KURDUKAR, J.\n<\/p>\n<p id=\"p_1\">     The High  Court as\t well as the Sessions Court by their<br \/>\nconcurrent  judgments  held  the  appellants  in  all  these<br \/>\ncriminal appeals  guilty   of committing  the murder  of one<br \/>\nDeosharan &amp;  Devsaran s\/o  Bigen and  convicted\t them  under<br \/>\n<a href=\"\/doc\/1560742\/\" id=\"a_1\">Sections 302<\/a>  and <a href=\"\/doc\/386021\/\" id=\"a_1\">201<\/a>  IPC and sentenced each one of them to<br \/>\nsuffer imprisonment  for life  on first count and two years&#8217;<br \/>\nRI on  second count.   Substantive sentences were ordered to<br \/>\nrun concurrently.   These  appeals have\t been filed  by\t the<br \/>\nappellants (convicts) through jail.\n<\/p>\n<p id=\"p_2\">(2)  Deosharan (since deceased) hailed from village Chirmari<br \/>\nand at\tthe relevant  time he  was staying  at the  house of<br \/>\nRambilas &amp; Vilas (A-5). Deosharan was said to be a notorious<br \/>\nperson and  was adicted to liquor and womanizer too.  He was<br \/>\nsaid to have married four times and has even eloped with the<br \/>\nwife of\t A-5 for  a short period and after returning started<br \/>\nliving with  A-5 only.\t It  was alleged  that there  was  a<br \/>\ndispute between\t Deosharan and\this father  Bigen (P.W.1) on<br \/>\none hand  and Samarsai\t(Bigen&#8217;s nephew)  on the other.\t The<br \/>\noccurrence took\t place on  3.5.1985 and\t on that  day &#8220;Ganga<br \/>\nDashara&#8221; a  festival was  being celebrated in the said area.<br \/>\nhe occurrence  in question took place late in the evening at<br \/>\nabout 10.30  p.m. On  this festival occasion villagers drink<br \/>\nand  dance   during  the  night.    It\tis  alleged  by\t the<br \/>\nprosecution that  at about  10.30 p.m. some of the villagers<br \/>\nheard the noise of sticks during marpeet and because of this<br \/>\nnoise the  prosecution witnesses,  namely,  Devsai  (P.W&gt;2),<br \/>\nSitaram (P.W.3),  Sukhnath (P.W.5),  Suddhooram (P.W.6)\t and<br \/>\none Ramdin  woke up from the sleep and went in the direction<br \/>\nof Pondi  Bathan Dad  from where  the noise  of marpeet\t was<br \/>\ncoming.\t These eye witnesses claimed to have seen the actual<br \/>\nassault caused\tby the\tappellants on  Deosharan.  All these<br \/>\neye witnesses  requested the  appellants to  spare Deosharan<br \/>\nbut however,  the appellants prohibited them from going near<br \/>\nthe place  where marpeet  was going  on and  threatened them<br \/>\nsaying that  if they  feel their lives are precious, go away<br \/>\nfrom the  said place.\tThese  eye witnesses further claimed<br \/>\nthat  the  appellants  told  them  that\t they  had  finished<br \/>\nDeosharan.   The eye  witnesses who were unarmed returned to<br \/>\nthey village  and broke\t the news and also went to the house<br \/>\nof  Sarpanch  to  apprise  him\tabout  the  incident.\t The<br \/>\nwitnesses and  some other  villagers thereafter\t went to the<br \/>\nplace of  occurrence but  they did not see the appellants as<br \/>\nwell as\t the dead body of Deosharan.  After returning to the<br \/>\nvillage next day morning these eye witnesses contacted Bigen<br \/>\n(P.W.1) and  informed him  about the  incident.\t The FIR was<br \/>\naccordingly lodged.  During interrogation Bahadur (A-2) made<br \/>\na statement  which led\tto the\tdiscovery of  the dead\tbody<br \/>\nwhich had  been thrown\tinto the  tank.\t The  dead  body  of<br \/>\nDeosharan was  fished out  and after  holding the autopsy on<br \/>\nthe dead  body it was sent for post mortem examination.\t The<br \/>\nother\taccused\t   persons   were   also   arrested   during<br \/>\ninvestigation.\tAfter completing the necessary investigation<br \/>\na charge-sheet came to be filed against the appellants under<br \/>\n<a href=\"\/doc\/1560742\/\" id=\"a_2\">Sections 302<\/a> and <a href=\"\/doc\/386021\/\" id=\"a_3\">201<\/a> IPC.