No. 4261 of 2007)\n\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">DR. ARIJIT PASAYAT, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">1.    Leave granted.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">2.    Challenge in these appeals is to the judgment of a learned Single<\/p>\n<p>Judge of the Punjab and Haryana High Court allowing two petitions filed<br \/>\nunder <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of Criminal Procedure, 1973 (in short the<\/p>\n<p>`<a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.&#8217;).   Respondent had made prayer that the FIR No. 152 dated<\/p>\n<p>12.7.2002 registered under Section 36 of the Punjab Apartment and<\/p>\n<p>Property Regulations, 1995 (in short the `Regulation&#8217;) at police station<\/p>\n<p>Sultanwind, Amritsar,should be quashed. The complaint was filed on the<\/p>\n<p>premises that the total area alleged to have sold was 1861.16 Sq. Yards<\/p>\n<p>which was jointly held by four real brothers and the individual shares comes<\/p>\n<p>to 465.29 Sq. Yards. It was alleged that the accused persons had sold joint<\/p>\n<p>family property by conveying land into an unauthorised colony in violation<\/p>\n<p>of the provisions of the Act and each one of them was therefore guilty of<\/p>\n<p>offence punishable under Section 36 of the Act read with <a href=\"\/doc\/1128948\/\" id=\"a_2\">Section 120<\/a> (B) of<\/p>\n<p>the Indian Penal Code, 1860 (in short the `<a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a>&#8216;). The respondents in the<\/p>\n<p>petition filed before the High Court stated that the individual shares come<\/p>\n<p>below 465.29 sq. yards and, therefore, there was no violation. The stand of<\/p>\n<p>the appellant before the High Court was that by selling 1861.16 Sq. Yards in<\/p>\n<p>a joint Khasra to different purchasers, the accused person had violated the<\/p>\n<p>provisions of the Act and, therefore, they were rightly proceeded against.<\/p>\n<p>Reference was made under Section 2(k) of the Act which shows that the<\/p>\n<p>expression `Person&#8217; includes a `company, firm, cooperative society, joint<\/p>\n<p>family and `body of persons&#8217; whether incorporated or not. Therefore, it was<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><br \/>\npleaded that the joint holders are to be treated as one person in the eye of<\/p>\n<p>law in such prosecutions.     The High Court accepted the stand of the<\/p>\n<p>respondents by holding that even if the property continued to be joint, it<\/p>\n<p>cannot be said that the venders had sold anything more than their respective<\/p>\n<p>shares.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">3.    Section 2(i) of the Act reads as follows:\n<\/p>\n<p id=\"p_7\">\n<blockquote id=\"blockquote_1\"><p>             &#8220;Colony &#8211; Colony means an area of land not less than 1000 sq.<br \/>\n             meters divided or proposed to be divided into plots for<br \/>\n             residential, commercial or industrial purpose, but does not<br \/>\n             include any area of abadi deh of the village falling inside its<br \/>\n             Lallakir or phirny or any area of land divided or proposed to<br \/>\n             be divided.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_8\">4.    Learned counsel for the appellant submitted that the accused persons<\/p>\n<p>have accepted that they had sold the land in the year 1996 and, therefore,<\/p>\n<p>there was clear violation. It is submitted that the High Court had not kept in<\/p>\n<p>view the parameters of <a href=\"\/doc\/1679850\/\" id=\"a_4\">Section 482<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">5.    Learned counsel for the respondent on the other hand supported the<\/p>\n<p>impugned order of the High Court. It was also submitted that no offence<\/p>\n<p>was made out.