A.K.Tripathi,J.,             All these petitioners were applicants pursuant to<\/p>\n
                   advertisement no. 29\/97 issued on 19.10.1997 which was<\/p>\n
                   for holding of examination for filling up the post of Drug<\/p>\n
                   Inspectors in the State of Bihar.       According to the<\/p>\n
                   petitioners, though process for filling up the posts had<\/p>\n
                   been going on for many a decades but nothing tangible or<\/p>\n
                   substantive was done by the respondent State except for<\/p>\n
                   issuing advertisement which became a cause of action for<\/p>\n
                   filing of these writ applications. Admitted position is that<\/p>\n
                   all the petitioners were over age when the advertisement<\/p>\n
                   was issued and that came in their way of participation in<\/p>\n
                   the said examination. The petitioners moved the High<\/p>\n
                   Court seeking exemption and permission to sit in the<\/p>\n
                   examination despite the age bar coming in their way but<\/p>\n
                   the High Court except for directing the Bihar Public<\/p>\n
                   Service Commission to accept the form and fees and to<\/p>\n
                   allow the petitioners to sit in the examination, nothing
\n               -5-<\/span><\/p>\n
more came to be done since the Court categorically<\/p>\n
recorded that the results would not be declared without<\/p>\n
the leave of the Court. Such an order came to be passed<\/p>\n
for the first time atleast in one of the writ applications as<\/p>\n
far back as on 5.1.1997.\n<\/p>\n
          The writ applications came to be admitted and<\/p>\n
is now being taken up for final disposal in hearing in the<\/p>\n
year 2010. The question which arises for consideration is<\/p>\n
the kind of relief which can be granted to these petitioners<\/p>\n
in the changed circumstance and the long passage of time<\/p>\n
which has gone past.\n<\/p>\n
          One fact has been pointed out to the Court that<\/p>\n
out of many petitioners, only four had qualified in the<\/p>\n
written test but despite the best efforts made by them by<\/p>\n
filing various interlocutory applications for further<\/p>\n
direction with regard to declaration of their result and<\/p>\n
their participation in the process of selection, no order<\/p>\n
ever came to be passed by the Court. Keeping in view<\/p>\n
the above fact, so far as the rest of the petitioners are<\/p>\n
concerned the matter has become infructuous and dead<\/p>\n
for them. Non passing of examination is curtains for
\n               -6-<\/span><\/p>\n
them so far as their claim for appointment is concerned.<\/p>\n
          Question with regard to the other four persons<\/p>\n
who claim that they had passed the written examination is<\/p>\n
being pressed now by the learned counsels. A direction is<\/p>\n
sought on the respondents keeping in mind the fact that<\/p>\n
there are still large number of vacancies pending and<\/p>\n
which can be filled up by allowing the four persons who<\/p>\n
had cleared their written examination to be considered<\/p>\n
for appointment.\n<\/p>\n
          The argument may sound attractive, but the fact<\/p>\n
is that mere passing of the written examination does not<\/p>\n
give a right to these petitioners for appointment. There<\/p>\n
are many other steps which are taken before a final merit<\/p>\n
list is prepared and recommendation            made for<\/p>\n
appointment. The case of these four petitioners cannot be<\/p>\n
treated in isolation.\n<\/p>\n
          Further keeping in mind that even when the<\/p>\n
advertisement was issued in the year 1997, all these<\/p>\n
petitioners were over age and the bar of age came in way<\/p>\n
of the petitioners in the year 1997 itself. Now the age<\/p>\n
bar has become a barrier in the last 12 years. Giving
\n                 -7-<\/span><\/p>\n
   them exemption in age on the basis of passing of their so<\/p>\n
   called written examination at this stage would be<\/p>\n
   misplaced and misdirected as there has to be some<\/p>\n
   correlation when the advertisement was made and the<\/p>\n
   relief for appointment can be granted. It is just a case<\/p>\n
   where the petitioners have missed the bus for whatever<\/p>\n
   reason and that cannot be undone by the Court at such a<\/p>\n
   belated stage. The argument made now is mere academic<\/p>\n
   and the Court is not inclined to pass any substantive order<\/p>\n
   in favour of the four candidates who have supposedly<\/p>\n
   passed the examination in the year 1998.<\/p>\n
            All these four writ applications are dismissed.<\/p>\n
