           The sole accused in C.C.No.421 of 2004 on the<\/p>\n
file of the Judicial First Class Magistrate Court,<\/p>\n
Nedumangad       seeks an order from this Court under<\/p>\n
Section 482<\/a> of the Code of Criminal Procedure quashing<\/p>\n
Annexure A5 complaint pending before the J.F.C.M.Court,<\/p>\n
Nedumangad.      C.C.No.421 of 2004 is instituted in the<\/p>\n
court below taking cognizance upon Annexure A5 protest<\/p>\n
complaint filed by the second respondent herein.<\/p>\n
      2.   The case of the petitioner can be summarised as<\/p>\n
follows:-\n<\/p>\n
        The petitioner was attacked on 28.4.2004 at about<\/p>\n
6.30 p.m. by the husband of the second respondent herein<\/p>\n
and on the basis of the information furnished by the<\/p>\n
petitioner, Crime No.107 of 2004 was registered in the<\/p>\n
Palode Police Station against the husband of the second<\/p>\n
respondent and certain other persons for the offences<\/p>\n
punishable under Sections 452<\/a>,294(b)<\/a>,323<\/a>,332<\/a>,427<\/a> and 34<\/a><\/p>\n
I.P.C.  Thereafter, to counter blast the above criminal<\/p>\n

case, after about one and a half month, the second<\/p>\n
respondent herein filed a complaint straight away before<\/p>\n
the Judicial First Class Magistrate Court, Nedumangad<\/p>\n
with the allegation that the petitioner had committed an<\/p>\n
offence under Section 354<\/a> I.P.C. against her on<\/p>\n
26.4.2004. The said complaint was sent to Palode Police<\/p>\n
Station under Section 156(3)<\/a> of Criminal Procedure<\/p>\n
Code for investigation.     On receiving the complaint,<\/p>\n
Crime No.125 of 2004 was registered in the Palode<\/p>\n
Police Station and they undertook the investigation and<\/p>\n
through their investigation, it is revealed that the<\/p>\n
allegation is false and they have accordingly filed a refer<\/p>\n
report, a copy of which is filed along with this Crl.M.C.<\/p>\n
as Annexure A4. Aggrieved by Annexure A4 report, in<\/p>\n
spite of various petitions and representation filed before<\/p>\n
the various authorities, the second respondent herein<\/p>\n
preferred the present protest complaint viz., Annexure<\/p>\n
A5 in which the allegation is that at about 3 p.m., on<\/p>\n
26.4.2004, the petitioner herein had committed the<\/p>\n
offence under Section 354<\/a> I.P.C. when the complainant<\/p>\n

approached him with the complaint of diarrhea and<\/p>\n
stomach pain, when she was attending her mother in law<\/p>\n
who was admitted in the hospital where the petitioner is<\/p>\n
working.    The court below took cognizance upon the<\/p>\n
above complaint and instituted the above case. It is the<\/p>\n
above case and the complaint, are sought to be quashed<\/p>\n
in these proceedings.\n<\/p>\n
      3.   I have heard the learned counsel for the<\/p>\n
petitioner   and     respondents  and  also   the   Public<\/p>\n
Prosecutor for the first respondent.<\/p>\n
      4.   Reiterating the contention raised in the<\/p>\n
Crl.M.C., the counsel for the petitioner submits that<\/p>\n
Annexure A5 complaint is filed with mala fide intention<\/p>\n
and to simply harass the petitioner who is a Doctor by<\/p>\n
profession and in lodging Annexure A5 complaint, his<\/p>\n
professional enemies are behind it. It is also pointed out<\/p>\n
by counsel for the petitioner that on the basis of receipt<\/p>\n
of the complaint from the court under Section 156(3)<\/a> of<\/p>\n
the Code of Criminal Procedure, after registering a<\/p>\n
crime, the Police had already conducted a very detailed<\/p>\n