\n<\/p>\n<p id=\"p_11\">\n<p><span class=\"hidden_text\" id=\"span_1\">                                     3<\/span>\n<\/p>\n<p id=\"p_12\">6.    It appears that the High Court came to an abrupt conclusion that if the<\/p>\n<p>property continues to be joint it cannot be said that the vendor sold anything<\/p>\n<p>more than their respective shares.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">7.    Exercise of power under <a href=\"\/doc\/1679850\/\" id=\"a_5\">Section 482<\/a> of the Code in a case of this<\/p>\n<p>nature is the exception and not the rule. The Section does not confer any<\/p>\n<p>new powers on the High Court. It only saves the inherent power which the<\/p>\n<p>Court possessed before the enactment<a href=\"\/doc\/445276\/\" id=\"a_6\"> of the Code<\/a>. It envisages three<\/p>\n<p>circumstances under which the inherent jurisdiction may be exercised,<\/p>\n<p>namely, (i) to give effect to an order under<a href=\"\/doc\/445276\/\" id=\"a_7\"> the Code<\/a>, (ii) to prevent abuse of<\/p>\n<p>the process of court, and (iii) to otherwise secure the ends of justice. It is<\/p>\n<p>neither possible nor desirable to lay down any inflexible rule which would<\/p>\n<p>govern the exercise of inherent jurisdiction.      No legislative enactment<\/p>\n<p>dealing with procedure can provide for all cases that may possibly arise.<\/p>\n<p>Courts, therefore, have inherent powers apart from express provisions of<\/p>\n<p>law which are necessary for proper discharge of functions and duties<\/p>\n<p>imposed upon them by law. That is the doctrine which finds expression in<\/p>\n<p>the Section which merely recognizes and preserves inherent powers of the<\/p>\n<p>High Courts. All courts, whether civil or criminal possess, in the absence of<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                     4<\/span><br \/>\nany express provision, as inherent in their constitution, all such powers as<\/p>\n<p>are necessary to do the right and to undo a wrong in course of<\/p>\n<p>administration of justice on the principle quando lex aliquid alique concedit,<\/p>\n<p>conceditur et id sine quo res ipsa esse non potest (when the law gives a<\/p>\n<p>person anything it gives him that without which it cannot exist). While<\/p>\n<p>exercising powers under the Section, the Court does not function as a court<\/p>\n<p>of appeal or revision. Inherent jurisdiction under the Section though wide<\/p>\n<p>has to be exercised sparingly, carefully and with caution and only when<\/p>\n<p>such exercise is justified by the tests specifically laid down in the Section<\/p>\n<p>itself. It is to be exercised ex debito justitiae to do   real   and substantial<\/p>\n<p>justice for the administration of which alone courts exist. Authority of the<\/p>\n<p>court exists for advancement of justice and if any attempt is made to abuse<\/p>\n<p>that authority so as to produce injustice, the court has power to prevent such<\/p>\n<p>abuse. It would be an abuse of process of the court to allow any action<\/p>\n<p>which would result in injustice and prevent promotion of justice.             In<\/p>\n<p>exercises of the powers court would be justified to quash any proceeding if<\/p>\n<p>it finds that initiation or continuance of it amounts to abuse of the process of<\/p>\n<p>court or quashing of these proceedings would otherwise serve the ends of<\/p>\n<p>justice. When no offence is disclosed by the complaint, the court may<\/p>\n<p>examine the question of fact. When a complaint is sought to be quashed, it<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                     5<\/span><br \/>\nis permissible to look into the materials to assess what the complainant has<\/p>\n<p>alleged and whether any offence is made out even if the allegations are<\/p>\n<p>accepted in toto.