Whether the judgment should be reported in the Digest ?\n<\/p>\n<p id=\"p_6\">                                ***<\/p>\n<p>AJAY TEWARI, J (Oral)<\/p>\n<p>             This appeal has been filed against the judgment of the learned<\/p>\n<p>lower appellate Court reversing that of the trial Court and thereby decreeing<\/p>\n<p>the suit of the plaintiffs\/respondents No.1 to 4 for declaration that they were<\/p>\n<p>co-owners of the land in dispute and in joint possession with the appellants.<\/p>\n<p id=\"p_7\">             The learned lower appellate Court on a conspectus of the entire<\/p>\n<p>evidence found that respondents No.1 to 4 were in fact the widow and<\/p>\n<p>children of deceased-Prabhu. The case of the appellants on the other hand<\/p>\n<p>was that Prabhu had died unmarried and issueless.\n<\/p>\n<p id=\"p_8\"> R.S.A No. 1310 of 2007                                     ::2::\n<\/p>\n<p id=\"p_9\">            The following questions have been proposed :-<\/p>\n<blockquote id=\"blockquote_1\"><p>                   &#8221; i)   Whether the reversal of findings of the trial Court<\/p>\n<p>                   by the first appellate Court is a clear misreading of<\/p>\n<p>                   evidence ?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                   ii)    Whether the plaintiffs have discharged their onus<\/p>\n<p>                   to prove that they are the legal heirs of deceased Prabhu?<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                   iii)   Whether the evidence produced by the plaintiffs is<\/p>\n<p>                   sufficient to prove the identity of the plaintiffs ?<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                   iv)    Whether the plaintiffs have produced sufficient<\/p>\n<p>                   evidence to prove that Shanti was legally married wife of<\/p>\n<p>                   deceased Prabhu ?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                   v)     Whether the findings of complete ouster recorded<\/p>\n<p>                   by the trial Court have been wrongly upset by the first<\/p>\n<p>                   appellate Court by misreading of evidence ?<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                   vi)    Whether the findings recorded by the first<\/p>\n<p>                   appellate Court on the question of limitation is not<\/p>\n<p>                   legally sustainable ?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                   vii)   Whether oral evidence of PW Manbhawati who<\/p>\n<p>                   herself suffered a decree in favour of Suraj Bhan, is<\/p>\n<p>                   liable to be discarded ?&#8221;\n<\/p><\/blockquote>\n<p id=\"p_10\">            It would be seen that questions No.(i) to (v) and (vii) are pure<\/p>\n<p>questions of fact. Counsel for the appellants has taken me through the<\/p>\n<p>findings and the evidence recorded on these questions by the learned lower<\/p>\n<p>appellate Court.     I, however, regret my inability to agree with the<\/p>\n<p>contentions that the findings recorded are either based on no evidence or are<\/p>\n<p>based on such misreading of evidence as would render the same perverse.\n<\/p>\n<p id=\"p_11\"> R.S.A No. 1310 of 2007                                    ::3::\n<\/p>\n<p id=\"p_12\">With regard to question No. (vi), the same is a question of law. I find that<\/p>\n<p>this question has actually been decided by the learned appellate Court by<\/p>\n<p>holding that respondents No.1 to 4 had filed a suit on the basis of title and,<\/p>\n<p>thus, was within limitation.\n<\/p>\n<p id=\"p_13\">             Consequently, holding the questions proposed against the<\/p>\n<p>appellants, this appeal is dismissed with no order as to costs.<\/p>\n<p id=\"p_14\">             As the main appeal has since been dismissed, all the pending<\/p>\n<p>civil miscellaneous applications, if any, also stand disposed of.<\/p>\n<pre id=\"pre_1\">                                          ( AJAY TEWARI             )\nSeptember     01, 2009.
