avoid transfer to a different place on\t the  ground\nthat  the  spouses  thereby would  be  posted  at  different\nplaces.\t While choosing the career and a particular  service\nthe couple have to bear in mind this factor and be  prepared\nto  face  such a hardship particularly when they  belong  to\ndifferent  services. They have to make their choice  at\t the\nthreshhold between career prospects and family life. [pp 495\nF-H; 496 A]\n    3.1 In the instant case, the respondent voluntarily gave\nan  undertaking\t that he was prepared to be  posted  at\t any\nplace in India and on that basis got promotion and  thereaf-\nter  sought to be relieved of that necessary incident of  an\nAll India Service on the ground that his wife had to  remain\nat Chandigarh. [p. 496 AB]\n    3.2\t In the face of Regulation 47 of the Bank  of  India\n(Officers')  Service  Regulations, 1979 according  to  which\nevery officer is liable for transfer to any office or branch\nof the Bank of India or to any place in India and the  clear\nprovision  for\tsuch transfer in the policy  read  with\t the\nnotice\tdated March 28, 1988, the High Court's order  cannot\nbe sustained. [p. 495 BC]\n494\n    The\t High  Court  was in error in  overlooking  all\t the\nrelevant aspect as well as the absence of any legal right in\nthe  respondent\t to claim the relief which it granted  as  a\nmatter of course. [p. 496 CD]\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">CIVIL APPELLATE JURISDICTION: Civil Appeal No. 4541 of<br \/>\n1991.\n<\/p>\n<p id=\"p_1\">    From the Judgment and Order dated 6.8.1991 of the Punjab<br \/>\nand Haryana High Court in C.W.P. Bagga for the Respond-<br \/>\nents.\n<\/p>\n<p id=\"p_3\">The Judgment of the Court was delivered by<br \/>\n    VERMA,  J.\tThe respondent, Jagjit Singh Mehta,  is\t em-<br \/>\nployed\tat  present in the Bank of India as  an\t officer  in<br \/>\nJunior\tManagement  Grade  Scale-1 and posted  in  a  Branch<br \/>\nOffice\tof  the\t Bank in District Giridih in  the  State  of<br \/>\nBihar.\tThe respondent was earlier employed in the  clerical<br \/>\ncadre of the Bank and was posted at Chandigarh. According to<br \/>\nthe  policy contained in Annexure-B read with  notice  dated<br \/>\nMarch 28, 1988 (Annexure-C), on promotion from the  clerical<br \/>\ncadre to the Officers&#8217; Grade, the respondent had to indicate<br \/>\nhis preparedness for posting anywhere in India according  to<br \/>\nthe availability of vacancies. The respondent readily  indi-<br \/>\ncated  his  preparedness to be posted anywhere in  India  by<br \/>\nAnnexure-D  dated  April 19, 1988 when\tthe  respondent\t was<br \/>\nposted as a Clerk at Chandigarh prior to his promotion as an<br \/>\nOfficer.\n<\/p>\n<p id=\"p_4\">    After  getting  the promotion as an\t officer  and  being<br \/>\nposted\tin  Bihar on the above basis, the  petitioner  filed<br \/>\nCivil  Writ Petition No. 2415 of 1991 in the High  Court  of<br \/>\nPunjab\tand Haryana for a direction to the Bank to  transfer<br \/>\nhim from the Bihar Zone to the Chandigarh Zone on the ground<br \/>\nthat his wife is employed as a Senior Accountant at  Chandi-<br \/>\ngarh. The writ petition has been allowed by a Division Bench<br \/>\n(M.R  Agnihotri\t &amp; D.S.Mehra, JJ,) of the High\tCourt  by  a<br \/>\ncryptic order dated 6.8.1991 which reads as under :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>\t      &#8220;After  hearing  the learned counsel  for\t the<br \/>\n\t      parties, we allow this petition and direct the<br \/>\n\t      respondents  by  issuing a  writ\tof  mandamus<br \/>\n\t      commanding  the Bank of India to transfer\t the<br \/>\n\t      peti-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">\t      495<\/span><\/p>\n<blockquote id=\"blockquote_1\"><p>\t      tioner and post him somewhere near  Chandigarh<br \/>\n\t      as his wife is posted as a Clerk in the office<br \/>\n\t      of  the Advocate General, Punjab,\t Chandigarh.<br \/>\n\t      This  shall  be done within a  period  of\t two<br \/>\n\t      months. No costs.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">    The\t petitioner-Bank of India is aggrieved by the  above<br \/>\norder of the High Court. Special leave is granted.<br \/>\n    In\tthe  face  of Regulation 47 of\tthe  Bank  of  India<br \/>\n(Officers&#8217;)  Service  Regulations, 1979 according  to  which<br \/>\nevery officer is liable for transfer to any office or branch<br \/>\nof the Bank of India or to any place in India and the  clear<br \/>\nprovision  for\tsuch a transfer in the\tpolicy\t(Annexure-B)<br \/>\nread  with notice dated March 28, 1988 (Annexure-C),  it  is<br \/>\ndifficult  to  sustain\tthe  High  Court&#8217;s  order.  