Mahto, A.P.P.\n     For the O.P.No.2              : Mr. S.P.Roy, Advocate\n                                 ----\n\n03\/ 14.11.2011<\/pre>\n<p id=\"p_1\">      Heard the counsel for the petitioner and the<\/p>\n<p>        counsel for the State.\n<\/p>\n<p id=\"p_1\">                   The counsel for the petitioner has submitted<\/p>\n<p>        that there is not a single chit of paper to show that the<\/p>\n<p>        complainant has given such a huge amount to the<\/p>\n<p>        petitioner for selling the land in question.         It is also<\/p>\n<p>        submitted that even the agreement, which has been<\/p>\n<p>        produced in this case, is not signed by the present<\/p>\n<p>        petitioners and the sign made on the said agreement is<\/p>\n<p>        not a genuine signature.\n<\/p>\n<p id=\"p_2\">                   The counsel for the complainant has submitted<\/p>\n<p>        that the complainant has given a huge amount i.e.<\/p>\n<p>        Rs.2,62,000\/- within a period of two years on the<\/p>\n<p>        assurance given by the petitioner No.1 that she will<\/p>\n<p>        register the land        in question in the name of the<\/p>\n<p>        complainant.\n<\/p>\n<p id=\"p_3\">                   Considering the facts and circumstances of the<\/p>\n<p>        case, I direct all the petitioners to deposit a sum of<\/p>\n<p>        Rs.50,000\/- in total in the trial court within a period of four<\/p>\n<p>        weeks from the date of this order and surrender within the<br \/>\n       said period. If they so deposit the said amount and<\/p>\n<p>      surrender within the said period, the trial court is directed<\/p>\n<p>      to release the petitioners namely        Sibani Dubey @<\/p>\n<p>      Shivani Dubey, Devendra Kumar Dubey and Tulsi Pd.<\/p>\n<p>      Dubey on bail on furnishing bail bonds of Rs.10,000\/-<\/p>\n<p>      each with two sureties of the like amount each, to the<\/p>\n<p>      satisfaction of the learned Judicial Magistrate, Deoghar,<\/p>\n<p>      in connection with P.C.R. Case No.512 of 2007<\/p>\n<p>      (T.R.No.687 of 2010), subject to the conditions that one<\/p>\n<p>      of the bailors will be their close relative and another will<\/p>\n<p>      be of local resident having immovable property within the<\/p>\n<p>      jurisdiction of the trial court concerned and also subject to<\/p>\n<p>      the conditions laid down under Section 438 (2) <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.<\/p>\n<p id=\"p_4\">                However, the trial court is directed to make a<\/p>\n<p>      long term fixed deposit of the aforesaid amount in the<\/p>\n<p>      name of the petitioner No.1 namely Sibani Dubey @<\/p>\n<p>      Shivani Dubey, which will be released subject to the<\/p>\n<p>      result of the case after conclusion of the trial.
