1.The first respondent filed W.P(C).20150\/08 seeking reliefs in<\/p>\n
  relation to proceedings under the SARFAESI Act<\/a>. That writ<\/p>\n
  petition was ordered on 24.9.2008.                He carried an appeal<\/p>\n
  against that. As per Ext.P1 judgment dated 24.10.2008, the<\/p>\n
  Division Bench ordered that appeal, W.A.2101\/08.<\/p>\n
2.When the appeal was being considered by the Division Bench,<\/p>\n
  the situation was that the residential building of the first<\/p>\n
  respondent herein was in the possession of the bank, it having<\/p>\n
  taken possession under SARFAESI Act<\/a> proceedings. Before<\/p>\n
  the Division Bench, an affidavit of undertaking was filed by the<\/p>\n
  appellant undertaking to deposit an amount of Rs.7,00,000\/-<\/p>\n

                                 2<\/span><\/p>\n
 within one month from then and balance within a further<\/p>\n
 period of three months.         This was to provide him an<\/p>\n
 opportunity to occupy the residential building. The appellant<\/p>\n
 undertook that if he commits default in remitting any payment,<\/p>\n
 he shall ultimately hand over possession of the property to the<\/p>\n
 bank. In spite of serious opposition from the bank, the Bench<\/p>\n
 acted on that undertaking of the appellant and passed the<\/p>\n
 following order:\n<\/p>\n
\n
             “(i) The appellant shall deposit a sum of<\/p>\n
       Rs.7,00,000\/-    (Rupees   seven   lakhs  only)  as<\/p>\n
       undertaken by him in the affidavit filed before this<\/p>\n
       Court within a month’s time from today.<\/p>\n<\/blockquote>\n
             (ii)  If such deposit is made within the time<\/p>\n
       granted by this Court, the first respondent Bank is<\/p>\n
       directed to handover possession of the residential<\/p>\n
       house situated in Sy.No.782\/2-2 of Alappuzha West<\/p>\n
       Village to the appellant.<\/p><\/blockquote>\n
\n
             (iii) The appellant shall pay the balance of<\/p>\n
        amount due to the first respondent Bank within the<\/p>\n
WPC.35275\/09.\n<\/p>\n
                                  3<\/span><\/p>\n
        outer limits of four months from today.       If such<\/p>\n
        payment is not made within the time granted by<\/p>\n
        this Court, the appellant shall voluntarily hand over<\/p>\n
        vacant possession of the residential house situated<\/p>\n
        in Sy.No.782\/2-2 of Alappuzha West village to the<\/p>\n
        first respondent Bank<\/p>\n
              (iv) If for any reason, the appellant fails to<\/p>\n
        hand over vacant possession of the residential<\/p>\n
        house, the first respondent Bank is at liberty to<\/p>\n
        take possession of the property with the assistance<\/p>\n
        of the police authorities.\n<\/p>\n
\n
              (v) The first respondent Bank shall not effect<\/p>\n
        sale of the property for a further period of four<\/p>\n
        months from today.”\n<\/p>\n

3.Direction No.(iv) of the aforesaid order was issued on the basis<\/p>\n
  of the undertaking of the first respondent herein that he shall<\/p>\n
  voluntarily hand over possession of the property to the<\/p>\n
  petitioner herein, in case of failure to pay the amount. That<\/p>\n
  being part of the judicial order issued by the Division Bench,<\/p>\n
WPC.35275\/09.\n<\/p>\n
                                 4<\/span><\/p>\n
  acting on the undertaking, the writ petitioner bank is well<\/p>\n
  founded in requesting for police help since the Bench had<\/p>\n
  directed that if for any reason there is failure to hand over<\/p>\n
  vacant possession, the bank will be at liberty to take<\/p>\n
  possession with assistance of police department.<\/p>\n
4.Learned counsel for the first respondent argued that police<\/p>\n
  force can be brought in only if the Bank initiates fresh<\/p>\n
  proceedings under section 14<\/a> of the SARFAESI Act. We repel<\/p>\n
  this argument for the reason that the Bank had earlier<\/p>\n
  obtained possession and the first respondent herein was<\/p>\n
  permitted to occupy it only in terms of the direction of this<\/p>\n
  Court. That direction was issued by this Court coupled with<\/p>\n
  the liability of the debtor to voluntarily surrender possession<\/p>\n
  on failure to pay the amount. This Court had also directed that<\/p>\n
  the bank would be entitled to take possession with police force<\/p>\n
  in case of default. That judgment and order have become final<\/p>\n
WPC.35275\/09.\n<\/p>\n
                                5<\/span><\/p>\n
 inter partis. We, therefore, overrule the contention of the first<\/p>\n
 respondent in that regard.\n<\/p>\n
\n
 For the aforesaid reasons, this writ petition is allowed<\/p>\n
 directing respondents 2 to 4 to forthwith give effect to the<\/p>\n
 request of the petitioner in Ext.P2.\n<\/p>\n