However,<br \/>\nlearned counsel for the respondent placed reliance on para 4\n<\/p>\n<p id=\"p_6\">(vi) of a Memorandum dated April 3, 1986 (AnnexureH) of\t the<br \/>\nGovernment  of\tIndia containing guidelines for\t posting  of<br \/>\nhusband\t and wife at one station which are meant to be\tfol-<br \/>\nlowed  also by all the Public Sector  Undertakings.  Learned<br \/>\ncounsel\t urged\tthat according to the  statutory  provisions<br \/>\ncontained in the Banking Companies (Acquisition and <a href=\"\/doc\/1232997\/\" id=\"a_1\">Transfer<br \/>\nof Undertakings) Act<\/a>, 1970 and the Bank of India (Officers&#8217;)<br \/>\nService Regulations, 1979 made thereunder, the Bank is bound<br \/>\nto  follow the guidelines and directions issued by the\tCen-<br \/>\ntral Government in this behalf.\n<\/p>\n<p id=\"p_7\">    There  can\tbe no doubt that ordinarily and\t as  far  as<br \/>\npracticable  the  husband  and wife who\t are  both  employed<br \/>\nshould be posted at the same station even if their employers<br \/>\nbe different. The desirability of such a course is  obvious.<br \/>\nHowever,  this\tdoes not mean that their  place\t of  posting<br \/>\nshould invariably be one of their choice, even though  their<br \/>\npreference may be taken into account while making the  deci-<br \/>\nsion  in  accordance with the administrative needs.  In\t the<br \/>\ncase of All-India Services, the hardship resulting from\t the<br \/>\ntwo being posted at different stations may be unavoidable at<br \/>\ntimes  particularly when they belong to\t different  services<br \/>\nand  one of them cannot be transferred to the place  of\t the<br \/>\nother&#8217;s posting. While choosing the career and a  particular<br \/>\nservice, the couple have to bear in mind this factor and  be<br \/>\nprepared to face such a hardship if the administrative needs<br \/>\nand transfer policy do not permit the posting of both at one<br \/>\nplace without sacrifice of the requirements of the  adminis-<br \/>\ntration\t and  needs of other employees. In such a  case\t the<br \/>\ncouple\thave to make their choice at the  threshold  between<br \/>\ncareer prospects and family life. After giving preference to<br \/>\nthe  career prospects by accepting such a promotion  or\t any<br \/>\nappointment  in\t an All-India Service with the\tincident  of<br \/>\ntransfer  to any place in India, subordinating the  need  of<br \/>\nthe couple living together at one<br \/>\n<span class=\"hidden_text\" id=\"span_1\">496<\/span><br \/>\nstation, they cannot as of right claim to be relieved of the<br \/>\nordinary  incidents of All-India Service and avoid  transfer<br \/>\nto a different place on the ground that the spouses  thereby<br \/>\nwould  be  posted at different places. In addition,  in\t the<br \/>\npresent case, the respondent voluntarily gave an undertaking<br \/>\nthat he was. prepared to be posted at any place in India and<br \/>\non  that basis got promotion from the clerical cadre to\t the<br \/>\nOfficers&#8217;  grade and thereafter he seeks to be\trelieved  of<br \/>\nthat  necessary incident of All-India Service on the  ground<br \/>\nthat  his  wife has to remain at Chandigarh.  No  doubt\t the<br \/>\nguidelines require the two spouses to be posted at one place<br \/>\nas  far as practicable, but that does not enable any  spouse<br \/>\nto  claim  such a posting as of right  if  the\tdepartmental<br \/>\nauthorities  do\t not consider it feasible.  The\t only  thing<br \/>\nrequired is that the departmental authorities should consid-<br \/>\ner  this aspect along with the exigencies of  administration<br \/>\nand  enable the two spouses to live together at one  station<br \/>\nif  it is possible without any detriment to the\t administra-<br \/>\ntive needs and the claim of other employees.<br \/>\n    The\t High  Court  was in error in  overlooking  all\t the<br \/>\nrelevant  aspects as well as the absence of any legal  fight<br \/>\nin  the respondent to claim the relief which the High  Court<br \/>\nhas  granted as a matter of course. The High  Court&#8217;s  order<br \/>\nmust, therefore, be set aside.\n<\/p>\n<p id=\"p_8\">    Consequently, the appeal is allowed, the impugned  order<br \/>\nof  the\t High Court is set aside and the  respondent&#8217;s\twrit<br \/>\npetition is dismissed.
