JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate :\n19\/10\/2011  \nORAL ORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\npetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p id=\"p_1\">&#8220;(A)\tTo<br \/>\nissue a writ of mandamus or any other appropriate writ,<br \/>\norder or direction<br \/>\ndirecting respondent No.2 to correct the birth date of the petitioner<br \/>\nas 01\/09\/1990 instead of 20\/09\/1990 and name as Patel Dhavalkumar<br \/>\nMahendrabhai instead of Patel Gautamkumar Mahendrakumar in the birth<br \/>\ncertificate.\n<\/p>\n<p id=\"p_2\">(B)\tIn<br \/>\nthe birth register and accordingly, respondent No.2 may be directed<br \/>\nto issue a new correct birth certificate to the petitioner as<br \/>\naforesaid;\n<\/p>\n<p id=\"p_3\">(C)\tPass<br \/>\nsuch other and further order in the interest of justice which may be<br \/>\ndeemed fit to this Hon&#8217;ble Court.&#8221;\n<\/p>\n<p id=\"p_4\">2.\tBriefly<br \/>\nstated, the case of the petitioner is that his name has wrongly been<br \/>\nmentioned in the Birth Certificate as &#8216;Patel<br \/>\nGautamkumar Mahendrakumar&#8217; whereas the correct name of<br \/>\nthe petitioner is &#8216;Patel<br \/>\nDhavalkumar Mahendrabhai&#8217;. Similarly, the correct date<br \/>\nof birth of the petitioner is 01.09.1990, which has been wrongly<br \/>\nreflected in the Birth Certificate as 20.09.1990. The petitioner made<br \/>\nan application to respondent No.2 for correction of his name and date<br \/>\nof birth that has been rejected by the said respondent by<br \/>\ncommunication dated 20.09.2011, on the ground that he does not have<br \/>\nthe jurisdiction to make the necessary correction.\n<\/p>\n<p id=\"p_5\">3.\tHeard<br \/>\nMr.D.K.Chaudhari, learned advocate for the petitioner and perused the<br \/>\naverments made in the petition and documents annexed thereto. It is<br \/>\nsubmitted by the learned advocate for the petitioner that the<br \/>\nimpugned communication of respondent No.2 is not in consonance with<br \/>\n<a href=\"\/doc\/626597\/\" id=\"a_1\">Section 15<\/a> of<br \/>\nthe Registration of Births and <a href=\"\/doc\/1636244\/\" id=\"a_2\">Deaths Act<\/a>, 1969 (&#8220;<a href=\"\/doc\/1636244\/\" id=\"a_3\">The Act<\/a>&#8221;<br \/>\nfor short) and Rule 11 of the Gujarat Registration of Births and<br \/>\nDeaths Rules, 2004 (&#8220;The Rule&#8221; for short),<br \/>\nwhereby the Competent Authority, which in this case is respondent<br \/>\nNo.2, is vested with the power to make a correction in the entry in<br \/>\nthe Register of Births and Deaths, maintained by him on it being<br \/>\nproved to his satisfaction that such a correction deserves to be<br \/>\nmade. The learned advocate for the petitioner has further referred to<br \/>\nthe judgment of this Court rendered in the case of Nitaben<br \/>\nNareshbhai Patel Vs. State of Gujarat and others &#8211; 2008 (1) GLR<br \/>\n884, wherein it has been laid down that if<br \/>\nthe Competent Authority does not exercise the jurisdiction vested in<br \/>\nhim, as per Section-15 of the Act and Rule-11 of the Rules, a writ of<br \/>\nmandamus can be issued.\n<\/p>\n<p id=\"p_6\">4.\tHaving<br \/>\nheard the learned advocate for the petitioner, it would be pertinent<br \/>\nto refer to the relevant provisions of law. Section-15 of the Act<br \/>\nreads as under :\n<\/p>\n<p id=\"p_7\">&#8220;15.\n<\/p>\n<p id=\"p_8\">Correction or cancellation of                entry in the register of<br \/>\nbirths and deaths- If<br \/>\nit is proved to the satisfaction of                the Registrar that<br \/>\nany entry of a birth or                death in any register kept by<br \/>\nhim under                this Act is erroneous in form or substance,<br \/>\n              or has been fraudulently or improperly<br \/>\nmade, he may, subject to such rules as may                be made by<br \/>\nthe State Government with                respect<br \/>\nto the conditions on which and the                circumstances in<br \/>\nwhich such entries may be                corrected or cancelled<br \/>\ncorrect the error                or cancel the entry by suitable<br \/>\nentry in                the margin, without any alteration of the<br \/>\n           original entry, and shall sign the marginal<br \/>\nentry and add thereto the date of the                correction or<br \/>\ncancellation.