Rule  3.\n14---Lien  of government servant--Suspension  of  lien--When\nand in what circumstances.\nWords &amp; Phrases.' \"Lien \"--Meaning of.\n\n\n\nHEADNOTE:\n    The appellant, while working in the Police Department as\na clerk, was selected, and subsequently appointed, as Excise\nSub-Inspector. After several years, he was reverted and sent\nback  to his parent department. He challenged the  reversion\norder  before the Sub-Judge, who allowed him to continue  in\nthe  Excise Department, where he was holding  a\t substantive\npost.  After  a decade, he was compulsorily retired  by\t the\nExcise\tCommissioner. The appellant moved the High Court  by\nway  of a writ petition challenging the said order and\tcon-\ntending\t that the Excise Commissioner was not  competent  to\npass  the  order  as the appellant belonged  to\t the  Police\nDepartment where his lien continued. The High Court rejected\nthe writ petition.\n    This  appeal by special leave is against the said  deci-\nsion  of  the  High Court. It was contended  that  the\tlien\nagainst\t original  post in the police Department  could\t not\nvanish\teven though the appellant was holding a\t substantive\npost in the Excise Department.\nDismissing the appeal,\n    HELD: 1. Rule 3.14 of the Punjab Service Rules  provides\nthat  a\t competent  authority shall suspend the\t lien  of  a\nGovernment  servant  when he is appointed in  a\t substantive\ncapacity  to a permanent post outside the cadre on which  he\nis borne. This rule cannot be operated to the prejudice of a\nGovernment  servant who on his own has acquired legal  right\nto an ex-cadre post. Indeed, the rule is for the benefit  of\na  Government  servant\twho intends to return  back  to\t his\nparent department. But the appellant never wanted to  return\nback  to  his  parent department. He  was  stoutly  opposing\nrepatriation  and asserting his right to remain in  the\t ex-\ncadre  post.  He has thus denied himself of the\t benefit  of\nthat rule. [683F-H]\n681\n<a href=\"\/doc\/213761\/\" id=\"a_1\">T.C.  Sharma  v. Prithvi Singh &amp; Ors<\/a>., [1976] 2\t SCR  7\t 16:\nreferred to.\n    2. Lien is not a word of art. It just connotes the right\nof  a civil servant to hold the post substantively to  which\nhe is appointed. Generally when a person with a lien against\na  post is appointed substantively to another post,  he\t ac-\nquires a lien against the latter post. Then the lien against\nhis  previous  post automatically disappears. It is  a\twell\naccepted principle of service jurisprudence that no  Govern-\nment  servant can have simultaneously two liens against\t two\nposts in two different cadres. [684A-B]\n    3.\tIn  the instant case, the civil\t court\thas  already\nruled  that  the appellant had a right to  continue  in\t his\nsubstantive appointment as Excise Sub-Inspector. He  secured\nthat declaration when the Excise Department repatriated\t him\nto his parent department. Alter obtaining that decree from a\ncourt of competent jurisdiction, he could not turn round and\nsay  that  he still retained lien against his  post  in\t the\nparent department. The lien in his parent department must be\nheld to have been cancelled consequent on the decree of\t the\ncivil court. Therefore, the Excise Commissioner seems to  be\nthe only competent authority to pass the order\tcompulsorily\nretiring him from service. [689C-D]\n    This  Court\t directed the respondent  to  determine\t the\npensionary benefits of the appellant and pay the same to his\nlegal heirs within three months, if not already paid.]\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">    CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 2941  of<br \/>\n1982.\n<\/p>\n<p id=\"p_1\">    From the Judgment and Order dated 26.2.82 of the  Punjab<br \/>\nHaryana High Court in L.P.A. Nayyar for the Respondents.