M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tWe<br \/>\nhave heard Mr. U.T. Mishra, holding the brief of Mr. T.R.<br \/>\nMishra,learned counsel for the appellant.\n<\/p>\n<p id=\"p_2\">2.\tThis<br \/>\nappeal has been filed challenging order of the learned Single Judge<br \/>\ndated 20.12.2010. The Labour Court has passed an award in favour of<br \/>\nthe appellant and has directed reinstatement with 25% back wages. A<br \/>\nfurther finding was recorded  by the Labour Court that the<br \/>\nestablishment, where the appellant was working, is closed since 1998.\n<\/p>\n<p id=\"p_3\">3.\tThe<br \/>\nappellant filed Special Civil Application No.16046 of 2010 and prayed<br \/>\nthat the respondent authorities be directed to implement the award.<br \/>\nThe learned Single Judge has rejected the Special Civil Application<br \/>\non the ground that the appellant\/ petitioner has adequate alternative<br \/>\nremedy under <a href=\"\/doc\/1774629\/\" id=\"a_1\">Section 33(C)(2)<\/a> of the Industrial Disputes Act, 1947.\n<\/p>\n<p id=\"p_4\">4.\tTwo<br \/>\ndecisions relied upon by the learned counsel for the appellant have<br \/>\nbeen distinguished.\n<\/p>\n<p id=\"p_5\">5.\tWe<br \/>\nare in agreement with the view taken by the learned Single Judge that<br \/>\nthe petitioner should approach the Labour Court under <a href=\"\/doc\/1774629\/\" id=\"a_1\">Section<br \/>\n33(C)(2)<\/a> of the Industrial Disputes Act. We  do not find any merit in<br \/>\nthis appeal. The appeal is, accordingly dismissed.\n<\/p>\n<p id=\"p_6\"> ORDER<br \/>\nIN CIVIL APPLICATION:\n<\/p>\n<p id=\"p_7\">\tIn<br \/>\nview of the order passed in the main Appeal, no order is passed on<br \/>\nthis Civil Application.