&#8221;\n<\/p>\n<p id=\"p_9\">4.1\tRule-11<br \/>\nof the Rules is reproduced hereinbelow :\n<\/p>\n<p id=\"p_10\">&#8220;11.\n<\/p>\n<p id=\"p_11\">Correction or cancellation of entry in the register of births and<br \/>\ndeaths :(1) If it is  reported to the registrar that a<br \/>\nclerical or formal error has been made in the register, or if such<br \/>\nerror is otherwise noticed by him and if the register is in his<br \/>\npossession, the    Registrar shall enquire into the matter and if he<br \/>\nis satisfied that any such error has been made, he shall correct the<br \/>\nerror(by correcting or cancelling the entry) as provided in Sec. 15<br \/>\nof the Act and shall send an extract of the entry showing the error<br \/>\nand how it has been corrected to the District Registrar of Births and<br \/>\nDeaths.\n<\/p>\n<p id=\"p_12\">(2)\tIn the case referred to in sub-rule (1)   if the register is not in the possession the  Registrar, he\/she shall make a report to the District Registrar of Births and Deaths and call for the relevant register and after inquiring into the matter, if he is satisfied that any such error has been  made, make the necessary correction.<br \/>\n(3)\tAny such correction as mentioned in sub  rule (2) shall be countersigned by the  District Registrar of Births and Deaths when the  register is received from the Registrar.\n<\/p>\n<p id=\"p_13\">(4)\tIf  any  person  asserts that any entry in the register of births and  deaths is  erroneous  in  substance, the Registrar may  correct  the  entry  in the manner prescribed under Sec. 15 of the Act upon production by that person a declaration setting forth the nature of the error and true facts of the case made by two  credible persons having knowledge of the     facts of the case.\n<\/p>\n<p id=\"p_14\">(5)\tNotwithstanding anything contained in sub  rule (1) and sub rule (4), the Registrar shall make report of any correction of the kind referred to therein giving necessary details  to  the  District Registrar of Births and Deaths.\n<\/p>\n<p id=\"p_15\">(6)\tIf it is proved to the satisfaction of the  Registrar that any entry in the register of  births and deaths  has been made fraudulently or improperly, he shall make a report giving necessary details to the officer authorized   by  the chief Registrar by general or special order in this behalf  under Sec. 25 of the Act and on hearing from him take necessary action in the matter.\n<\/p>\n<p id=\"p_16\">(7)\tIn<br \/>\nevery case in which an entry  is corrected or cancelled under this<br \/>\nrule,   intimation thereof should be sent to the  permanent address<br \/>\nof the person who has given  information under  Sec. 8 or Sec.9 of<br \/>\nthe Act.&#8221;\n<\/p>\n<p id=\"p_17\">5.\tIn<br \/>\nNitaben N.Patel Vs. State of Gujarat and<br \/>\nothers (Supra), this Court has culled out the following<br \/>\nprinciples of law :\n<\/p>\n<p id=\"p_18\">\t&#8220;26.***********<\/p>\n<p>\t(A)***********<\/p>\n<p>&#8220;(B)\t<a href=\"\/doc\/626597\/\" id=\"a_4\">Section<br \/>\n15<\/a> of the Act of 1969 read with Rule 11 of the State Rules, 2004<br \/>\nalong with Chapter 9, Clause 9.6 and 9.7 of the Handbook of Registrar<br \/>\nGeneral, Ministry of Home Affairs, Govt. of India and Clause 5.8 of<br \/>\nChapter 5 of guidelines contained in vernacular Gujarati adequately<br \/>\nconferred power upon the authority to correct\/cancel erroneous<br \/>\nentries and provide for complete mechanism for types of errors to be<br \/>\ncorrected.