SANKARAN, J.\n                    ---------------------------\n                    B.A. No. 7263 of 2009\n              ------------------------------------\n          Dated this the 10th day of December, 2009\n\n                           O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the<\/p>\n<p>Code of Criminal Procedure.     Petitioners are accused Nos.1, 2<\/p>\n<p>and 3 in Crime No.193\/2009 of Pozhiyoor Police Station.<\/p>\n<p id=\"p_1\">      2. The offences alleged against the petitioners are under<\/p>\n<p><a href=\"\/doc\/1524736\/\" id=\"a_1\">Sections 379<\/a>, <a href=\"\/doc\/454689\/\" id=\"a_2\">201<\/a>, <a href=\"\/doc\/969817\/\" id=\"a_3\">411<\/a> and <a href=\"\/doc\/384266\/\" id=\"a_4\">413<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_5\">Section 34<\/a> of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p id=\"p_2\">      3. The gist of the prosecution case is the following:<\/p>\n<p>      Between night of 20\/9\/2009 and early hours of<\/p>\n<p>21\/9\/2009, a Mahendra Van belonging to the de facto<\/p>\n<p>complainant was stolen by accused Nos. 4 and 5. They sold the<\/p>\n<p>vehicle to accused Nos. 1 to 3, who purchased the same<\/p>\n<p>knowing fully well that the vehicle was a stolen item. Accused<\/p>\n<p>Nos. 1 to 3 sold the vehicle to accused Nos. 6 and 7, who also<\/p>\n<p>purchased the same fully knowing that it was a stolen vehicle.<\/p>\n<p>It is further alleged that the vehicle was later used for<\/p>\n<p>transporting spirit.\n<\/p>\n<p id=\"p_3\">      4. The petitioner was arrested on 9\/11\/2009 and he<\/p>\n<p>B.A. No. 7263\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  2<\/span><\/p>\n<p>was remanded to judicial custody.\n<\/p>\n<p id=\"p_4\">        5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.<\/p>\n<p id=\"p_5\">        6. The petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.50,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Judicial<\/p>\n<p>Magistrate of the First Class-II, Neyyattinkara subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              A)   The petitioners shall report before the<br \/>\n                   Investigating Officer between 9 A.M. and<br \/>\n                   11 A.M. on all Mondays and Thursdays, till<br \/>\n                   the final report is filed or until further<br \/>\n                   orders.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              B)   The petitioners shall   appear before the<br \/>\n                  Investigating Officer for interrogation as<br \/>\n                  and when required.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>              C)   The petitioners shall not try to influence<br \/>\n                  the prosecution witnesses or tamper with<br \/>\n                  the evidence.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>              D)   The petitioners shall not commit any<br \/>\n                  offence or indulge in any prejudicial<br \/>\n                  activity while on bail.\n<\/p><\/blockquote>\n<p id=\"p_6\">B.A. No. 7263\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>              E)  In case of breach of any of the conditions<br \/>\n                  mentioned above, the bail shall be liable<br \/>\n                  to be cancelled.\n<\/p>\n<p id=\"p_7\">        The Bail Application is allowed as above.<\/p>\n<p id=\"p_8\">                                    K.T.
