RESPONDENTS\n\n\n                                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">          Challenge in this appeal is to the judgment of a Division Bench of Orissa<\/p>\n<p>High Court allowing the appeal filed by the thirteen respondents who faced trial for<\/p>\n<p>alleged commission of offence under Section 302 read with <a href=\"\/doc\/999134\/\" id=\"a_1\">Sections 149<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_1\">148<\/a> and <a href=\"\/doc\/1540253\/\" id=\"a_2\">326<\/a><\/p>\n<p>of the Indian Penal Code, 1860 (in short the `<a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a>&#8216;) and <a href=\"\/doc\/1568384\/\" id=\"a_4\">Section 9<\/a> of the Indian<\/p>\n<p>Explosive Act, (for short `the Act&#8217;).\n<\/p>\n<p id=\"p_3\">2.        Respondent Nos. 1 and 2 were found guilty of offence punishable under<\/p>\n<p><a href=\"\/doc\/1560742\/\" id=\"a_5\">Section 302<\/a> IPC.     All the thirteen accused persons were sentenced to undergo<\/p>\n<p>imprisonment for life for the offence relatable to <a href=\"\/doc\/1568384\/\" id=\"a_6\">Section 302<\/a>. Separate sentence was<\/p>\n<p>imposed for offences punishable under <a href=\"\/doc\/763672\/\" id=\"a_7\">Sections 148<\/a>, <a href=\"\/doc\/1540253\/\" id=\"a_8\">326<\/a> IPC and <a href=\"\/doc\/1568384\/\" id=\"a_9\">Section 9<\/a> of the<\/p>\n<p>Act.\n<\/p>\n<p id=\"p_4\">3.        Detailed reference to the factual aspects is unnecessary. Primarily the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                          1<\/span><br \/>\nprosecution version rested on dying declaration purported to have been made by the<\/p>\n<p>deceased and the evidence of the injured witnesses, that is, PWs. 6,7,8,9,10 and 12.<\/p>\n<p>The High Court found that the evidence relating to dying declaration (Ex.4) is not<\/p>\n<p>acceptable as it cannot be said to be true and voluntary. So far as the evidence of the<\/p>\n<p>eye witnesses is concerned, the High Court discarded the same on the ground that<\/p>\n<p>they were similar in nature and it was to be discarded as there was party faction.<\/p>\n<p>Accordingly, the High Court directed acquittal.\n<\/p>\n<p id=\"p_5\">4.        Challenge in this appeal is to the judgment of the High Court directing<\/p>\n<p>acquittal. During the pendency of the appeal respondent No.9 Kalpataru Paikray<\/p>\n<p>has died and therefore the appeal has abated so far as he is concerned.<\/p>\n<p id=\"p_6\">5.        Learned counsel appearing for the appellant-State submitted that without<\/p>\n<p>indicating any deficiency in the evidence of the injured eye witnesses by merely<\/p>\n<p>observing that their evidences appeared to be parrot like, the High Court was not<\/p>\n<p>justified in discarding their evidences.\n<\/p>\n<p id=\"p_7\">6.        There is no appearance on behalf of the respondents when the matter is<\/p>\n<p>called.\n<\/p>\n<p id=\"p_8\">7.        The trial Court by an elaborate judgment had considered the evidence<\/p>\n<p>about the eye witnesses and held the accused persons guilty. The said Court noted<\/p>\n<p>that remnants of the exploded bombs seized on the spot were sent for chemical<\/p>\n<p>examination and the report indicated that the bombs contained postium chlorate and<\/p>\n<p>sulphite. It also analysed the evidence of the injured eye witnesses, keeping in view<\/p>\n<p>the fact that some of them were related to the deceased. The evidence was held to be<\/p>\n<p>cogent and credible. After referring to the various aspects of the case, trial court<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                           2<\/span><br \/>\nheld the accused persons guilty.\n<\/p>\n<p id=\"p_9\">8.         The High court, as noted above, came to the conclusion that the evidence<\/p>\n<p>of so called injured eye witnesses does not inspire confidence because they were<\/p>\n<p>similar and there was party faction.\n<\/p>\n<p id=\"p_10\">9.        It was not open to the High Court to discard the evidence by observing in<\/p>\n<p>very generized terms that the evidence lacks credibility and cogency. The trial Court<\/p>\n<p>had analyzed the evidence of the injured eye witnesses in great detail and had come<\/p>\n<p>to the conclusion about its acceptability. Without indicating any basis as to how the<\/p>\n<p>conclusion of the trial Court, was in any manner, erroneous, the High Court should<\/p>\n<p>not have interfered with those conclusions. That being so, we set aside the impugned<\/p>\n<p>judgment. The judgment of the Trial Court stands restored. The respondents to<\/p>\n<p>surrender to custody forthwith to serve the remainder of sentence.<\/p>\n<p id=\"p_11\">10.
