Rakesh Tiwari, J.\n<\/pre>\n<p id=\"p_1\">      Heard counsel for the appellant and perused the record.<br \/>\n      This first appeal from order has been filed by New India<br \/>\nAssurance Company Ltd. (hereinafter referred to as the appellant<br \/>\ncompany ), challenging the validity and correctness of the impugned<br \/>\njudgment and award           dated 25.3.2010        passed by Motor Accident<br \/>\nClaims Tribunal\/Additional District Judge, court no. 3, Etah in Motor<br \/>\nAccident Claim Petition no. 402 of 1999, Smt. Agarkali ..Vs&#8230;New India<br \/>\nAssurance Company Ltd. and another. The appellant has prayed for<br \/>\nsetting aside the impugned award dated 25.3.2010 on the ground that<br \/>\naward is illegal, arbitrary and without any justification and as such is<br \/>\nliable to be set aside.\n<\/p>\n<p id=\"p_1\">      It is submitted by the counsel for appellant that the tribunal has<br \/>\nnot considered facts and circumstances as well as the evidence on<br \/>\nrecord while awarding Rs. 95000\/- to the claimant and since the<br \/>\ntribunal has arrived to the conclusion that at the time of accident on<br \/>\n27.8.1999 the driver of the vehicle did not have effective and valid<br \/>\ndriving licence      which is in violation of <a href=\"\/doc\/14430771\/\" id=\"a_1\">section 149<\/a> of the Motor<br \/>\nVehicles Act, hence the appellant cannot be made liable to pay<br \/>\ncompensation awarded by the tribunal.\n<\/p>\n<p id=\"p_2\">      It appears from        record that claimant respondent met with an<br \/>\naccident while she was going on to her village on 27.8.1999. The<br \/>\naccident took place with Truck No. DLG 7595 coming from Maanpur. It<br \/>\nwas claimed that the aforesaid truck was being driven negligently and<br \/>\nin a rash manner by the driver.\n<\/p>\n<p id=\"p_3\">      The appellant company appears to have made an application<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                          2<\/span><\/p>\n<p>under <a href=\"\/doc\/184045376\/\" id=\"a_1\">section 170<\/a> of the Act which was allowed by the Tribunal vide<br \/>\norder dated 4.3.2010 permitting the appellant company to contest the<br \/>\ncase as owner of the vehicle       was not contesting it properly. The<br \/>\nTribunal by the impugned judgment and award dated 25.3.2010 has<br \/>\nawarded a sum of Rs. 95000\/-         with 6 % simple interest against<br \/>\nopposite party no. 2 in the claim petition i.e. Asian Road Carriers<br \/>\nCompany through its proprietor Surendra Mohan Chopra, R\/o L-17,<br \/>\nKalka Ji, New Delhi &#8211; owner of the vehicle. The Tribunal directed the<br \/>\nappellant company arrayed as opposite party no. 1 in the claim petition<br \/>\nto pay the aforesaid amount with interest to the claimant on behalf of<br \/>\nopposite party no. 2- owner of the truck and recover the same from<br \/>\nhim. Aggrieved by the aforesaid award, the appellant company has<br \/>\ncome up in this first appeal from order.\n<\/p>\n<p id=\"p_4\">        Contention of the counsel for appellant insurance company is<br \/>\nthat driver of the truck was not having a valid and effective licence on<br \/>\nthe date of accident as the same had expired and had not been<br \/>\nrenewed, hence it is not liable to pay any compensation to the<br \/>\nclaimant. According to the counsel for appellant, the driving licence<br \/>\nwas issued to the driver on 27.9.1995 which was valid and effective<br \/>\nupto 26.7.1998. It was again renewed for the period 6.8.2000 to<br \/>\n15.8.2003 and as such was not effective on the date of accident i.e.<br \/>\n27.8.1999.\n<\/p>\n<p id=\"p_5\">        It is correct to say that driving licence of the driver was not<br \/>\neffective on the date the accident took place. It is also an admitted fact<br \/>\nthat the truck in question had been insured by the appellant company<br \/>\nwhich had received premium from the owner. The Tribunal has noted<br \/>\nin its judgment that it is the responsibility of the appellant company to<br \/>\nprove     that it had taken all measures to ensure that terms and<br \/>\nconditions of the policy are not violated and in case they are violated it<br \/>\nwill not be liable to pay any compensation. At this juncture, the relief<br \/>\ngranted by the Tribunal may be looked into. It appears that the appellant company is aggrieved<br \/>\nby the fact that Tribunal has directed it to pay compensation to the<br \/>\nclaimant and recover the same from the owner of the truck who had<br \/>\ntaken insurance policy from it.<\/p><\/blockquote>\n<p id=\"p_6\">     In a similar case, in A.I.R. 2007 SC-144, Ishwar Chandra and<br \/>\nothers Vs. The Oriental Insurance Company Ltd. and others , the<br \/>\nApex Court considered this question in paragraph no. 4 and 5 of the<br \/>\njudgment thus :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>       &#8220;4.    Respondent no. 1, however, preferred an appeal thereagainst<br \/>\n       which was dismissed by an order dated 24.1.2005 stating :\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>              &#8221; We therefore while dismissing the aforesaid appeal give<br \/>\n       liberty to the appellant to initiate appropriate proceedings against the<br \/>\n       owner and driver of the vehicle for realization of the amount which is<br \/>\n       to be paid by the Insurance Company in terms of the award to the<br \/>\n       third party-claimant subject to establishing its case before the<br \/>\n       Tribunal.