Writ petition is field aggrieved by detention of<\/p>\n<p>transport effected, on issuing Ext.P5 notice under Section<\/p>\n<p>47 (2) of the Kerala Value Added Tax Act, 2003 (KVAT Act).<\/p>\n<p>The reason for detention mentioned in Ext.P5 is that the<\/p>\n<p>date furnished in the Delivery Note which accompanied the<\/p>\n<p>transport, is 12.11.2009, whereas the transport was<\/p>\n<p>effected on 12.12.2009. Copy of the Delivery Note which<\/p>\n<p>accompanied the transport is produced as Ext.P3. It seems<\/p>\n<p>that the suspicion is raised on the basis that there is a<\/p>\n<p>correction effected while noting the date in the Delivery<\/p>\n<p>Note. Contention of the petitioner is that inspite of that<\/p>\n<p>minor correction the date is clearly legible as, &#8220;12.12.09&#8221;.<\/p>\n<p>Onward transport is detained seeking to furnish security<\/p>\n<p>deposit to the tune of Rs.26,834\/-.\n<\/p>\n<p id=\"p_1\">W.P.(C)No. 36445 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -2-<\/span><\/p>\n<p id=\"p_2\">      2.    Without adjudication on the merits regarding the<\/p>\n<p>reason for detention, I am of the opinion that the allegation<\/p>\n<p>contained in Ext.P5 is only in the nature of a discrepancy<\/p>\n<p>with respect to the document accompanying the transport.<\/p>\n<p>The petitioner being a registered dealer, I am of the opinion<\/p>\n<p>that pending finalisation of the adjudication, the goods can<\/p>\n<p>be released on its furnishing Security Bond, as provided<\/p>\n<p>under proviso to Section 47 (2).\n<\/p>\n<p id=\"p_3\">      3.    In the result the writ petition is disposed of<\/p>\n<p>directing the 2nd respondent to release the goods detained<\/p>\n<p>under Ext.P5 notice along with the vehicle, on the petitioner<\/p>\n<p>furnishing Security Bond in the form provided under the<\/p>\n<p>KVAT Rules, without sureties, for the value of amounts<\/p>\n<p>demanded under Ext.P5.\n<\/p>\n<p id=\"p_4\">      4.      The competent authority under Section 47 (5) &amp;<\/p>\n<p>(6) of the KVAT Act is directed to finalise the adjudication<\/p>\n<p>proceedings and to pass final order, after affording<\/p>\n<p>opportunity to the petitioner, as early as possible, at any<\/p>\n<p>W.P.(C)No. 36445 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            -3-<\/span><\/p>\n<p>rate within a period of one month from the date of release<\/p>\n<p>of the goods.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                     C.K.
