The High\t Court\tdis-\n\tmissed the appeal in view of the appellants' entitlement  to\n\tset off the period of their pre-trial detention against\t the\n\tentire\tsentence  of imprisonment imposed  upon\t them  after\n\tobserving  that\t it was not necessary to go into the  matter\n\tas it  would be only of\t an academic interest.\n\t    Accepting the appeal by Special Leave and remanding\t the\n\tcases\tto  the High Court for disposing of on\tmerits,\t the\n\tCourt,\n\t    HELD:  (1 ) The High Court was in error in so far as  it\n\tdeclined  to  go into the validity of the conviction of\t the\n\tappellants.  [600 F]\n\t    (2) The object of a challenge to conviction is to  avoid\n\tcertain\t  consequences flowing from conviction and  also  to\n\terase  the stigma resulting from the conviction.   The\tfact\n\tthat the convicted person has already Undergone the sentence\n\tor is otherwise entitled to be set at liberty because of the\n\tlength\tof the period during which he has been under  deten-\n\ttion  during the course of investigation, enquiry and  trial\n\tcannot\tprevent the accused from challenging his  conviction\n\tin appeal. A.<br \/>\n\tNo. 462 of 1973.\n<\/p>\n<p id=\"p_2\">\tS.C. Agarwala and A.P. Gupta for the Appellants.<br \/>\n\tP.P. Rao, G.N. Rao and T.V.S.N. Chari for the Respondent.<br \/>\n\t&#8216;The Judgment of the Court was delivered by<br \/>\n\t    KHANNA,  J. This appeal by special leave is against\t the<br \/>\n\tjudgment  of  the Andhra Pradesh High Court  dismissing\t the<br \/>\n\tappeal filed by the appellants.\n<\/p>\n<p id=\"p_3\">\t    The appellants were convicted by the Additional Sessions<br \/>\n\tJudge Visakhapatnam for offences under <a href=\"\/doc\/1258372\/\" id=\"a_4\">sections 147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_5\">148<\/a> and<br \/>\n\t<a href=\"\/doc\/1672685\/\" id=\"a_6\">352<\/a>  Indian  Penal Code.  Some of the appellants  were\talso<br \/>\n\tconvicted  for\toffences under <a href=\"\/doc\/1335368\/\" id=\"a_7\">section 5<\/a>  of  the  Explosive<br \/>\n\tSubstances Act and <a href=\"\/doc\/73862\/\" id=\"a_8\">section 25<\/a> of the Indian Arms Act.\tThey<br \/>\n\twere  sentenced\t to various terms of  imprisonment  and\t the<br \/>\n\tsentences  were\t ordered  to run  concurrently.\t  The  total<br \/>\n\tsentence  of  imprisonment to be undergone by  some  of\t the<br \/>\n\tappellants was<br \/>\n<span class=\"hidden_text\" id=\"span_1\">\t600<\/span><br \/>\n\ttwo  years while in the case of the other appellants it\t was<br \/>\n\tone year. The appellants went up in appeal to the High Court<br \/>\n\tagainst\t the  judgment of the trial court.  The\t High  Court<br \/>\n\treferred to the fact that the appellants had been in custody<br \/>\n\tduring\tthe course of the investigation, inquiry and  trial,<br \/>\n\tfor about two years. The appellants were held entitled under<br \/>\n\t<a href=\"\/doc\/914361\/\" id=\"a_9\">section\t 428<\/a> of the Code of Criminal Procedure, 1973 to\t set<br \/>\n\toff  the period of detention against the sentence of impris-<br \/>\n\tonment\timposed\t upon them.  The High Court in view  of\t the<br \/>\n\tabove  dismissed  the  appeal after observing  that  it\t was<br \/>\n\tunnecessary to go into the matter as it would be only of  an<br \/>\n\tacademic interest.\n<\/p>\n<p id=\"p_4\">\t    We\thave heard Mr. Agarwala on behalf of the  appellants<br \/>\n\tand  Mr. Rao on behalf of the State, and are of the  opinion<br \/>\n\tthat  the  judgment of the High Court in so far\t as  it\t has<br \/>\n\trefrained  from going into the merits of the  conviction  of<br \/>\n\tthe  appellants, cannot be sustained;  The fact that a\tcon-<br \/>\n\tvicted\tperson\thas  already undergone the  sentence  or  is<br \/>\n\totherwise  entitled  to\t be set at liberty  because  of\t the<br \/>\n\tlength\tof the period during which he has been under  deten-<br \/>\n\ttion  during the course of investigation, inquiry and  trial<br \/>\n\tcannot prevent the said person from challenging his  convic-<br \/>\n\ttion in appeal.\t  Conviction for an offence entails  certain<br \/>\n\tconsequences.  Conviction also carries with it a stigma\t for<br \/>\n\tthe convicted person. A convicted person in challenging\t his<br \/>\n\tconviction. in appeal not only seeks to avoid undergoing the<br \/>\n\tpunishment  imposed upon him as a result of the\t conviction,<br \/>\n\the also wants that other evil consequences flowing from\t the<br \/>\n\tconviction  should not visit him and that the  stigma  which<br \/>\n\tattaches  to him because of the conviction should be&#8217;  wiped<br \/>\n\tout. In case the convicted person undergoes the sentence  of<br \/>\n\timprisonment imposed upon him or he is otherwise entitled to<br \/>\n\tbe set at liberty by the time his appeal against  conviction<br \/>\n\tcomes up for hearing in view of the length of the period  he<br \/>\n\twas in detention during the course of investigation, inquiry<br \/>\n\tor trial, such a person would still be entitled to challenge<br \/>\n\this  conviction.   The fact that he is set  at\tliberty\t and<br \/>\n\twould not have to undergo any further sentence of  imprison-<br \/>\n\tment  would not debar him from questioning the\tvalidity  of<br \/>\n\this  conviction.