\n<\/p>\n<p id=\"p_19\">(C)\t<a href=\"\/doc\/626597\/\" id=\"a_5\">Section<br \/>\n15<\/a> of the Act of 1969 empowers Registrar of Birth and Death to<br \/>\ncorrect  any erroneous entry in form or substance or any entry<br \/>\nwhich has been fraudulently or improperly made.   Rule 11 of<br \/>\nRules, 2004 and particularly Sub-Rule (1) provide for any entry, any<br \/>\nerror which may be clerical or formal and Sub-Rule 4  of the<br \/>\nabove Rule 11 mention about any entry which may be erroneous in<br \/>\nsubstance and Sub-Rule 6 of Rule 11 refer to any entry which is<br \/>\nfraudulently or improper is to be corrected by the Registrar and an<br \/>\nelaborate procedure is provided which prescribe method and manner in<br \/>\nwhich such entry to be corrected or cancelled and report to be made<br \/>\nto the higher authority, which may rule out in misuse of power by<br \/>\nregistering authorities.\n<\/p>\n<p id=\"p_20\">\tThus,<br \/>\nclause 9.6 and 9.7 of Chapter 9 of the Handbook of Registrar General,<br \/>\nMinistry of Home Affairs, Govt. of India provide for corrections and<br \/>\ncancellations of entries and contain clerical or formal error, error<br \/>\nin substance or fraudulent or improper entry and once any error in<br \/>\nsubstance is to be corrected, it covers error of such nature which is<br \/>\nan error of substance or form. That similar types of errors are<br \/>\nmentioned in Clause 5.8 of Chapter 5 of vernacular guidelines<br \/>\npublished by the State Authorities under the Act.\n<\/p>\n<p id=\"p_21\">(D)**********<\/p>\n<p>(E)<br \/>\n When the authority empowered to exercise power under Sec. 15 of<br \/>\nthe Act and Rule 11 of the State Rules, 2004, refuse to do so, writ<br \/>\npetition is maintainable under <a href=\"\/doc\/1712542\/\" id=\"a_6\">Article 226<\/a> of the Constitution of<br \/>\nIndia for issuing appropriate directions to the authority.\n<\/p>\n<p id=\"p_22\">(F)\tThe<br \/>\nkind and types of directions to be issued to the authority depend on<br \/>\nfacts and circumstances of the each case and nature of denial of<br \/>\nlegal right to the aggrieved persons by the authority.&#8221;<br \/>\n(emphasis supplied)<\/p>\n<p id=\"p_23\">6.\tFrom<br \/>\na cumulative reading of the provisions of law mentioned hereinabove<br \/>\nin light of the principles of law laid  down in the above-quoted<br \/>\njudgment, it is evident that respondent No.2 is vested with the power<br \/>\nand jurisdiction to make a correction in the entry regarding the name<br \/>\nand date of birth of the petitioner, in the eventuality that he is<br \/>\nsatisfied that such a correction is required to be made.\n<\/p>\n<p id=\"p_24\">7.\tIn<br \/>\nview of the above, the ground on which the application of the<br \/>\npetitioner has been rejected, vide communication dated 20.09.2011,<br \/>\nnamely, that respondent No.2 is not vested with the power to make the<br \/>\nnecessary correction, is not in consonance with the provisions of law<br \/>\nor the principles of law enunciated in the above-mentioned judgment.\n<\/p>\n<p id=\"p_25\">8.\tIn<br \/>\nview of the above, the following directions would meet the ends of<br \/>\njustice :\n<\/p>\n<p id=\"p_26\">\tRespondent<br \/>\nNo.2 is directed to consider and decide the application made by the<br \/>\npetitioner dated 20.09.2011 afresh and, in accordance with law,<br \/>\nwithin a period of six weeks from the date of receipt of a copy of<br \/>\nthis order.\n<\/p>\n<p id=\"p_27\">\tThe<br \/>\npetition is disposed of, in the above terms, without entering into<br \/>\nthe merits of the case.\n<\/p>\n<p id=\"p_28\">\tDirect<br \/>\nService of this order is permitted.\n<\/p>\n<p id=\"p_29\">(Smt.\n<\/p>\n<p id=\"p_30\">Abhilasha Kumari, J.)<\/p>\n<p>~gaurav~<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Patel vs State on 19 October, 2011 Author: Abhilasha Kumari, Gujarat High Court Case Information System Print SCA\/15668\/2011 9\/ 9 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 15668 of 2011 ========================================================= PATEL DHAVALKUMAR MAHENDRABHAI &#8211;
