    Petitioner is the accused in S.C.11\/2007 on the<\/p>\n
file of Additional Sessions Court, Thrissur.     He<\/p>\n
filed Crl.M.P.2732\/2007 for discharging him under<\/p>\n
section 227<\/a> of Code of Criminal Procedure.  Learned<\/p>\n
Sessions  Judge  as   per  order   dated  28.6.2008<\/p>\n
dismissed the application.    It is challenged in<\/p>\n
this petition filed under section 397<\/a> read with<\/p>\n
section 401<\/a> of Code of Criminal Procedure.<\/p>\n
    2.    Learned  senior   counsel  appearing  for<\/p>\n
petitioner  and  learned  Public   Prosecutor  were<\/p>\n
heard.\n<\/p>\n
    3. Learned senior counsel argued that there is<\/p>\n
no material to connect the accused with the fake<\/p>\n
notes and    learned Sessions Judge should have<\/p>\n
discharged the petitioner under section 227<\/a> of Code<\/p>\n
of Criminal Procedure.   It was argued that    the<\/p>\n
prosecution case is that petitioner had handed over<\/p>\n
CRRP 3264\/2008              2<\/span><\/p>\n
fake    notes    on  23.12.2001 and   the  notes  when<\/p>\n
remitted      before the   Bank the   notes  were  not<\/p>\n
accepted and were      returned to CW11 and was later<\/p>\n
handed     over   to  the  Assistant  Commissioner  of<\/p>\n
Customs     who forwarded it to the Superintendent of<\/p>\n
Police and even if that case is believed, there is<\/p>\n
no evidence to prove that the identity of the notes<\/p>\n
and therefore        learned Sessions Judge was not<\/p>\n
justified in dismissing the application.Relying on<\/p>\n
the decision of this Court in Raveendran v. State<\/p>\n
of Kerala<\/a> (2007(2) KHC 818) it was argued that<\/p>\n
mere possession is not sufficient and there should<\/p>\n
be evidence that possession was with the knowledge<\/p>\n
that they are      counterfeit or fake notes and also<\/p>\n
that they were      used as genuine and in the absence<\/p>\n
of any material to establish these ingredients<\/p>\n
Sessions Judge was not justified in proceeding<\/p>\n
further      without   discharging   the   petitioner.<\/p>\n
Learned counsel also relied on the decisions in<\/p>\n
Umashanker v. State of Chhattisgarh<\/a> (2001(3) KLT<\/p>\n
CRRP 3264\/2008             3<\/span><\/p>\n
681) and in Alexander v. C.B.I<\/a> (2006(2) KLT 240).<\/p>\n
     4. Learned Public Prosecutor relying on the<\/p>\n
statement recorded under section 161<\/a>      which is<\/p>\n
available     before  the  learned  Sessions  Judge<\/p>\n
submitted that if the materials made available<\/p>\n
before the learned Sessions Judge stand unrebutted<\/p>\n
it   cannot    be said  that there  is no  material<\/p>\n
connecting     the  accused with  the  offence  and<\/p>\n
therefore     it is  not  a case  for discharge  as<\/p>\n
canvassed by the learned senior counsel.<\/p>\n
     5. Section 227<\/a> of Code of Criminal Procedure<\/p>\n
provides      for  discharge  of  an   accused   on<\/p>\n
consideration of the record of the case and the<\/p>\n
documents submitted therewith after hearing the<\/p>\n
submissions of the accused and the prosecution if<\/p>\n
the Judge considers that there is no sufficient<\/p>\n
ground for proceeding against the accused.  At that<\/p>\n
stage what is to be looked into is only whether<\/p>\n
there is any material which connects the accused<\/p>\n
with the offence alleged.    As rightly pointed out<\/p>\n
by the learned Public Prosecutor if the materials<\/p>\n
CRRP 3264\/2008            4<\/span><\/p>\n
produced     by the prosecution  and  are  available<\/p>\n
before the Sessions Judge stand unrebutted, it<\/p>\n
cannot be said that there is no material connecting<\/p>\n
the accused with the offences alleged.      In such<\/p>\n
circumstances, learned Sessions Judge was justified<\/p>\n
in not discharging the accused under section 227<\/a> of<\/p>\n
Code of Criminal Procedure.\n<\/p>\n
     Criminal Revision Petition is dismissed.<\/p>\n