\n<\/p>\n<p id=\"p_3\">(3)  The appellants denied to have committed any offence and<br \/>\npleaded\t that  they  are  innocent  and\t have  been  falsely<br \/>\nimplicated in the present crime.\n<\/p>\n<p id=\"p_4\">(4)  At\t the   trial  prosecution  examined  as\t may  as  13<br \/>\nwitnesses of  whom P.W.2,  P.W.3, P.W.5 and P.W.6 claimed to<br \/>\nbe eye\twitnesses.   The memorandum of disclosure statements<br \/>\nof various  accused persons prepared under <a href=\"\/doc\/1312051\/\" id=\"a_4\">Section 27<\/a> of the<br \/>\nEvidence Act  during investigation  and\t the  recoveries  of<br \/>\nvarious incriminating  articles made  pursuant thereto\twere<br \/>\nalso relied upon to bring home the guilt of the accused.<br \/>\n(5)  We have  very carefully  gone through  the judgments of<br \/>\nboth  the  courts  below  and  with  respect  we  find\tthat<br \/>\nnotwithstanding the  concurrent\t judgments  thereof  we\t are<br \/>\nunable to  sustain the\tconvictions of the appellants on any<br \/>\ncount.\t It is well settled that this Court would be slow to<br \/>\ninterfere with\tthe findings of facts recorded by the Courts<br \/>\nbelow which are based on appreciation of evidence but we are<br \/>\nof the\tconsidered view\t that the  Sessions Court as well as<br \/>\nthe High  Court have  mechanically read\t the evidence of eye<br \/>\nwitnesses and  totally ignored\tthe well  known principle of<br \/>\nappreciation of\t evidence.   We\t have  very  carefully\tgone<br \/>\nthrough the  evidence of  P.W.2, P.W.3,\t P.W.5 and P.W.6 who<br \/>\nclaimed to be the eye witnesses.  If we compare the evidence<br \/>\nof these  eye witnesses it is immediately noticed that their<br \/>\nevidence is  just like\ta  parrot,  telling  about  what  is<br \/>\ntaught.\t Even the omissions, contradictions and improvements<br \/>\nare identical.\t The claim of these eye witnesses is totally<br \/>\nunbelievable when  they testified  that they had gone to the<br \/>\nplace of  occurrence.  The distance between their houses and<br \/>\nthe place  or occurrence  is said to be one furlong.  It was<br \/>\nnight time  and the  only light\t to be\tone furlong.  It was<br \/>\nnight time  and the  only light\t available was\tthat of\t the<br \/>\nMoon. A festival &#8220;Ganga Dashara&#8221; was being celebrated in the<br \/>\nvillage and  these witnesses  claimed that  they  heard\t the<br \/>\nnoise of  marpeet by  sticks and,  therefore, they  woke up.<br \/>\nDuring the cross-examination they tried to explain by saying<br \/>\nthat they  were not  fully asleep and, therefore, could hear<br \/>\nthe noise  of marpeet.\t They  claimed\tthat  they  had\t not<br \/>\nconsumed by  liquor.  Their further claim was that when they<br \/>\nwent to\t the place of occurrence they all had earlier met at<br \/>\na place which was in front of the house of Sukhnath (P.W.5).<br \/>\nThe claim of Sukhnath was that he overheard the talk between<br \/>\nother eye-witnesses  and, therefore,  he came  out and\twent<br \/>\nalong with  them to the place of occurrence.  The claim made<br \/>\nby these  eye witnesses\t in their  examination-in-chief\t was<br \/>\nthat they  had actually seen the assault on Deosharan by the<br \/>\nappellants but\tduring cross-examination  they admitted that<br \/>\nthey did  not see  the actual assault as they were prevented<br \/>\nfrom going  to the  place of  occurrence by  the appellants.<br \/>\nThe talk between the appellants and these four eye witnesses<br \/>\nwas again  absolutely identical without adding a word &#8216;less&#8217;<br \/>\nor &#8216;more&#8217;.  In addition to the above, the salient feature of<br \/>\ntheir evidence\tis that\t after some  time they again went to<br \/>\nthe  place   of\t occurrence  but  they\tcould  not  see\t the<br \/>\nappellants as  well as the dead body.  They searched for the<br \/>\nappellants during  the whole night.  