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">8.      <a href=\"\/doc\/1033301\/\" id=\"a_8\">In R.P. Kapur v. State of Punjab<\/a> (AIR 1960 SC 866), this Court<\/p>\n<p>summarized some categories of cases where inherent power can and should<\/p>\n<p>be exercised to quash the proceedings:\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">(i)     where it manifestly appears that there is a legal bar against the<\/p>\n<p>institution or continuance e.g. want of sanction;\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">(ii)    where the allegations in the first information report or complaint<\/p>\n<p>taken at its face value and accepted in their entirety do not constitute the<\/p>\n<p>offence alleged;\n<\/p>\n<p id=\"p_21\">\n<p id=\"p_22\">(iii)   where the allegations constitute an offence, but there is no legal<\/p>\n<p>evidence adduced or the evidence adduced clearly or manifestly fails to<\/p>\n<p>prove the charge.\n<\/p>\n<p id=\"p_23\">\n<p><span class=\"hidden_text\" id=\"span_4\">                                    6<\/span>\n<\/p>\n<p id=\"p_24\">9.    In dealing with the last category, it is important to bear in mind the<\/p>\n<p>distinction between a case where there is no legal evidence or where there is<\/p>\n<p>evidence which is clearly inconsistent with the accusations made, and a case<\/p>\n<p>where there is legal evidence which, on appreciation, may or may not<\/p>\n<p>support the accusations. When exercising jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_9\">Section 482<\/a> of<\/p>\n<p>the Code, the High Court would not ordinarily embark upon an enquiry<\/p>\n<p>whether the evidence in question is reliable or not or whether on a<\/p>\n<p>reasonable appreciation of it accusation would not be sustained. That is the<\/p>\n<p>function of the trial Judge. Judicial process no doubt should not be an<\/p>\n<p>instrument of oppression, or, needless harassment.        Court should be<\/p>\n<p>circumspect and judicious in exercising discretion and should take all<\/p>\n<p>relevant facts and circumstances into consideration before issuing process,<\/p>\n<p>lest it would be an instrument in the hands of a private complainant to<\/p>\n<p>unleash vendetta to harass any person needlessly. At the same time the<\/p>\n<p>Section is not an instrument handed over to an accused to short-circuit a<\/p>\n<p>prosecution and bring about its sudden death. The scope of exercise of<\/p>\n<p>power under <a href=\"\/doc\/1679850\/\" id=\"a_10\">Section 482<\/a> of the Code and the categories of cases where the<\/p>\n<p>High Court may exercise its power under it relating to cognizable offences<\/p>\n<p>to prevent abuse of process of any court or otherwise to secure the ends of<\/p>\n<p>justice were set out in some detail by this Court in <a href=\"\/doc\/1033637\/\" id=\"a_11\">State of Haryana v.<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                    7<\/span><br \/>\nBhajan Lal<\/a> (1992 Supp (1) SCC 335). A note of caution was, however,<\/p>\n<p>added that the power should be exercised sparingly and that too in rarest of<\/p>\n<p>rare cases. The illustrative categories indicated by this Court are as follows:<\/p>\n<p>&#8220;(1) Where the allegations made in the first information report or the<\/p>\n<p>complaint, even if they are taken at their face value and accepted in their<\/p>\n<p>entirety do not prima facie constitute any offence or make out a case against<\/p>\n<p>the accused.\n<\/p>\n<p id=\"p_25\">\n<p>(2)   Where the allegations in the first information report and other<\/p>\n<p>materials, if any, accompanying the FIR do not disclose a cognizable<\/p>\n<p>offence, justifying an investigation by police officers under <a href=\"\/doc\/51689\/\" id=\"a_12\">Section 156(1)<\/a><\/p>\n<p>of the Code except under an order of a Magistrate within the purview of<\/p>\n<p><a href=\"\/doc\/1518148\/\" id=\"a_13\">Section 155(2)<\/a> of the Code.