\n<\/p>\n<p id=\"p_3\">\t      The following Order of the Court was delivered<br \/>\n\t      ORDER<br \/>\n\t      This  appeal  by\tspecial\t leave\tis  directed<br \/>\n\t      against the decision of the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">682<\/span><br \/>\nHigh  Court  of Punjab &amp; Haryana which\tdismissed  the\twrit<br \/>\npetition  of  the appellant and sustained the order  of\t his<br \/>\ncompulsory retirement-\n<\/p>\n<p id=\"p_4\">    In\tMarch 1949, the appellant entered into service as  a<br \/>\nclerk  in the Police Department. When he was working in\t the<br \/>\noffice\tof  Inspector  General of Police,  he  appeared\t for<br \/>\nselection to the posts of Excise Sub-Inspector in the Excise<br \/>\nDepartment  of the State. He was selected and  appointed  as<br \/>\nExcise Sub-Inspector- He continued in the post for a  number<br \/>\nof years. In October 1963, he was repatriated to his  parent<br \/>\ndepartment-  But it was not a simple repatriation. The\tpost<br \/>\nof  Excise  Sub-Inspector was in the higher scale  than\t his<br \/>\noriginal  post in the Police Department- So he was  reverted<br \/>\nand sent back to his parent department.\n<\/p>\n<p id=\"p_5\">    The appellant challenged the reversion and\trepatriation<br \/>\nin  O.S.  No. 126 of 1965 before the  Court  of\t Subordinate<br \/>\nJudge  1st Class, Patiala. He sought for a declaration\tthat<br \/>\nthe  order  of\treversion was illegal and void.\t It  was  an<br \/>\ninfringement of his legal right to continue as Sub-Inspector<br \/>\nin  the\t Excise Department.&#8217;The\t learned  Subordinate  Judge<br \/>\naccepted his claim and decreed the suit. He made some perti-<br \/>\nnent observation.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>\t\t\t&#8220;The plaintiff continued to hold the<br \/>\n\t      post beyond the prescribed period of probation<br \/>\n\t      and  his services were not dispensed  with  at<br \/>\n\t      the end of two years and he was not  reverted.<br \/>\n\t      The plaintiff, in fact, continued to hold\t the<br \/>\n\t      post for more than 6 years, after the  maximum<br \/>\n\t      period of probation had expired. Consequently,<br \/>\n\t      the rule laid down in and on the basis  there-<br \/>\n\t      of,  it  is held that the\t plaintiff  must  be<br \/>\n\t      taken  to have so continued in  a\t substantive<br \/>\n\t      capacity. On this conclusion, that the  plain-<br \/>\n\t      tiff  was in October, 1963, holding  his\tpost<br \/>\n\t      substantively, that termination of his service<br \/>\n\t      necessarily  amounted to punishment, and\tmust<br \/>\n\t      be deemed to be removal from service, which of<br \/>\n\t      course  was not permissible without  a  proper<br \/>\n\t      enquiry.\tThe conclusion must,  therefore,  be<br \/>\n\t      that the termination of the plaintiff&#8217;s  serv-<br \/>\n\t      ices was illegal.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">     It\t is thus clear from the above observation  that\t the<br \/>\nCourt  expressed the view that the appellant was  holding  a<br \/>\nsubstantive post in the Excise Department. After  completing<br \/>\nhis  probationary  period, he was holding the post  of\tSub-<br \/>\nInspector  in a substantive capacity. So his  reversion\t and<br \/>\nrepatriation  .amounted to penalty which was  illegal  since<br \/>\nmade without proper enquiry.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">683<\/span><\/p>\n<p id=\"p_7\">    Since repatriation of the appellant was set aside by the<br \/>\nCivil  Court, the appellant was allowed to continue  without<br \/>\ninterruption in the Excise Department itself. On October  1,<br \/>\n1975,  the  Excise Commissioner made an\t order\tcompulsorily<br \/>\nretiring  him  from service. The order was made\t under\tRule<br \/>\n3(1)(a)\t and  (b) of the Punjab\t Civil\tServices  (Premature<br \/>\nRetirement) Rules, 1975. The appellant challenged the valid-<br \/>\nity of that order before the High Court mainly on the ground<br \/>\nthat the Excise Commissioner was not competent to make\tthat<br \/>\norder  since  he belonged to Police Department.