However, it is pertinent to note that when Special<br \/>\n\tCivil Application No.6906 of 1993 came up for admission hearing<br \/>\n\tbefore this Court on 29th July 1994, this Court (Coram :<br \/>\n\tH.L. Gokhale, J) passed the following order:\n<\/p>\n<p id=\"p_2\">&#8220;Petitioners<br \/>\nand advocates are absent when the matter is called out. Heard<br \/>\nMr.Harin Raval for Respondent No.1 &amp; Shri A.R. Dave for<br \/>\nRespondent No.2 &amp; 3 holding for D.R. Dave.\n<\/p>\n<p id=\"p_3\">\tRule.\n<\/p>\n<p id=\"p_4\">To be heard with Spl.C.A. No.3641 of 1992. No interim relief.&#8221;\n<\/p>\n<p id=\"p_5\">Thus,<br \/>\n\twhen Special Civil Application No.6906 of 1993 has been ordered to<br \/>\n\tbe heard with Special Civil Application No.3641 of 1992, it would be<br \/>\n\tappropriate to recall the order passed in both the matters and it<br \/>\n\twould be appropriate to restore both the matters accordingly.\n<\/p>\n<p id=\"p_6\">In<br \/>\n\tview of aforesaid, present application is hereby allowed. The oral<br \/>\n\tjudgment dated 16th April 2010 passed by this Court in<br \/>\n\tSpecial Civil Application No.3641 of 1992 with Special Civil<br \/>\n\tApplication No.6906 of 1993, is hereby recalled. The Registry is<br \/>\n\tdirected to list both the matters for hearing before the regular<br \/>\n\tCourt on 25th October 2010.