investigation     and  they   have   questioned   several<\/p>\n
witnesses and examined various documents and finally,<\/p>\n
they found that the allegations raised against the<\/p>\n
petitioner are absolutely false and baseless and they<\/p>\n
intimated their conclusion by filing Annexure A4 refer<\/p>\n
report to the court below.       Learned counsel further<\/p>\n
submits    that    considering   the  entire  facts  and<\/p>\n
circumstances involved in the case, the only conclusion<\/p>\n
that can be arrived is that Annexure A5 protest<\/p>\n
complaint is filed with a mala fide intention. In support<\/p>\n
of the above contention, he further submits that there is<\/p>\n
long delay in filing the complaint before the court below<\/p>\n
even during the initial time. The delay was not properly<\/p>\n
explained. According to the counsel for the petitioner,<\/p>\n
even on comparison regarding the date of occurrence in<\/p>\n
the above two incidents, it can be seen that actually the<\/p>\n
petitioner was attacked on 28.4.2004 and the Police<\/p>\n
registered a crime and investigation was conducted and<\/p>\n
proper charge was laid. If the occurrence alleged in the<\/p>\n
protest complaint is true, there is no explanation as to<\/p>\n

why the complainant failed to approach the Police in<\/p>\n
time and even if the Police has not taken appropriate<\/p>\n
action at her request, it was also open to her to<\/p>\n
approach the higher superior officers of the Palode<\/p>\n
Police Station authorities. According to counsel for the<\/p>\n
petitioner, there is no explanation for the above lapse on<\/p>\n
the part of the complainant. The learned counsel for the<\/p>\n
petitioner     also invited my attention to certain<\/p>\n
contradictions and omissions that contained in the<\/p>\n
statement    recorded      by   the   Police during  their<\/p>\n
investigation in Crime No.125 of 2004 which was<\/p>\n
registered at the instance of the complainant.        This<\/p>\n
Court is not in a position to enter into any finding or<\/p>\n
appreciating      those    contradictions   and  omissions<\/p>\n
because, as on today, those documents are not part of<\/p>\n
the prosecution or complainant’s record. Certainly, if<\/p>\n
the petitioner is so advised, the same can be considered<\/p>\n
at the time of trial, if the law permits.<\/p>\n
      5.   Counsel for the petitioner very much argued<\/p>\n
regarding the delay occurred in filing the complaint<\/p>\n

initially before the court below. It is the case of the<\/p>\n
complainant which can be seen from Annexure A5<\/p>\n
complaint that the approach adopted by the Police was<\/p>\n
against the complainant and to help the petitioner and<\/p>\n
therefore, she approached various other authorities in<\/p>\n
the mean while. It is true that if the date of alleged<\/p>\n
incident has taken as a true date, there is delay of more<\/p>\n
than 40 days.         The explanation offered by the<\/p>\n
complainant was to be appreciated during the trial of<\/p>\n
the case and it is for the trial court to come into a<\/p>\n
correct    conclusion   on    merits   regarding    those<\/p>\n
contentions. It is not proper for this court to enter into<\/p>\n
the finding on that issue.\n<\/p>\n
      6.   I have perused Annexure A5 complaint and I<\/p>\n
am deliberately abstaining from making any observation<\/p>\n
or finding regarding the merits of the allegations<\/p>\n
contained in the complaint.      If the petitioner is of<\/p>\n
opinion that the protest complaint is made to harass the<\/p>\n
petitioner and with mala fide intention, he can raise<\/p>\n
those contentions before the court below at appropriate<\/p>\n

stage and he can also rely upon the materials which are<\/p>\n
produced at that time or after taking steps for producing<\/p>\n
such materials. But, on a consideration of Annexure A5<\/p>\n
protest complaint and other materials on record, I find<\/p>\n
no ground to interfere with Annexure A5 complaint.<\/p>\n
      7.   In the light of the above discussion and<\/p>\n
materials available on record, no interference is<\/p>\n
warranted under Section 482<\/a> of the Code of Criminal<\/p>\n
Procedure. All the contentions raised by the petitioner<\/p>\n
in this petition can be raised before the court below at<\/p>\n
appropriate time. It is open for the petitioner to avail<\/p>\n
such opportunity even without any observation or any<\/p>\n
direction.\n<\/p>\n
           With the above observation, the Crl.M.C. is<\/p>\n
dismissed.\n<\/p>\n