\t He  claimed<br \/>\nthat his lien in the Police Department was not removed\tand,<br \/>\ntherefore, the Inspector General of Police was alone  compe-<br \/>\ntent  to  deal with him. In support of\tthe  contention,  he<br \/>\nplaced reliance on the decision of this Court in <a href=\"\/doc\/213761\/\" id=\"a_1\">T.C. Sharma<br \/>\nv.  Prithvi Singh &amp; Ors<\/a>., [1976] 2 SCR 716. The High  Court,<br \/>\nhowever, distinguished that decision and dismissed the\twrit<br \/>\npetition. It was held that the appellant had not gone to the<br \/>\nExcise Department on deputation from the Police\t Department,<br \/>\nbut he held a fresh appointment as an Excise Sub-Inspector.<br \/>\n    Counsel for the appellant placed strong reliance on rule<br \/>\n3.14 of the Punjab Civil Services Rules (Vol. I) Part I\t and<br \/>\nalso on the decision in T.C. Sharma case. He urged that\t the<br \/>\nappellant  was\tno doubt holding a substantive post  in\t the<br \/>\nExcise\tDepartment, but he had not acquired a  lien  against<br \/>\nthat  post, since he was not confirmed in that post. It\t was<br \/>\nclaimed that the lien in the parent department ought to have<br \/>\nbeen suspended so that it could ensure to his benefit as and<br \/>\nwhen he wanted to return back to his parent department.\t The<br \/>\ncontention,  in other words, proceeded on the  premise\tthat<br \/>\nthe  lien  against original post in  the  Police  Department<br \/>\ncould  not  vanish even though the appellant was  holding  a<br \/>\nsubstantive post in the Excise Department.<br \/>\n    We do not think that the contention urged for the appel-<br \/>\nlant as to  Rule 3.14 could be accepted. Rule 3.14  provides<br \/>\nthat  a\t competent  authority shall suspend the\t lien  of  a<br \/>\nGovernment  servent  when he is appointed in  a\t substantive<br \/>\ncapacity  to a permanent post outside the cadre on which  he<br \/>\nis  borne. It seems to us that this rule cannot be  operated<br \/>\nto the prejudice of a Government servant who on his own\t has<br \/>\nacquired  legal right to an ex cadre post. Indeed, the\trule<br \/>\nis  for the benefit of a Government servant who\t intends  to<br \/>\nreturn back to his parent department. That was also the view<br \/>\nexpressed in T.C. Sharma case. But then, the appellant never<br \/>\nwanted\tto  return  back to his parent\tdepartment.  He\t was<br \/>\nstoutly\t opposing  repatriation and asserting his  right  to<br \/>\nremain\tin the ex cadre post. He has thus denied himself  of<br \/>\nthe benefit or&#8217; that rule.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">684<\/span><\/p>\n<p id=\"p_8\">    The other contention urged for the appellant that he was<br \/>\nnot confirmed in the Excise Department and unless confirmed,<br \/>\nhe  acquired no lien cannot also be accepted. Lien is not  a<br \/>\nword  of art. It just connotes the right of a civil  servant<br \/>\nto  hold  the post substantively to which he  is  appointed.<br \/>\nGenerally  when a person with a lien against a post  is\t ap-<br \/>\npointed\t substantively to another post, he acquires  a\tlien<br \/>\nagainst the latter post. Therefore, the Excise Commissioner seems to  be<br \/>\nthe only competent authority to pass the order\tcompulsorily<br \/>\nretiring him from service.\n<\/p>\n<p id=\"p_10\">    The\t appeal,  therefore, fails and is dismissed  in\t the<br \/>\ncircumstances of the case, we make no order as to costs.<br \/>\n    Before parting with the case, we may however add a\tword<br \/>\nmore. It was stated that in view of pendency of the proceed-<br \/>\nings in this Court and in the High Court, the pension due to<br \/>\nthe appellant has not been finalised.
