In writ Petition no. CW 1545\/1997? The Hon&#8217;ble High Court of Delhi vide<br \/>\n       its order dated 17-09-2002 directed the MCD as follows:- &#8220;In view of<br \/>\n       therefore the only direction liable to be passed is to direct respondent no. 1<br \/>\n       to carry out inspection of the property in question within a period of four<br \/>\n       weeks from today and in case any violation is found both in respect of the<br \/>\n       construction or user, to take action in accordance with law within four<br \/>\n       weeks therefore, writ petition stands disposed of in the aforesaid terms.\n<\/p>\n<p id=\"p_4\">2.     In view of the above order, the Dy. Commissioner vide his criminal<br \/>\n       complaint dated 23.03.2004 under Section 347\/461 of MCD Act, 1957.<br \/>\n       directed the Municipal prosecutors to prosecute the accused who had \/ has<br \/>\n       committed an offence under Section 347\/461 of the BMC Act.\n<\/p>\n<p id=\"p_5\">3.     Even after the prosecution of the accused party was ordered by DC (DE),<br \/>\n       MCD the accused continued to violate section 347 of the DMC Act, and is<br \/>\n       still continuing the same. In this context. The following information is<br \/>\n       sought under the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_6\"> i)      What action was taken by the Municipal prosecutor on the criminal<br \/>\n        complaint referred to him by the Dy. Commissioner (City Zone) on<br \/>\n        23.03.2004?\n<\/p>\n<p id=\"p_7\">ii)     When was the case challaned in the Court and in which Court?\n<\/p>\n<p id=\"p_8\">iii)    When and what order was passed by the Court, A copy of the order be<br \/>\n        furnished?\n<\/p>\n<p id=\"p_9\">iv)     Since the accused is still violating section 347 of BMC Act, What<br \/>\n        cognizance the Municipal prosecutor has taken in this behalf and with what<br \/>\n        result.\n<\/p>\n<p id=\"p_10\">The PIO replied.\n<\/p>\n<p id=\"p_11\">Not replied.\n<\/p>\n<p id=\"p_12\">First Appellate Authority Ordered:\n<\/p>\n<p id=\"p_13\">Not replied.\n<\/p>\n<p id=\"p_14\">Relevant facts emerging during hearing:\n<\/p>\n<p id=\"p_15\">The following were present.\n<\/p>\n<p id=\"p_16\">Appellant: Absent<br \/>\nRespondent: Mr. Sushil Kumar deemed PIO<br \/>\nThe PIO has given no information at all to the appellant and there is no reason for this.<br \/>\nThe First appellate authority Shri Vijay singh is also guilty of dereliction of duty<br \/>\nsince he has not passed any order.\n<\/p>\n<p id=\"p_17\">Decision:\n<\/p>\n<p id=\"p_18\">The Appeal is allowed.\n<\/p>\n<p id=\"p_19\">The PIO will provide the complete information to the appellant before<br \/>\n5 May 2009.\n<\/p>\n<p id=\"p_20\">The issue before the Commission is of not supplying the complete, required<br \/>\ninformation by the deemed PIO Mr. Sushil Kumar within 30 days as required<br \/>\nby the law.\n<\/p>\n<p id=\"p_21\">From the facts before the Commission it is apparent that the deemed PIO is guilty<br \/>\nof not furnishing information within the time specified under sub-section (1) of<br \/>\n<a href=\"\/doc\/1831074\/\" id=\"a_1\">Section 7<\/a> by not replying within 30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. It<br \/>\nappears that the deemed PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_3\">Section 20<\/a> (1) .<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to<br \/>\nthe Commission to show cause why penalty should not be levied on him.<br \/>\nHe will present himself before the Commission at the above address on 18 May<br \/>\n2009 at 5.00 pm alongwith his written submissions showing cause why penalty<br \/>\nshould not be imposed on him as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_4\">Section 20<\/a> (1).
