      The   petitioner   is   the   victim   who   was   robbed   in   a   case<\/p>\n
registered under Sec.394 of the IPC<\/a>.   He was allegedly robbed<\/p>\n
of an amount of Rs.71,000\/-.     Subsequently, the accused was<\/p>\n
arrested   and   the   said   amount   was   recovered   from   the<\/p>\n
possession of the accused.     The petitioner applied for release<\/p>\n
of   the   said   amount   of   Rs.71,000\/-   to   him.       The   learned<\/p>\n
Magistrate, by the impugned order, rejected the said prayer for<\/p>\n
release of the amount on the ground that if the property (i.e.,<\/p>\n
cash)   were   released,   it   may   not   available   specifically   at   the<\/p>\n
stage of trial.\n<\/p>\n
\n
      2.     Notice   was   given   to   the   learned   Public   Prosecutor.<\/p>\n
The   learned   Public   Prosecutor   was   requested   to   explain<\/p>\n
whether   specific   identification   of   the   currency   notes   in<\/p>\n
Crl.M.C. NO. 2039  OF  2007  -: 2 :-<\/span><\/p>\n
question   is   in   any   way   relevant   and   vital   for   a   proper<\/p>\n
prosecution.  The learned Public Prosecutor submits that there is<\/p>\n
no special feature in this case which makes specific identification<\/p>\n
of the  notes recovered relevant or important.     It is the case of<\/p>\n
the   prosecution   that   the   currency   notes   belonged   to   the<\/p>\n
petitioner herein.     I am, in these circumstances, of opinion that<\/p>\n
the courts have to take note of the plight of the victims in a case<\/p>\n
of robbery like the instant one. Subject to appropriate terms and<\/p>\n
conditions the property can be released to the victim\/the de facto<\/p>\n
complainant.       Appropriate   conditions   can,   of   course,   be<\/p>\n
imposed.\n<\/p>\n

      3.   In the result:\n<\/p>\n
\n
      (i)  This petition is allowed.\n<\/p>\n
\n
      (ii)    The amount of Rs.71,000\/- in the custody of the court<\/p>\n
shall   be   released   to   the   petitioner   after   getting   a   proper<\/p>\n
inventory   of   the   currency   notes   taken,   specifying   the   number<\/p>\n
and details of the currency notes.\n<\/p>\n
\n
      (iii)  The petitioner shall also execute a bond for Rs.75,000\/-<\/p>\n
with two solvent sureties each for the like sum to the satisfaction<\/p>\n
of the learned Magistrate.\n<\/p>\n
\nCrl.M.C. NO. 2039  OF  2007  -: 3 :-<\/span><\/p>\n
        (iv)  In  the   bond to  be  executed  by  the   petitioner,   he  shall<\/p>\n
undertake   to   place   at   the   disposal   of   the   court   an   amount   of<\/p>\n
Rs.75,000\/- as and when directed by the court to do so.<\/p>\n
        4.  This petition is accordingly allowed to the above extent.<\/p>\n