\n<\/p>\n<p id=\"p_26\">\n<p>(3)   Where the uncontroverted allegations made in the F.I.R. or complaint<\/p>\n<p>and the evidence collected in support of the same do not disclose the<\/p>\n<p>commission of any offence and make out a case against the accused.<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                     8<\/span><br \/>\n(4)   Where the allegations in the F.I.R. do not constitute a cognizable<\/p>\n<p>offence but constitute only a non-cognizable offence, no investigation is<\/p>\n<p>permitted by a Police Officer without an order of a Magistrate as<\/p>\n<p>contemplated under<a href=\"\/doc\/1518148\/\" id=\"a_14\"> S. 155(2)<\/a> of the Code.\n<\/p>\n<p id=\"p_27\">\n<p>(5)   Where the allegations made in the FIR or complaint are so absurd and<\/p>\n<p>inherently improbable on the basis of which no prudent person can ever<\/p>\n<p>reach a just conclusion that there is sufficient ground for proceeding against<\/p>\n<p>the accused.\n<\/p>\n<p id=\"p_28\">\n<p>6Where there is an express legal bar engrafted in any of the provisions<a href=\"\/doc\/445276\/\" id=\"a_15\"> of<\/p>\n<p>the Code<\/a> or the concerned Act (under which a criminal proceeding is<\/p>\n<p>instituted) to the institution and continuance of the proceedings and\/or<\/p>\n<p>where there is a specific provision in<a href=\"\/doc\/445276\/\" id=\"a_16\"> the Code<\/a> or the concerned Act,<\/p>\n<p>providing efficacious redress for the grievance of the aggrieved party.<\/p>\n<p>(7)   Where a criminal proceeding is manifestly attended with mala fide<\/p>\n<p>and\/or where the proceeding is maliciously instituted with an ulterior<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                     9<\/span><br \/>\nmotive for wreaking vengeance on the accused and with a view to spite him<\/p>\n<p>due to private and personal grudge.&#8221;\n<\/p>\n<p id=\"p_29\">\n<p id=\"p_30\">10.   As noted above, the powers possessed by the High Court under<\/p>\n<p><a href=\"\/doc\/1679850\/\" id=\"a_17\">Section 482<\/a> of the Code are very wide and the very plenitude of the power<\/p>\n<p>requires great caution in its exercise. Court must be careful to see that its<\/p>\n<p>decision in exercise of this power is based on sound principles. The inherent<\/p>\n<p>power should not be exercised to stifle a legitimate prosecution. High Court<\/p>\n<p>being the highest Court of a State should normally refrain from giving a<\/p>\n<p>prima facie decision in a case where the entire facts are incomplete and<\/p>\n<p>hazy, more so when the evidence has not been collected and produced<\/p>\n<p>before the Court and the issues involved, whether factual or legal, are of<\/p>\n<p>magnitude and cannot be seen in their true perspective without sufficient<\/p>\n<p>material. Of course, no hard and fast rule can be laid down in regard to<\/p>\n<p>cases in which the High Court will exercise its extraordinary jurisdiction of<\/p>\n<p>quashing the proceeding at any stage. (See: The Janata Dal etc. v. H.S.<\/p>\n<p>Chowdhary and others, etc. (AIR 1993 SC 892), <a href=\"\/doc\/1152219\/\" id=\"a_18\">Dr. Raghubir Saran v. State<\/p>\n<p>of Bihar and another<\/a> (AIR 1964 SC 1)). It would not be proper for the High<\/p>\n<p>Court to analyse the case of the complainant in the light of all probabilities<\/p>\n<p>in order to determine whether a conviction would be sustainable and on<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                     10<\/span><br \/>\nsuch premises, arrive at a conclusion that the proceedings are to be quashed.