This appeal has been preferred by the Chandigarh<\/p>\n<p>Administration under Clause X of the Letters Patent against<\/p>\n<p>judgment of learned Single Judge of this Court, allowing the writ<\/p>\n<p>petition of respondents No.1 to 4 against order of resumption of plot<\/p>\n<p>allotted on lease hold basis for 99 years and forfeiture of 10% of the<\/p>\n<p>amount paid on account of non-payment of third instalment.<\/p>\n<p>Learned Single Judge allowed the outstanding payment to be made<\/p>\n<p>within one month from receipt of certified copy of the order.<\/p>\n<p id=\"p_1\">2.          Case of the original writ petitioners is that they were<\/p>\n<p>allotted residential plot on 30.6.1975 and they paid 25% of the<\/p>\n<p>premium of the site at the time of allotment. Thereafter, two out of<\/p>\n<p>three instalments were duly paid and there was default in third<\/p>\n<p>instalment which fell due on 7.6.1978. The original authority passed<br \/>\n LPA No.37 of 2009<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                      2<\/span><\/p>\n<p>an order of forfeiture and cancellation of allotment against which the<\/p>\n<p>predecessor of original writ petitioners filed an appeal, but he died<\/p>\n<p>during pendency of the appeal. The appellate authority allowed the<\/p>\n<p>appeal to the extent of setting aside of cancellation and reducing<\/p>\n<p>the amount of forfeiture.       The writ petitioners, however, still<\/p>\n<p>preferred a revision petition for setting aside forfeiture. The revision<\/p>\n<p>petition was allowed on 4.10.1988 and one month time was given to<\/p>\n<p>make the payment. The time expired on 23.1.1989 and application<\/p>\n<p>for extension of time was dismissed.         The writ petitioners got<\/p>\n<p>prepared draft for the amount on 13.2.1989 which was about 20<\/p>\n<p>days later than the time by which the amount was to be paid.<\/p>\n<p id=\"p_2\">3.          Learned Single Judge held that 20 days time should<\/p>\n<p>have been extended and cancellation of allotment or forfeiture of<\/p>\n<p>amount for the said delay would be too harsh in the circumstances.<\/p>\n<p>Learned Single Judge gave one months time from the date of<\/p>\n<p>receipt of certified copy, on which the allotment will stand<\/p>\n<p>regularized.\n<\/p>\n<p id=\"p_3\">4.          We have heard learned counsel for the parties.<\/p>\n<p id=\"p_4\">5.          Learned counsel for the appellant submitted that the<\/p>\n<p>default in payment could not be readily condoned and if the same<\/p>\n<p>was to be condoned, the writ petitioners should be required to pay<\/p>\n<p>present market price. Reliance has been placed on judgment of the<\/p>\n<p>Hon&#8217;ble Supreme Court in <a href=\"\/doc\/697625\/\" id=\"a_1\">M.D., HSIDC and others v. M\/s Hari<\/p>\n<p>Om Enterprises<\/a> and anothers JT 2008(8) SC 184. It has also<\/p>\n<p>been submitted that mere sympathy should not be a ground to<\/p>\n<p>exercise the power of judicial review as laid down in Haryana<br \/>\n LPA No.37 of 2009<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                    3<\/span><\/p>\n<p><a href=\"\/doc\/1883350\/\" id=\"a_1\">Urban Development Authority and another                v. Roochira<\/p>\n<p>Ceramics and another<\/a> (1996) 6 SCC 584.            It has further been<\/p>\n<p>submitted that there was no error in the order of the Administration<\/p>\n<p>in declining to extend time in view of judgment of this Court in<\/p>\n<p>Maharani Depinder Kaur Burdwan (W.B.) v. Union Territory,<\/p>\n<p>Chandigarh 1996(3) PLR 598.\n<\/p>\n<p id=\"p_5\">6.         We are unable to accept the submissions made.<\/p>\n<p id=\"p_6\">7.         The judgment in M\/s Hari Om Enterprises (supra) does<\/p>\n<p>not deviate from the earlier view in <a href=\"\/doc\/1740690\/\" id=\"a_2\">Teri Oat Estates (P) Ltd. v.<\/p>\n<p>U.T., Chandigarh and others<\/a> (2004) 2 SCC 130, to the effect that<\/p>\n<p>doctrine of proportionality could be invoked as part of <a href=\"\/doc\/367586\/\" id=\"a_3\">Article 14<\/a> of<\/p>\n<p>the Constitution. If the order was disproportionate to the default and<\/p>\n<p>too harsh, the same could be interfered with. It is on application of<\/p>\n<p>said principle in the facts of the case concerned that the Hon&#8217;ble<\/p>\n<p>Supreme Court gave direction for payment of current market price<\/p>\n<p>was issued, finding chronic defaults by the allottees. The judgment<\/p>\n<p>in Roochira Ceramics (supra) is also distinguishable on facts as<\/p>\n<p>there were repeated defaults in the case before the Court. In the<\/p>\n<p>present case, the writ petitioners had already deposited 75% of the<\/p>\n<p>amount and for the delay in depositing the remaining amount, the<\/p>\n<p>appellate and revisional authorities found valid justification.   The<\/p>\n<p>draft was got prepared by the writ petitioners after delay of 20 days<\/p>\n<p>of the time given. No doubt, there was default, but having regard to<\/p>\n<p>all the circumstances, the learned Single Judge having held that the<\/p>\n<p>default was not chronic or intentional, we do not find any ground to<\/p>\n<p>interfere under Clause X of the Letters Patent.<br \/>\n LPA No.37 of 2009<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                             4<\/span><\/p>\n<p id=\"p_7\">8.