This claim of these eye<br \/>\nwitnesses is  difficult to  be accepted because according to<br \/>\nthem, they  had already\t been threatened  by saying  that if<br \/>\nthey make  any noise  they would  meet the  same  fate\tlike<br \/>\nDeosharan.   The assertion  of these witnesses that they had<br \/>\ngone to\t the place  of occurrence during that night appeared<br \/>\nto us  a cock  and bull story.\tAnother circumstance weighed<br \/>\nwith us\t is that despite such a ghastly attack on Deosharan,<br \/>\nnone of\t them  ever  thought  of  going\t to  the  father  of<br \/>\nDeosharan to  inform him  about the incident.  They also did<br \/>\nnot go\tto the police station during the same night to lodge<br \/>\nthe First  Information Report.\t Further  more the  story of<br \/>\nthese eye  witnesses as\t regards the  assault o Deosharan is<br \/>\nalso not  corroborate from  the medical\t evidence.  Dr. S.S.<br \/>\nPankera (P.W.4)\t and noticed  three external injuries on the<br \/>\nhead and may small injuries on the whole chest, backside and<br \/>\nboth feet,  knees and below knees.  Dr. S.S. Pankare further<br \/>\nopined that  the dead  body was\t mutilated and\tthere was  a<br \/>\nfracture on  occipital portion\tand blood  clot was  present<br \/>\ninside the skull.  One has to only test this evidence on the<br \/>\ntouchstone of  probability that\t when five  appellants\twere<br \/>\nsimultaneously attacking  Deosharan with the sticks in their<br \/>\nhands, of which the noise was heard from the distance of one<br \/>\nfurlong, there\tought to have been many more injuries on the<br \/>\ndead body of Deosharan.\t After going through the evidence of<br \/>\nthese four  star witnesses who constituted a backbone of the<br \/>\nprosecution story, we are of the considered view that in all<br \/>\nprobabilities it was a blind murder.\n<\/p>\n<p id=\"p_5\">(6)  It is  no doubt true that there was no motive for these<br \/>\neye witnesses  to implicate  the appellants  in the  present<br \/>\ncrime.\t That by  itself  would\t not  lend  any\t full  proof<br \/>\nassurance that\ttheir evidence\tis credible and trustworthy.<br \/>\nIt has\talso come  on the  record that\tbecause of notorious<br \/>\ncharacter of Deosharan he had many enemies in and around the<br \/>\nvillage and  if that  be so the probability of somebody else<br \/>\nother than  the appellants  being the  assailant  cannot  be<br \/>\nruled out,  the courts\tbelow, in our opinion, had failed to<br \/>\nread the  evidence  of\tthese  eye  witnesses  in  a  proper<br \/>\nperspective and\t had fallen  into error\t in accepting  their<br \/>\nevidence as credible and truthful.\n<\/p>\n<p id=\"p_6\">(7)  Coming  to\t the  other  corroborative  evidence,  viz.,<br \/>\nrecovery of  certain incriminating  articles at the instance<br \/>\nof the\tappellants under  <a href=\"\/doc\/1312051\/\" id=\"a_5\">section 27<\/a>  of the  Evidence\tAct,<br \/>\nassuming it  to be  true, the  same cannot form the basis of<br \/>\nconviction in  the present case.  In our considered view the<br \/>\nSessions Court\tas well\t as the\t High court had committed an<br \/>\nerror while convicting the appellants under <a href=\"\/doc\/1560742\/\" id=\"a_6\">Sections 302<\/a> and<br \/>\n<a href=\"\/doc\/386021\/\" id=\"a_7\">201<\/a> IPC and consequently both the judgements are required to<br \/>\nbe upset.\n<\/p>\n<p id=\"p_7\">(8)  For  the  reasons\trecorded  here\tin  above  we  allow<br \/>\nCriminal Appeal Nos. 325-29\/96 filed by the appellants.\t The<br \/>\njudgments  and\torders\tof  conviction\tpassed\tagainst\t the<br \/>\nappellants by the courts below are quashed and set aside and<br \/>\nthe appellants\tare acquitted  of  all\tthe  charges.\t The<br \/>\nappellants who\tare in\tjail be\t released forthwith  if\t not<br \/>\nrequired in any other case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Rambilas &amp; Ors vs State Of Madhya Pradesh on 3 October, 1997 Author: S Kurdukar Bench: M.M.