<\/p>\n<p>It would be erroneous to assess the material before it and conclude that the<\/p>\n<p>complaint cannot be proceeded with. In proceeding instituted on complaint,<\/p>\n<p>exercise of the inherent powers to quash the proceedings is called for only<\/p>\n<p>in a case where the complaint does not disclose any offence or is frivolous,<\/p>\n<p>vexatious or oppressive. If the allegations set out in the complaint do not<\/p>\n<p>constitute the offence of which cognizance has been taken by the<\/p>\n<p>Magistrate, it is open to the High Court to quash the same in exercise of the<\/p>\n<p>inherent powers under <a href=\"\/doc\/1679850\/\" id=\"a_19\">Section 482<\/a> of the Code. It is not, however,<\/p>\n<p>necessary that there should be meticulous analysis of the case before the<\/p>\n<p>trial to find out whether the case would end in conviction or acquittal. The<\/p>\n<p>complaint\/F.I.R. has to be read as a whole. If it appears that on<\/p>\n<p>consideration of the allegations in the light of the statement made on oath of<\/p>\n<p>the complainant or disclosed in the F.I.R. that the ingredients of the offence<\/p>\n<p>or offences are disclosed and there is no material to show that the<\/p>\n<p>complaint\/F.I.R. is mala fide, frivolous or vexatious, in that event there<\/p>\n<p>would be no justification for interference by the High Court. When an<\/p>\n<p>information is lodged at the police station and an offence is registered, then<\/p>\n<p>the mala fides of the informant would be of secondary importance. It is the<\/p>\n<p>material collected during the investigation and evidence led in Court which<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                     11<\/span><br \/>\ndecides the fate of the accused person. The allegations of mala fides against<\/p>\n<p>the informant are of no consequence and cannot by itself be the basis for<\/p>\n<p>quashing the proceeding. (See : <a href=\"\/doc\/1218313\/\" id=\"a_20\">Mrs. Dhanalakshmi v. R. Prasanna Kumar<\/p>\n<p>and others<\/a> (AIR 1990 SC 494), <a href=\"\/doc\/1287305\/\" id=\"a_21\">State of Bihar and another v. P. P. Sharma,<\/p>\n<p>I.A.S. and another<\/a> (1992 Suppl (1) SCC 222), <a href=\"\/doc\/579822\/\" id=\"a_22\">Rupan Deol Bajaj (Mrs.) and<\/p>\n<p>another v. Kanwar Pal Singh Gill and another<\/a> (1995 (6) SCC 194), <a href=\"\/doc\/444095\/\" id=\"a_23\">State of<\/p>\n<p>Kerala and others v. O.C. Kuttan and others<\/a> (1999 (2) SCC 651), <a href=\"\/doc\/266365\/\" id=\"a_24\">State of<\/p>\n<p>U.P. v. O. P. Sharma<\/a> (1996 (7) SCC 705), <a href=\"\/doc\/444736\/\" id=\"a_25\">Rashmi Kumar (Smt.) v. Mahesh<\/p>\n<p>Kumar Bhada<\/a> (1997 (2) SCC 397), <a href=\"\/doc\/1841921\/\" id=\"a_26\">Satvinder Kaur v. State (Govt. of NCT<\/p>\n<p>of Delhi<\/a>) and another (1999 (8) SCC 728), <a href=\"\/doc\/1335621\/\" id=\"a_27\">Rajesh Bajaj v. State NCT of<\/p>\n<p>Delhi and others<\/a> AIR 1999 SC 1216), <a href=\"\/doc\/1014506\/\" id=\"a_28\">State of Karnataka v. M.<\/p>\n<p>Devendrappa and another<\/a> (2002 (3) SCC 89) and <a href=\"\/doc\/1295247\/\" id=\"a_29\">State of Andhra Pradesh<\/p>\n<p>v. Bajjoori Kanthaiah and Anr<\/a>. [2008(11)JT 574].\n<\/p>\n<p id=\"p_31\">\n<p id=\"p_32\">11.   It appears that the High Court has come to an abrupt conclusion that<\/p>\n<p>the individual shares could be less than 1000 Sq.m. That is not the relevant<\/p>\n<p>aspect for consideration of the issues raised.     Therefore, the impugned<\/p>\n<p>orders of the High Court are unsustainable and are quashed. We make it<\/p>\n<p>clear that we have not expressed any opinion on the merits of the cases<\/p>\n<p>which are to be adjudicated in trial.\n<\/p>\n<p id=\"p_33\">\n<p><span class=\"hidden_text\" id=\"span_10\">                                        12<\/span>\n<\/p>\n<p id=\"p_34\">12.
