If nothing has been done who is responsible for<br \/>\n       it?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>    3) Provide the name, address and phone no. of the officer appointed for both the circles. Also tell<br \/>\n       from how much time he is working on this post?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>    4) Provide the detail of the property of both the officer of the circle? What is their total salary and<br \/>\n       their total property?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>    5) When will the problems be solved? If it will not be solved than who will be responsible for that<br \/>\n       and what action would be taken against the same?\n<\/p><\/blockquote>\n<p id=\"p_2\">First Appeal:\n<\/p>\n<p id=\"p_3\">Reply was unsatisfactory<\/p>\n<p>FAA order:\n<\/p>\n<p id=\"p_4\">Smt. Veenu Ganesh was present. Appellant absent. Reply of queries 1 and 2 completely irrelevant.<br \/>\nPIO to provide information on query 1 and 2 within 7 days.\n<\/p>\n<p id=\"p_5\">Ground of the Second appeal:\n<\/p>\n<p id=\"p_6\">The appellant states that the information given to him by the PIO is incomplete and unsatisfactory.\n<\/p>\n<p id=\"p_7\">Submission from the PIO:\n<\/p>\n<p id=\"p_8\">Specific information on query 1 and 2 as per the order of the FAA was sent on 24\/11\/2010.<br \/>\n Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_9\">The following were present<br \/>\nAppellant : Mr. Mahesh Rathi;\n<\/p>\n<p id=\"p_10\">Respondent : Mr. Bhagat Ram, FSO(C-63) on behalf of Mr. R. K. Meena, PIO &amp; AC (NE);\n<\/p>\n<p id=\"p_11\">        The Appellant had sought information on certain queries on Circle 62 &amp; 63. Despite the FAA&#8217;s<br \/>\norder stating that irrelevant information has been given regarding query-1 &amp; 2 and his direction to<br \/>\nprovide the information within 07 days the PIO did not supply any information. It appears that he<br \/>\nbelieves the Information Commission reminder service for him. After receiving the intimation of<br \/>\nhearing for second appeal he has sent information regarding Circle-63 on 08\/04\/2011. The Appellant<br \/>\nstates that this information regarding Circle-63 is also incomplete. The Appellant states that only 20<br \/>\ncomplaints have been listed whereas he himself had approached PGC with two complaints which are<br \/>\nnot shown in the list. Hence he alleges that the information provided is incomplete.\n<\/p>\n<p id=\"p_12\">The Respondent states that the then PIO was Mr. Subodh Kumar the then AC(NE).\n<\/p>\n<p id=\"p_13\">Decision:\n<\/p>\n<p id=\"p_14\">The appeal is allowed.\n<\/p>\n<p id=\"p_15\">      The PIO is directed to provide the complete information on Circle-62 &amp; 63 to the<br \/>\nAppellant before 10 May 2011. He will also certify that all complaints have been listed<br \/>\nwhich have been received during the period.\n<\/p>\n<p id=\"p_16\">The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO Mr. Subodh Kumar the then AC(NE) within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it appears that the then PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within 30<br \/>\ndays, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. He has further refused to obey the orders of his superior<br \/>\nofficer, which raises a reasonable doubt that the denial of information may also be malafide. The First<br \/>\nAppellate Authority has clearly ordered the information to be given.\n<\/p>\n<p id=\"p_17\">It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p id=\"p_18\">Mr. Subodh Kumar the then AC(NE) will present himself before the Commission at the above address<br \/>\non 23 May 2011 at 10.30am alongwith his written submissions showing cause why penalty should not<br \/>\nbe imposed on him as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1). He will also submit proof of having given the<br \/>\ninformation to the appellant.\n<\/p>\n<p id=\"p_19\">If there are other persons responsible for the delay in providing the information to the Appellant the<br \/>\nPIO is directed to inform such persons of the show cause hearing and direct them to appear before<br \/>\nthe Commission with him.\n<\/p>\n<p id=\"p_20\">This decision is announced in open chamber.\n<\/p>\n<p id=\"p_21\">Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this Order will be provided free of cost as per <a href=\"\/doc\/383252\/\" id=\"a_3\">Section 7(6)<\/a> of RTI Act.\n<\/p>\n<p id=\"p_22\">                                                                                                    Shailesh Gandhi<br \/>\n                                                                                          Information Commissioner<br \/>\n                                                                                                       21 April 2011<br \/>\n(In any correspondence on this decision, mention the complete decision number.)