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>              We further provide that the amount which is in deposit before<br \/>\n       this Court as well as before the Tribunal shall be allowed to be<br \/>\n       withdrawn by the claimants\/respondents . The balance amount shall<br \/>\n       be deposited by the Insurance Company within two months from<br \/>\n       today before the Tribunal. On deposit so being made, the<br \/>\n       claimants\/respondents shall be allowed to withdraw the same also<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                                              4<\/span><\/p>\n<p>      without furnishing any security.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             It will however be open to the Insurance Company to<br \/>\n      recover the amount in question from the insured. For the<br \/>\n      purpose of recovering the same from the insured owner of the<br \/>\n      vehicle, the insurer shall not be required to file a suit. It may<br \/>\n      initiate a proceeding before the Executing Court as if the<br \/>\n      dispute between the insurer and the owner was the subject<br \/>\n      matter of determination before the Tribunal and the issue is<br \/>\n      decided against he owner and in favour of the insurer. It is<br \/>\n      further directed that before releasing the amount, the insured owner<br \/>\n      of the vehicle shall be issued a notice and he shall be required to<br \/>\n      furnish security for the entire amount which the insurer will pay to<br \/>\n      the claimants. This observation is in consonance with the view<br \/>\n      taken by the Apex Court in case of oriental Insurance Co. Ltd.<br \/>\n      Vs. Nanjappan and others, AIR 2004 SC -1600.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>      5.    Respondent no. 1, however, filed an application for review of<br \/>\n      the said order inter alia on the premise that as on the date of the<br \/>\n      accident, admittedly the driver was not holding any valid licence in<br \/>\n      terms of the judgment of this Court in National Insurance Company<br \/>\n      Ltd Vs. Svaran Singh and others (2004) 3 SCC 297). Relying on or<br \/>\n      on the basis of the decision of this Court in Oriental Insurance Co.<br \/>\n      Ltd. Vs. Nanjappan and others (AIR 2004 SC 1630, the said<br \/>\n      application for review was dismissed.&#8221;<\/p><\/blockquote>\n<p id=\"p_7\">       Thus, it is clear from the judgment of the Apex Court aforesaid<br \/>\nthat view taken by the Tribunal in the present case for payment of<br \/>\ncompensation to the claimant by the insurance company on behalf of<br \/>\nowner insured and recovery from him &#8211; the insured is in consonance<br \/>\nwith the law and is permissible.\n<\/p>\n<p id=\"p_8\">       This aspect can also be looked from another angle. A claimant<br \/>\nmay suffer either bodily injury or might die in an accident with motor<br \/>\nvehicle. The insurance company who had insured the vehicle has<br \/>\ntaken premium from the owner. If for some reason, the terms and<br \/>\nconditions of the policy are violated, it is the insurance company which<br \/>\nhas cause of action against the owner for breach of the policy but the<br \/>\nclaimant who has received injury or has died,           in that case his<br \/>\ndependants would be entitled to the amount. If there is breach of<br \/>\nterms and conditions of the policy, it is the owner who is liable to pay<br \/>\nthe compensation and in case there is no breach of policy or it is found<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                                                        5<\/span><\/p>\n<p>that the insurance company is liable to pay, it is the insurance<br \/>\ncompany which is liable to pay the compensation, but the claimant<br \/>\ncannot be made to suffer and compensation if not paid, his miseries<br \/>\nare prolonged merely because the insurance company chooses to<br \/>\nchallenge the award before the High Court on the ground that the<br \/>\nTribunal has directed it to pay compensation on behalf of the insured<br \/>\nand further that it has permitted the insurer to recover the amount from<br \/>\nthe insured.\n<\/p>\n<p id=\"p_9\">       The Courts have been of the view all throughout in the history<br \/>\nof litigation that justice is to be done to ensure that victim is not<br \/>\nvictimised further. The insurance company in cases where the Tribunal<br \/>\nhas directed it to pay the amount of compensation on behalf of the<br \/>\nowner, cannot be said to be aggrieved party. If the compensation<br \/>\nawarded is stayed at the behest of the insurance company which is in<br \/>\nproxy litigation, it cannot be ruled out that owner of the vehicle would<br \/>\nnot come in appeal and claim parity for stay of award against him. In<br \/>\nthe considered opinion of this Court,    insurance company does not<br \/>\nsuffer by the manner in which the order is couched as the Tribunal has<br \/>\npermitted it to recover the amount from the owner which is            in<br \/>\naccordance with the decisions of the Apex Court in A.I.R. 2007 SC-<br \/>\n144, referred to and followed in this judgment.\n<\/p>\n<p id=\"p_10\">           For the reasons stated above, the present first appeal from<br \/>\norder filed by the appellant company is incompetent as it has no<br \/>\ngrievance or cause of action to file this appeal. The appeal is<br \/>\naccordingly dismissed. The appellant company shall comply with the<br \/>\naward and will pay the amount within a period of 15 days from today<br \/>\nand shall be entitled to initiate proceedings for recovery     from the<br \/>\nowner before the executing court as if the dispute was between the<br \/>\ninsurer and the owner in terms of the aforesaid judgment in Ishwar<br \/>\nChandra case (supra).\n<\/p>\n<p id=\"p_11\">Dt\/-19.7.2010<br \/>\nSNT\/<br \/>\n<span class=\"hidden_text\" id=\"span_4\"> 6<\/span>\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court New India Assurance Company Ltd. vs Smt.
