(J)\nPARIPOORNAN, K.S.(J)\n\nCITATION:\n 1996 SCC  (3) 585\t  JT 1996 (4)\t213\n 1996 SCALE  (3)389\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     The  appellant   had   contested\telection   fram\t  72<br \/>\nBethamangala  Assembly\t Constitueney  of   Karnataka  State<br \/>\nLegislature as\treserved candidate The appellant claimed the<br \/>\nstatus of  Mundala which  is a\trecognised  Scheduled  Caste<br \/>\nnotified by  the Pregident  of India  in exercise  of  power<br \/>\nunder <a href=\"\/doc\/68762\/\" id=\"a_1\">Article  341 [1l<\/a> of the Constitution. He contested the<br \/>\nsaid election  on that\tbasis and  stood  elected.  When  an<br \/>\nelection pSetitlon  was laid  by the  first respondents\t the<br \/>\nHigh Court  found that\tthe caste  to  which  the  appellant<br \/>\nbelongs is  Mondy\/Mondigaru. The  High Court on the basis Of<br \/>\nevidence on  record  found  that  the  appellant,  in  fact,<br \/>\nbelongs t.o  Mondy\/Mondigaru caste  which was not recognised<br \/>\nas a Scheduled Caste in the Presidential notification  There<br \/>\nfore the  High Court  declared by  the impugned\t order dated<br \/>\nApril 30,1987 passed in Election petition No.21 of 1985 that<br \/>\nhis elections  to the Assembly constituency allotted to thee<br \/>\nScheduled Caste was not valid in law. Thus this appeal.\n<\/p>\n<p id=\"p_1\">     The question  before us  is. whether  the status of the<br \/>\nappe11ant who  is a  Mondy\/Mondigaru, can  be considered  as<br \/>\nMundala &#8211;  a Scheduled\tCaste synonym,\tfor the\t purpose  of<br \/>\nelection to  the Legistative  Assembly?\t <a href=\"\/doc\/68762\/\" id=\"a_1\">Article  341<\/a>  reads<br \/>\nthus:s<br \/>\n     &#8220;341.  Scheduled  Castes.\t[1]  The<br \/>\n     President may  with respect  to any<br \/>\n     State or Union Territory, and where<br \/>\n     it is  a State  after  consultation<br \/>\n     with  the\t Governor  thereof,   by<br \/>\n     public notifications,  specify  the<br \/>\n     castes, races,  or tribes\tor parts<br \/>\n     of or  groups Within  castes, races<br \/>\n     or\t tribes\t  which\t shall\tfor  the<br \/>\n     purposes of  this\tConstitution  be<br \/>\n     deemed to\tbe Scheduled  Castes  in<br \/>\n     relation to  that\tState  or  Union<br \/>\n     Territory, as the case may be.\n<\/p>\n<p id=\"p_2\">     [2] Parliament  may by  law include<br \/>\n     in or  exclude  from  the\tlist  of<br \/>\n     Scheduled\tCastes\tspecified  in  a<br \/>\n     notification  issued  under  clause<br \/>\n     [1] any  caste, race  or  tribe  or<br \/>\n     part of  or group within any caste,<br \/>\n     rece  or\ttribe,\t but   save   as<br \/>\n     aforesaid\ta   notification  issued<br \/>\n     under the\tsaid clause shall not be<br \/>\n     varied    by     any,    subsequent<br \/>\n     notification&#8221;.\n<\/p>\n<p id=\"p_3\">     A reading\tthereof\t would\tclearly\t indicate  that\t the<br \/>\nPresident may, with respect to any State or Union Territory,<br \/>\nafter\tconsu1tarion\twith   the   Governor,\t by   public<br \/>\nnotification, specify  the castes,  races or tribes or parts<br \/>\nof or groups within castes, races or tribes which shall, for<br \/>\nthe purposes  of this Constitution be deemed to be Scheduled<br \/>\nCastes in  relation to that State or Union Territory, as the<br \/>\ncase may  be. Under  clause [2]\t thereof the  Parliament has<br \/>\nbeen empowered\tby law\teither to include in or exclude from<br \/>\nthe list  of Scheduled\tCastes specified  by  the  President<br \/>\nunder clause  [1] of <a href=\"\/doc\/68762\/\" id=\"a_2\">Article 341<\/a> any caste, race or tribe or<br \/>\npart of\t or group within any caste, race or tribes. Once the<br \/>\nParliament by  law includes  in or  excludes from  any race,<br \/>\ncaste, tribe,  parts of\t or groups within any caste, race or<br \/>\ntribes, the President thereafter shall have no power to vary<br \/>\nby any\tsubsequent notification\t the said caste, race, tribe<br \/>\nor part of or group within any caste, race or tribe. Thus it<br \/>\ncould be  seen that since the caste Mondy\/Mondigaru does not<br \/>\nadmittedly find\t place in  the notification  issued  by\t the<br \/>\nPresident or  as amended  by the  Scheduled  Caste\/Scheduled<br \/>\nTribes [Amendment  Order]  Act,\t 1976,\tthe  status  of\t the<br \/>\nappellant as  Mundala cannot  be considered to be synonymous<br \/>\nof or  equivalent  to  Mondy\/Mondigaru\tas  claimed  by\t the<br \/>\nappellant. This\t Court in  a recent  judgment  in  NItyanand<br \/>\nSharma v. State of Bihar [JT 1996 (2) SC 117] has considered<br \/>\nthe scope  of the  power of the Court to declare the entries<br \/>\nof the\tPresidential notification  under <a href=\"\/doc\/1874527\/\" id=\"a_3\">Article 342 [1]<\/a> and<br \/>\nhad held that no court has power to give such a declaration.<br \/>\nThe limited scope of enquiry is whether the caste claimed by<br \/>\nthe candidates\tfinds  place  in  the  notification  of\t the<br \/>\nPresident  as\tamended\t under\tthe  Act.  The\tHigh  Court,<br \/>\ntherefore, was\tright in  its conclusion  that the appellant<br \/>\ncannot have  the status\t of Scheduled  Caste to\t contest the<br \/>\nsaid Legislative  Assembly election. The learned counsel for<br \/>\nthe appellant  has relied  upon <a href=\"\/doc\/313846\/\" id=\"a_4\">Revenue\t Officer &amp;  Ors.  v.<br \/>\nPrafulla Kumar Pati &amp; Ors<\/a>. [(1990) 2 SCC 162]. In that case,<br \/>\nadmittedly Dhoba  is one  of the  castes recognised  by\t the<br \/>\nPresident as  Schedule Caste  in relation  to the  State  of<br \/>\nOrissa. Since  the appellant tharein claimed the status as a<br \/>\nRajaka in  one of  the sale deeds, it was sought to deny him<br \/>\nthe benefits  conferred on  Scheduled Castes. This Court had<br \/>\nheld that  since the  President has  notified  Dhoba  to  be<br \/>\nScheduled Caste\t in relation  to the State of Orissa, merely<br \/>\nbecause he  described himself  to be  a Rataka in one of the<br \/>\nsale deeds,  his status\t as a  Scheduled Caste\tis not taken<br \/>\naway  by   such\t description.\tThe  ratio  therein  has  no<br \/>\napplicatin to the facts in this case.\n<\/p>\n<p id=\"p_4\">     The appeal is dismissed accordingly.
