APPEAL  NO.236  OF 2002\n\n                          ----------------------------------------\n\n\n                       Dated this the 31st day of May,  2007\n\n\n                                      JUDGMENT\n<\/pre>\n<p id=\"p_1\">       This appeal is  preferred by the complainant in C.C. No.391 of 1999<\/p>\n<p>on   the   file   of   the   Judicial   First   Class   Magistrate&#8217;s   Court,   Kayamkulam.\n<\/p>\n<p id=\"p_1\">The   complaint   was   filed   against   the   first   respondent   herein   alleging<\/p>\n<p>commission   of   offence   punishable   under   <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section   138<\/a>   of   the   Negotiable<\/p>\n<p>Instruments Act, 1881.\n<\/p>\n<p id=\"p_2\">       2.     The case of the complainant &#8211; appellant was that the accused &#8211;\n<\/p>\n<p id=\"p_3\">first respondent herein  borrowed from him an amount of Rs.4,50,000\/- in<\/p>\n<p>two instalments and issued Exts.P1 and P2 cheques for Rs.2,25,000\/- each<\/p>\n<p>towards   discharge   of   the   said   liability.         The   further   case   of   the<\/p>\n<p>complainant was that when Exts.P1 and P2 cheques were presented to the<\/p>\n<p>bank for encashment, both the cheques were dishonoured on the ground of<\/p>\n<p>insufficiency of funds in the account of the first respondent.  On receipt of<\/p>\n<p>intimation   regarding   dishonour   of   the   cheques,   the   appellant   issued<\/p>\n<p>statutory   notice   to   the   first   respondent   who   refused   to   accept   the   same.\n<\/p>\n<p id=\"p_4\">Accordingly, the complaint was filed.   To prove the case against the first<\/p>\n<p>respondent, the appellant was examined as PW.1 and Exts.P1 to P6 were<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.APPEAL NO.236\/2002                          2<\/span><\/p>\n<p>produced.             On   closing  the evidence of the complainant, the accused<\/p>\n<p>was questioned under <a href=\"\/doc\/767287\/\" id=\"a_1\">Section 313<\/a> Cr.P.C.  Denying the allegations in the<\/p>\n<p>complaint, the accused  stated that he had not borrowed any amount from<\/p>\n<p>the appellant as alleged.  At the same time, the first respondent had a case<\/p>\n<p>that   the   cheques   in   question   were   given   to   the   appellant   as   security   for<\/p>\n<p>some amount borrowed by one Chandran from the appellant.  To prove the<\/p>\n<p>case set up  by the first respondent, he relied on Ext.D1 letter   alleged to<\/p>\n<p>have been issued by the appellant.   After considering the entire evidence,<\/p>\n<p>the trial court  as per judgment dated 31.10.2001 acquitted the accused on<\/p>\n<p>the  ground  that  the appellant  failed  to  prove  the case  against  him.     The<\/p>\n<p>said judgment is challenged in this appeal.\n<\/p>\n<p id=\"p_5\">        3.  This Court heard the learned counsel appearing for the appellant.\n<\/p>\n<p id=\"p_6\">It is seen that the trial court acquitted the accused on the sole ground set up<\/p>\n<p>by the first respondent that the cheques in question were issued by him as<\/p>\n<p>security for the amount alleged to have been borrowed by one Chandran.\n<\/p>\n<p id=\"p_7\">From   the   evidence   now   adduced   by   the   appellant,   it   is   not   possible   to<\/p>\n<p>conclude that Ext.D1 relied on by the first respondent can be considered as<\/p>\n<p>a   piece   of   evidence   to   rebut   the   presumption   available   to   the   appellant<\/p>\n<p>under   <a href=\"\/doc\/268919\/\" id=\"a_2\">Section   139<\/a>   of   the   Negotiable   Instruments   Act.       The   first<\/p>\n<p>respondent had admitted issuance of the cheques in question, but tried to<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.APPEAL NO.236\/2002                           3<\/span><\/p>\n<p>prove that those cheques were issued as security for the amount borrowed<\/p>\n<p>by   one   Chandran.     There   was   no   evidence   before   the   court   below   to<\/p>\n<p>conclude   that   Ext.D1   would   prove   that   the   cheques   were   issued   as<\/p>\n<p>suggested   by   the   first   respondent   during   cross-examination   of   the<\/p>\n<p>appellant.   The burden is on the first respondent to rebut the presumption<\/p>\n<p>available  in  favour  of  the  appellant  under  <a href=\"\/doc\/268919\/\" id=\"a_3\">Section  139<\/a>  of  the  Negotiable<\/p>\n<p>Instruments   Act.     There   is   no   circumstance   or   evidence   to   come   to   the<\/p>\n<p>conclusion that the cheques  in question were not issued as alleged in the<\/p>\n<p>complaint.\n<\/p>\n<p id=\"p_8\">        4.     In   the   above   circumstances,   this   Court   is   of   the   view   that   the<\/p>\n<p>judgment   of   the   court   below     requires   interference.     Accordingly,   the<\/p>\n<p>impugned   judgment   is   set   aside   and   the   matter   is   remanded   to  the   court<\/p>\n<p>below  for fresh  consideration.    It  is  made clear  that    the  parties  shall  be<\/p>\n<p>allowed to adduce additional evidence, if any.\n<\/p>\n<p id=\"p_9\">        The  Crl.   Appeal is  allowed by way of remand.
